On 11/02/2022, I made an unannounced onsite inspection to the child care center from 10:40 AM to 12:09 PM. Program director, Tanya Hensley was not present when I arrived at the center. I interviewed child care staff member, Irina Yakovenko. Ms. Yakovenko has worked at the child care center since 2015 and works in the preschool classroom. Ms. Yakovenko was surprised by the allegation and denies ever seeing any staff member hit any child at the center. She believes the staff is nice to all the children at the child care center. Ms. Yakovenko has not received any complaints from parents and has only heard positive feedback from the parents. Ms. Yakovenko has a total of 24 children in her classroom including part time children. Some of the children may cry in the morning during drop off but staff quickly comfort the children and they do not cry for an extended period of time. Ms. Yakovenko and Ms. Hensley, the program director, work together in the preschool classroom. In the afternoon, child care staff members Sarah Fracala and Lindsey Pender assist in the preschool room. On 11/02/2022, I interviewed child care staff member, Shelly Nowak. Ms. Nowak works in the infant/toddler classroom and sometimes assists in the preschool classroom. Ms. Nowak is also the Christian music instructor and has been employed at the child care center part time since 2013 and has been full time the last five years. Ms. Nowak has never witnessed staff members hit children. Ms. Nowak stated the staff members make sure they are not alone with the children except during toileting, and they leave the doors open so other staff can see and/or hear. Ms. Nowak does not have a lot of interactions with the parents but has not had any parents complain to her about the child care staff members or the temperament of the child care staff members. If she had received any complaints or heard any parents complain she would let the program director know. Ms. Nowak stated that she was baffled and could not believe the allegations and that the child care center does not condone hitting. If children are not listening or having behavior issues, then they are redirected. If it is extreme, then children are asked to leave the group and come back when they are ready. Sometimes children have to be physically removed from an area, however, physical discipline is not allowed. On 11/02/2022, I interviewed child care staff member, Hannah Fultz. Ms. Fultz has been employed at the child care center since January of 2022. Ms. Fultz says she has never seen staff be physical with the children or use physical discipline with the children. Ms. Fultz stated that she tries not to discipline the children, but when she does, she verbally redirects children. Ms. Fultz stated there is typically multiple staff in the classroom and if children are having severe behavioral issues, she allows the other child care staff members in the classroom to address the child(ren). If children are in conflict, then the children are separated. They do not use time out, but they have quiet corners where children can go to calm down and read a book if they choose. Difficult children or children with behavioral issues are redirected, and 3 sometimes Ms. Hensley may sit with a child away from the group to calm/comfort them. She has not received any complaints from the parents but has heard parents complain to other staff. At a Halloween outing, a parent complained to another child care staff member that another child care staff member was speaking too loudly to a child. On 11/02/2022, I interviewed child care staff member, Lindsey Pender. Ms. Pender has been employed at the child care center since February of 2021. Ms. Pender denies witnessing staff hit any child. Ms. Pender normally works in the preschool room as a closer. She believes the child care center and staff are inviting and treat the children like family. When children are not listening or have behavioral issues, she tells the child(ren) what happened and

This has occurred on multiple occasions throughout October, November and as recent as this month (December). On December 15, 2021, a preschool staff member was working in the classroom alone with 19 preschoolers ages 3 and up from approximately 10am to 1pm due to another staff member having a medical appointment.

On 12/17/2021, I made contact with the complainant. The complainant shared that staff leave children unsupervised to answer the door for the parents because they are not allowed to enter the building due to Covid. I asked the complainant if there were specific dates or the times when children were left alone, and the complainant could not recall specific dates. The complainant did not provide any additional information. On 12/17/2021, I made contact with the Program Director (PD), Judi Burk. Ms. Burk shared effective 12/16/2021, she resigned from the role of PD. I asked Ms. Burk during her time of employment at the child care facility if she had any knowledge of children being left unsupervised in classrooms during parent pickups in the evenings. Ms. Burks shared she did have personal knowledge of this taking place. She shared there have been a few occasions during her time of employment when she or other CCSM's were closing, and due to low numbers, they were within ratio to work in the classrooms alone. During those times they have had to leave children in the classrooms for under a minute while taking children to the door when a parent arrived for pickup. I asked how often this has occurred, and she shared "maybe once 3 a week or sometimes a couple times a week." She did not have specific dates. She went on to share due to the facilities Covid protocol, parents aren't allowed to enter the building so this is the reason children are brought to the door. I asked Ms. Burk if this was ever addressed during staff meetings or with Ms. Meissner . She shared Ms. Meissner is aware and knows but hasn't done anything about it. Ms. Burk shared on most occasions there is an extra staff present and this isn't an issue. On 12/17/2021, I completed an unannounced onsite inspection. Consultant, Michelle Fruehan was present with me during this contact. I spoke with Ms. Marilyn Meissner and made her aware of the allegations made against the child care facility. Ms. Meissner denied any knowledge of a time when children have been left unattended in the classrooms. I asked if any of the staff have ever brought a concern regarding parent pickup and staffing needs to her attention. She denied this. Ms. Meissner shared that she or Ms. Burk are typically always present at the end of the day and help Child Care Staff Members (CCSMs) answer the doors for parents during pickups. Ms. Meissner shared last week an employee left, so Ms. Burk had to fill in the classroom to help maintain ratio. I asked for a detailed understanding of how pickups with parents' work. She shared that, due to Covid, the facility has implemented a plan that only allows the children to enter the building. Parents pickup and drop off at the door. During pickups, parents ring the door bell and wait for the staff to bring the child to them at the door. Ms. Meissner shared Ms. Burk was not a pleasant employee and left in a very disgruntled manor. Ms. Meissner shared on Wednesday, December 15, 2021, Ms. Burk had "some kind of emotional break down and walked out." The following day, Thursday, Ms. Meissner shared Ms. Burk did not come in and said she was thinking about if she wanted to continue her employment. As of today (December 17, 2021), around 3pm, Ms. Meissner shared Ms. Burks said she was not returning. On 02/25/2022, I made contact with CCSM, Irina Yakovenko by phone. Present via three- way call was Ms. Meissner per her request to be present for interviews with her staff. I asked Ms. Yakovenko about the parent pickup routine since the facilities implementation of parents not being allowed to enter the building. Ms. Yakovenko shared there is a floater (extra staff) to help with releasing children to their parents. asked if she recalled any times that children were left in the classroom alone while CCSM's took a child to the door during pick up. Ms. Yakovenko denied any knowledge of this. I asked Ms. Yakovenko how long she's been employed at the child care facility. She shared sinc

On 12/17/2021, I made contact with the complainant. The complainant shared knowledge of the program director, Ms. Burk working in the preschool classroom alone. There was no additional information provided. I spoke with program director, Ms. Burk regarding the allegations. Ms. Burk confirmed she was working on December 15, 2021, with CCSM Ms. Yakovenko. She shared Ms. Yakovenko had to leave to take care of something and was gone from approximately 1O am-1p m. She shared during this time she worked in the classroom with 19 children ages 3 and 4 alone. She shared Ms. Meissner was in the building but worked in the office area and never worked in the classroom with her during this time. Ms. Burk shared she was able to manage the children with ease and didn't need Ms. Meissner, however, she was not in ratio, and this was upsetting. I asked Ms. Burks if Ms. Meissner was aware that she had 19 children in her care. She shared Ms. Meissner was aware but "didn't work in the room with her." I asked Ms. Burk if, during her time of employment, if she has worked out of ratio. She said she had not. On 12/17/2022, I made contact with Ms. Meissner to discuss the allegations. Ms. Meissner confirmed that Ms. Burk was working in the classroom on December 15, 2021. She worked in the classroom with CCSM, Ms. Yakovenko until Ms. Yakovenko left for a medical appointment. Ms. Meissner shared while Ms. Yakovenko was at her medical appointment she filled in and assisted Ms. Burk in the classroom. I asked if she remained in the room the entire time Ms. Yakovenko was absence. She shared she did. Ms. Meissner shared she was aware of the 1 to 10 ratio and shared her facility has always been in compliance with ratio requirements. I requested to view the time sheet for Ms. Yakovenko and herself for December 15, 2022. Ms. Meissner provided a timesheet for Ms. Yakovenko. The timesheet had an actual punched time in of 7am and time out at 1:44pm. A hand written note stating doctor at 1O am was on the timesheet. Ms. Meissner shared Ms. Yakovenko was 5 told to clock out for a break at 1:44pm by Ms. Burk but there was a change of plans, so the break never occurred. She stated that Ms. Yakovenko must have forgotten to clock back in and a hand written note was added for her clock out time at 6:06pm. Ms. Meissner shared since she works on things for the facility throughout the day and isn't assigned to a specific classroom or a set schedule, she did not maintain attendance for herself. I asked if she recalled the number of children present in the preschool room. She shared she wasn't sure, but 19 children sounded correct. We attempted to pull up the attendance records through the ProCare app, however, we were not successful in locating attendance records for December 15, 2022. Ms. Meissner shared the PD understands how to navigate the app and due to her unfamiliarity, she would need time to contact someone through the app to assist her with obtaining the records. On 02/24/2022, I made contact with Ms. Meissner. Ms. Meissner shared contact with CCSM Ms. Yakovenko could be made today or tomorrow. She was waiting to confirm availability for Ms. Yakovenko. I inquired about ProCare attendance records for children from December 15, 2021. Ms. Meissner shared she was able to utilize documents from temperature checks and some through ProCare to develop an accurate list. Ms. Meissner shared the documents would be emailed. The documents were received 02/25/2022 and 0/01/2022. On 02/25/2022, Ms. Meissner provided hand written timesheets for Ms. Yakovenko, Ms. Burk and an employee, Anna Rumball who recently resigned (and was working in the infant/toddler room on December 15, 2021). The timesheet for Ms. Yakovenko showed her as clocking in at 7am, out at 10am, returning at 1:44pm and clocking out for the day at 6:06pm. Ms. Burks timesheet shows her being present from 7:29am until 4:17pm. A screenshot of a text message thread was provided for Ms. Meissner . The thread was to Ms. Burk
