    On 11/10/2022, 1 received a written complaint alleging the following information. Child A is being ., at the center by program director Mandy King. Child A disclosed that Ms. King hits him, and he is afraid of her. Child A sustained missing hair from his scalp and a scab on his knee. program director Mandy King, Witness 1, Child Care Staff Member 1 (CCSM 1), Child Care Staff Member 2 (CCSM 2), and Child Care Staff Member 3 (CCSM 3). Ms. King requested that Witness 1 be present during her interview for support. Ms. King stated that she had no knowledge of any mark on Child A's knee prior to this investigation. She reported that Child A's Mother sent her an email regarding the missing hair on Child A's head on 09129,2022. Child A's Mother had concerns that another child was pulling Child A's hair. Ms. King stated that she reviewed video recordings for the previous week, and she only saw Child A pulling out his own hair. After she reviewed the video recordings, she spoke to Child A's Mother and suggested that she take Child A to the doctor for the hair pulling. She also A suggested that she have Child bedue to some of his behaviors. Ps"ou Child A's Mother agreed with her a for his behaviors. Ms. King described Child A as well behaved, friendly, polite, and very sweet, but he has a that makes it difficult to understand him at times. Ms. King stated that Child As Mother was not consistent with Child A's child care schedule, which she believes could be contributing to Child A having difficulties adjusting to the daily routine and expectations. Consequently, she told Child A's Mother on 11/09/2022 that Child A would be disenrolled from the center if she were not able to keep a more consistent schedule for him. Ms. King reiterated that Child A is not a difficult child to manage. In fact, she could not recall one time that Child A had to even be redirected by staff. Ms. King questioned the allegations due to the fact that Child A told her that she met with Child A, and he did speak to her, difficult to understand him at times. Ms. King stated that there is no way that Child A is afraid of her because he runs up to her and hugs her whenever he sees her. Ms. King stated that there are more than two African American children who attend the center. She took out the enrollment list and counted approximately six African American children. Ms. King stated that she had no knowledge of Child A or any other African American children being made to stand against the playground fence. Ms. King denied every spanking or slapping a child. She denied seeing Child A with a puffy eye on 1110912022 or any other day. CCSM 1 stated that she has been employed with the center since September 2022. She identified herself as an assistant child care staff member in the preschool classroom. She does not remember anything unusual about Child A's last day at the center on 11/09/2022. She stated that children who need disciplined while on the playground either sit away from the other children or stand against the fence for a Ica five-minute break. She did not recall Child A needing to be disciplined on the playground on 11/09/2022. In fact, she does not recall any child being placed against the fence that day. She stated that Child A had missing patches of hair when she started working at the center. She was told by other staff members that Child A pulls his own hair. She has observed Child A picking at the area of missing hair. She has never seen Child A with a puffy eye. She did not have a problem understanding Child A when he spoke. CCSM 2 stated that he worked in Child A's classroom a few times, but he never observed any scratches on Child A. He stated that Child A says words clearly, but he does not say much. Child A would sometimes cause conflict when he tried to get other children to play with him, but overall, Child A was not a problem. He recalled Child A being up against the fence when Child A's Mother picked him up on 11/09/2022. He does not know which st

    On 04/14/2022, I spoke with Child A's Mother. She stated that Child A has been attending the center for since October of last year. Her husband received a phone call from Child Care Staff Member, Kindra Rienstra stating that Child A had crawled out of his high chair and that he has a small bump on his head. Her husband told her about it and they both immediately left their jobs to go to the center. She and her husband spoke with the program director Mandy King who wasn't aware of the incident when they arrived which was about an hour after it happened. They asked Ms. King to see the video footage and Ms. King told them she couldn't show them the video footage because other children were in the video. Ms. King told them that she would view the video and give them a call later. Ms. King called later but they decided not to talk until the following day. The following day Ms. King apologized for what happened and not knowing right away about the incident. She said that Ms. Rienstra was the person feeding Child A at the time. She told them that Ms. Rienstra walked away to attend to another child and asked her 2 assistant to get him down; however, the assistant was cleaning up a mess at the time. After cleaning up the mess she then went to go change another child and forgot to grab him. Meanwhile, he was banging on his tray, which came off, allowing him to fall out of the chair. On 04/14/2022, I conducted an unannounced on-site inspection and spoke with Licensee Designee and Program Director, Mandy King. She stated that she wasn't in the room when Child A fell out of the high chair; therefore, she did not witness the incident. However, she confirmed the details of events that were provided to me by Child A's Mother. Ms. King allowed me to observe the video which also confirmed that details given by Child A's Mother. I then spoke with Child Care Staff Member Kindra Rienstra regarding the incident. She stated that she was on the carpet feeding another infant and Child A was in his high chair because he had just finished eating. She said she asked Child Care Staff Member Aleyssa Gallarzo to get him; she agreed but she ended up grabbing another child to change her. Ms. Rienstra stated that Child A ended up falling out of his chair after the tray fell off from him bagging on it. Child Care Staff Member, Taylor Morrison put him in his chair. Ms. Rienstra stated that she called the parent immediately, completed the incident report and let the director know what happened. I also spoke with Child Care Staff Member Taylor Morrison. She said she wasn't there when Child A fell out of the chair, but she admits that she put him in the high chair and that she forgot to strap him in. She stated that she knows she is supposed to, but she forgot. ......................................................................... ....................

    On February 7, 2022, I made an unannounced on-site inspection at the child care center. I spoke with the program director, Mandy King, and child care staff members (CCSM) Janell Casper, Wendy Mendez, and Maggie Sharpe. Mandy King said at the end of the day on February 2, 2022, Child B's Mother told her that staff informed her about an incident in the gymnasium but that the stories 2 did not "match". Child B's Mother said that Janell Casper had told her that Child B and another child were playing on the slide and "kept falling on each other." Then Maggie Sharpe approached Child B's Mother in the hallway and asked her if Ms. Casper had informed her what had happened. Child B's Mother told Ms. King that Ms. Sharpe said the children were "grinding on each other." Ms. King said that later that evening she received a text from Child B's Mother letting her know that Child B had disclosed that Child A had "puts fingers into and it hurt while they were in the gymnasium. Ms. King stated she spo about t e allegation that same evening because they had a staff meeting scheduled. She said that Janell Casper was supervising a group of children in the gymnasium on the afternoon of February 3, 2022. Staff member, Wendy Mendez was also in the gymnasium at the time but was not "clocked in." Ms. King stated that Ms. Casper and Ms. Mendez told her the only incident that happened was that Child A and Child B were playing on a slide in the gymnasium and "kept falling on each other." Ms. King explained Ms. Casper told her that the first time this happened she verbally redirected the children. The second time she walked over and asked the children to play with something different. Ms. Mendez was in the gymnasium and saw the same events occur. She said that Ms. Sharpe told her she had spoken with Child B's Mother about the incident in the gymnasium and that the children were laying on top of each other and "grinding." Ms. King stated that neither Child A nor Child B have displayed patterns of inappropriate touching. Neither of the children have a behavior plan in place. Janell Casper said she is the assistant in the Infant room but was supervising the preschool and school age group in the gymnasium at the end of the day. The groups were combined due to low numbers. She said that the groups typically combine at the end of the day at approximately 5:00pm. Ms. Casper said that she and Maggie Sharpe were supposed to be in the gymnasium providing supervision but Ms. Sharpe had gone to another room. She couldn't remember if it was to cover a break or help in the other room. Ms. Casper said that she was supervising the children. There was another staff member, Wendy Mendez in the gymnasium at the time but she was not working at the time. She said that Ms. Mendez was in the gymnasium waiting for the staff meeting to begin after the center closed. She said that while she was supervising the group, Child A was standing backwards on the steps of the slide and Child B was trying to climb over to go down the slide. Ms. Casper stated she went over to the slide to tell Chil to get off the slide so that Child A could slide down. Child B got down from the slide. Ms. Casper said she had to redirect Child B twice about climbing on Child A. The first time it was verbally, the second time she lifted Child B off the slide. She said she told them to play separately from each other. A little later, Child A and Child B were tugging at each other's hands. Ms. Casper said they may have been arguing over a toy. She walked over and had told them to stop fighting over the toy. She said that Ms. Sharpe "peeked in" the doorway of the gymnasium at some point during these interactions. Ms. Casper said she told Ms. Sharpe the children were "trying to climb on each other" and being "inappropriate." Ms. Casper said that she informed Child B's Mother at pick up time, that Child B had 3 been trying to climb over a friend on the slide and that the children had been "grabbing at each other."
