There is no evidence to support that the teachers failed to provide appropriate care and supervision for Child A and Child B. Although Child A requested to see Child B’s private parts, and this was not the first occurrence of this behavior, the brief duration between the request and the exposure was developmentally age-appropriate. Teacher intervention occurred promptly once the behavior took place. A clear supervision and communication plan is in place among staff to ensure direct oversight of Child A, and this plan was observed to be implemented effectively. Child A is currently receiving services to support the development of age-appropriate social skills and personal boundaries, following trauma experienced earlier in his life.

On 12/10/2020 I was assigned a special investigation because of a submitted incident report from WLACE Head Start Whitehall. The Incident Report that was submitted indicating that Child A was on the playground climbing up the slide and fell off. He was taken to Gerber Hospital where he was diagnosed with a broken arm. I conducted an unannounced on-site inspection on 12/15/2020 and interviewed child care staff member Ms. Angela Bluhm. Ms. Bluhm stated that she had her 2 preschool class of 10 children out on the playground. The children are all reminded that climbing up the slide is not the correct way to play on it. However, while Ms. Bluhm was counting steps with another child, Child A climbed up the slide and fell off. Ms. Bluhm immediately went to tend to Child A. She called Child A's mother who came and took him to seek medical treatment. While waiting for Child A's Mother to arrive ice was applied to Child A's arm. Child A and Child A's Mother was at the school during my on-site inspection. She stated that Ms. Bluhm called her immediately after the accident. She was told that Child A fell off the slide while trying to climb up the wrong way. She took Child A for medical treatment where it was determined that Child A had an angular fracture. A soft cast was put on and an appointment was made for a hard cast that he would have on for 6-8 weeks. Child A's Mother had no concerns regarding supervision. I placed call to two other child care children's parents. Child B's parent stated that she has never had supervision concerns with the staff at WLACE. Child B is a busy child and the staff do a great job supervising him. At the time this report was written Child C's Mother had not returned my phone call.
