On 08/28/2025, Licensee, Teacher 1, and Teacher 2 stated that children go outside daily and there is extra clothing and winter gear available for children who are not dressed appropriately. They all stated that teachers are responsive to children's needs if they indicate they are too hot to too cold when outdoors and can come inside. On 09/02/2025, Deputy Norman's police report indicated that there is extra clothing available to children if needed when going outdoors. The police report indicated that it did not appear that the program was mishandling the children. On 09/05/2025, PA confirmed that children play outside daily and that there is clothing and winter gear available to the children if they need it. She does not recall a time when a child was uncomfortable outdoors. On 09/16/2025, Child A's Mother, Child C's Mother, Child D's Mother, and Child D's Father stated that they have no concerns about outside play and children being dressed appropriately.

They all indicated that a child has not been threatened or hit on the head with an object. On 09/05/2025, PA stated that children can get up to do quiet activities if they do not fall asleep during nap time. She was not aware of children being threatened or hit on the head with an object. On 09/05/2025, Deputy Norman's police report indicated that children were not being mishandled. On 09/16/2025, Child A's Mother, Child C's Mother, Child D's Mother, and Child D's Father stated that they do not have concerns about interactions or supervision during naptime. Child A's Mother and Child D's Father indicated that staff have appropriate interactions with children. On 08/28/2025, I observed adequate food available in the kitchen and storage closets. Kitchen staff were 3 LANDMARK BUILDING • 105 W. ALLEGAN STREET • LANSING, MICHIGAN 48933 Michigan.gov/MiLEAP observed preparing food. Licensee, Teacher 1, and Teacher 2 indicated the program follows the CACFP food requirements and uses suggested portion sizes with measuring cups. Children are served more than one serving of food. On 09/05/2025, Program Administrator (PA) also confirmed meals are served daily and that children can receive more than one serving of food. On 09/16/2025, Child A's Mother, Child C's Mother, Child D's Mother, and Child D's Father indicated that they were not concerned with the amount of food served to the children. Staff communicate through a phone app to inform parents of the food a child ate throughout the day.

On 08/28/2025, I observed the allergy plans posted in each classroom. Licensee, Teacher 1, and Teacher 2 indicated all teachers and program staff are aware of children's allergies and food needs. They described accommodations made to meet children's food and allergy needs. Teacher 1 indicated that there was a time when gummy bears were served, but a child with an allergy to red dye was not given colored gummy bears. On 09/05/2025, Program Administrator (PA) confirmed that a child was not served red dye and all staff are aware of children's dietary needs. PA stated that they work with families to meet all children's food needs. On 09/16/2025, Child A's Mother and Child D's Father indicated the teachers and staff have been very accommodating to children's food needs and offer alternatives or avoid foods at parent request. On 08/28/2025, I observed cups of water in the classroom labeled with each child's name. Licensee, Teacher 1, and Teacher 2 indicated that children are offered water daily in plastic cups, filled with water in a pitcher. Licensee stated that pitchers are filled from the kitchen or drinking fountain, Teacher 1 and Teacher 2 indicated that pitchers are sometimes filled from the classroom sink. Licensee, Teacher 1, and Teacher 2 stated that they are not aware of children complaining about the smell or taste of the drinking water. On 09/05/2025, PA indicated that drinking water pitchers are filled in the kitchen and confirmed that children have not complained about the smell of the water. On 10/21/24, Child C did not line up with the rest of the children from Room 2 as they were leaving the playground to go back inside. Two CCSMs from Classroom 3 were still on the playground with their own group as both groups of children had been playing together. Three minutes after Child C's group left the playground, a CCSM from Classroom 3 noticed this and took Child C back inside.

On 4/20/23, I received a telephone call from program director Katey Huber. Ms. Huber said that on 4/18/23, Child A was left unsupervised in a classroom. This occurred at 4:40pm. On 4/20/23, I received the incident report by email. Ms. Huber said three child care staff members were bringing children back in the building after playing outside. Children from Rooms 2, 3 and 4 were combined into one large group. They were all walking down the hallway on the way to Room 3. Child A 2 left the group and followed Child B's Father into Room 4. He had gone into this room to get Child B's belongings after signing her out. The child care staff members didn't realize Child A left the group. No one else was in Room 4 besides Child A. Child care staff member Kari Wirtanen opened the door to Room 4 and changed the sign that had been up indicating the group was outside. When she did this, she did not notice Child A in the room. Upon entering Room 3, child care staff members did a head count and were off by one child. They knew that Child D (3-years, male) was in the office, so they thought this is why they were off by one child. Child D is the son of and employee and is enrolled for care at the center. There were 18 children in the combined group of various ages ranging from 30 months through five years. The center was in compliance with ratios. On 4/27/23, I verified this by reviewing child and staff attendance records for 4/18/23. Ms. Huber said that Child C's Mother discovered Child A in Room 4 when she went in the room to collect Child C's (4-years, female) belongings. Ms. Huber had already left the center when this took place and received a call at home from child care staff member Oliver Barnhart letting her know what had happened. On 4/26/23, I interviewed child care staff member Oliver Barnhart. Mr. Barnhart said that there were three child care staff members on the playground on 4/18/23. Each of them had taken their group out separately. The head count for the combined group of children was 18. The count of 18 children included Child D. When the groups went outside on 4/18/23, Child D wanted to stay inside near his mother, who works at the center. Mr. Barnhart said that head counts are normally done before leaving the classroom and again before going through the doors to go outside. Once outside, if there is more than one group of children, all the rooms combine into one head count. Before going back inside the building, the staff looks around the playground. A count is done while children are lining up, when children are entering the building and while children are entering the classroom. At 4:40pm when the group was coming back in, it was very chaotic in the hallway. There were several parents in the hallway to pick up their children. When the head count was 17 instead of 18, they could have thought it was correct due to Child D staying inside with his mother. At about 5:00pm, Mr. Barnhart heard Child C's Mother say, "There's a child in Room 4." Child care staff member Savannah Hurkman went to Room 4 to get Child A. Each child care staff member is required to keep a clip board. When signing children out, parents need to find their child's child care staff member and use the clipboard to sign their child out. A new electronic system is also being used called "Himama". With this system, child care staff members sign children in and out on a tablet. Having to monitor both the clipboard and the electronic system could make a child care staff member too busy and make it easier to overlook something wrong with the head counts. On 4/26/23, I interviewed child care staff member Savannah Hurkman. On 4/18/23, she was in the front of the line as the combined group was getting ready to leave the playground. On 03/08/2021, a phone interview was conducted with the complainant. Child A complained of feeling like she was going to choke while in the preschool classroom. Child A looked peaked and "spit up a couple times." Child A kept repeating that she did not feel well and laid on the floor. She soon puked all over the floor. Child A's mother, who works at the center, said to call dad. Child A's mother left Child A in the classroom and did not come get her and isolate her. An on-site inspection was completed on 03/09/2021. Aysha Koszla, program director stated Child A had not eaten for three days due to watching another child care child choke at lunch on a previous day. Child A had been on a liquid diet since, consequently on 03/03/2021 she had dry heaves. Ms. Koszla took Child A to the office while a child care staff member called Child A's father. Child A's father picked Child A up from care. Child A's father texted Ms. Koszla later that day to tell her that Child A had no fever and that Child A had eaten two bananas and some soup. An on-site interview with child care staff member Tonya Mannebach confirmed what Ms. Koszla stated adding that Child A was pale and did not appear to want to play with the other children in the classroom. Ms. Mannebach also stated that Child A, after throwing up what appeared to be phlegm, was isolated from the other children by sitting at a table with developmentally appropriate toys. 2 Attendance records reviewed confirmed that Child A had been picked up by her father on 03/03/2021 at 11:30am. A text sent to Ms. Koszla in regard to what Child A had eaten at home was reviewed and confirmed what was said during the on-site interview. Covid temperature check logs confirmed that Child A did not have a fever on 03/03/2021, nor did she have a fever on 03/04/2021 when she returned to the child care center.

On 8/19/20, center administrator Caron Salo called me to report that Child B's Mother contacted her on 8/18/20 and was concerned because Child B, (three- year-old, male), said that he had been spanked by a child care staff member at the center. Child B said the staff member who spanked him was wearing a pineapple shirt. Ms. Salo told Child B's Mother that she would review the center's surveillance video footage, speak with staff members, and get back to her. When she checked what the staff members were wearing and looked through the tape for 8/18/20, there were no staff members wearing a shirt with pineapples on it. When she looked at the tape from 8/17/20, there was a staff member wearing a shirt with pineapples on it, Becky Gouin. No inappropriate interactions were seen on the tape between Ms. Gouin and Child B. When she interviewed Ms. Gouin, she said there were no inappropriate interactions between her and Child B. She called Child B's Mother and let her know that she had not seen anything inappropriate on the tape or heard about anything inappropriate when she spoke to Ms. Gouin. On 8/18/20, child care staff member Erika Barnhart came into her office and informed her that on 8/11/20 there had been an incident between Ms. 3 Gouin and Child A (four-year-old, female). Ms. Gouin had pulled Child A's ponytail and pulled Child A down the hallway by the arm. Ms. Barnhart said on the day of the incident she had reported what she had seen to program director Melissa Nelson. When Ms. Salo viewed the surveillance video from 8/11/20, she could see Ms. Gouin tug on Child A's ponytail. The children were lined up to use the bathroom and Child A got out of line and ran to the end of the line. Ms. Gouin went to talk to Child A. Child A went down on one knee, crossed her arms, and put her head down. Ms. Gouin tried to take her hand to get her back in line. Child A would not get up so Ms. Gouin tugged on her pony tail. Then Child A got into a sitting position in the hallway with both legs forward. Ms. Gouin grabbed Child A's arm pulled her down the hallway into the bathroom. On 8/25/20 when I visited the center, Ms. Salo said that upon seeing Ms. Gouin's behavior in the video and listening to what was reported to her by staff member Ms. Barnhart, she talked to program director Melissa Nelson. Ms. Nelson said she recalled Ms. Barnhart informing her of the incident between Ms. Gouin and Child A on 8/11/20. Ms. Nelson said that Ms. Barnhart did not portray the incident as anything serious. Ms. Salo said she showed Ms. Nelson and her supervisor the footage from 8/11/20. Ms. Gouin was called into the office and shown the video as well. She was dismissed as an employee immediately. Ms. Salo called Child B's Mother and informed her that a staff member had been terminated but that it had nothing to do with interactions between that staff member and Child B. When Ms. Salo asked staff member Candace Mlostek if she had any concerns while working with Ms. Gouin, Ms. Mlostek said her only concern had been Ms. Gouin raising her voice with children. Ms. Salo contacted Child A's Mother and explained what had been seen in the video with Ms. Gouin and Child A and that Ms. Gouin had been terminated. Child A's Mother and her boyfriend were very concerned about it and said they would give it some thought. They decided later that at this time they would not be withdrawing Child A from the program. On 8/27/20, Child A's Mother said Child A had not mentioned anything to her about the incident on 8/11/20. She confirmed that the incident was reported to her by the center and felt that things had been handled correctly. Child A's Mother said she was concerned that a week had gone by had gone before she found out about the incident. On 9/3/20, Child B's Mother said Child B told her he was spanked by a lady with a pineapple shirt on and did not want to go to daycare. Child B's Mother confirmed that she spoke to Ms. Salo about it and that nothing was found on the survei
