    R 400.8125 · R 400.8125 Staff; volunteer; requirements. 4 (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On December 17, 2021, I initiated this investigation via telephone with Child A's Mother. Child A's Mother said that Child A complained that her vagina was hurting. Child A's Mother asked her if anyone touched it, and Child A responded yes. Child A told her mother that another child in care, Child C, touched her. Child A's Mother stated that the area did not appear irritated. She reported the allegation to the program director/owner, Christina Jacobs. Child A is still enrolled in care at this facility. On December 21, 2021, during an unannounced onsite inspection, I interview Hannah Jacobs. Ms. Jacobs identified herself as the assistant director. Ms. Jacobs was not aware of the incident as described in the allegations. She said that Child A and Child C play together a lot and are never alone. If Child C touched Child A's vagina, it could have been an accident while playing. On December 21, 2021, I interviewed Christina Jacobs via telephone. Mrs. Jacobs stated that Child A's Mother informed her of these allegations without a timeframe or a date. Child A did not report to her or any of the child care staff members that her vagina was touched or hurting. She also reported that the children are never alone. On December 22, 2021, Patricia Stevens, lead teacher, denied that the children are ever unsupervised. She has never observed any inappropriate touching between these two children or any of the children in her classroom. She said that Child A and Child C play together and are "good friends" Child A is still in a diaper and her vagina has not looked irritated at changing time. Child A did not complain to her that she was feeling pain. On December 27, 2021, Shelly Lully, child care staff member, said Child A and Child C play together a lot. They enjoy playing with the baby dolls. Child A has never complained to her that her vagina hurt or that anyone touched it. The children are never alone in the bathroom. Child A has been in a diaper until recently, she now wears a pull-up. They are never unsupervised in the classroom. On December 28, 2021, Child B's Father said he has had two children in care at this facility since 2019. He does not have any concerns regarding supervision or the quality of care they are receiving. On December 28, 2021, Child C's Mother said she has two children in care at this facility. She was made aware of the allegations. She has no concerns about supervision, or the quality of care being provided. She feels the child care staff members are very attentive to the children and will communicate well if a concern arises.
