R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home. I
I conducted an unscheduled on-site inspection on 04/01/2021. Ms. Smith was present as was her child care staff member Shaelynn Buckley. There were no children present. Both Ms. Smith and Ms. Buckley advised that children were not due to be present until 2:30 pm that day. Ms. Smith sated that she currently has seventeen children enrolled. Of the seventeen, 9 children are related. Of the seventeen children, 6 are school age and are in school (in person) for full days, Monday through Friday. During the school day it is only possible that 11 children are present. Before and after school it is possible that up to 17 children are present. Ms. Smith said that she does sometimes have 17 children present, but she is not exceeding her capacity because 9 are related. She has never had 32 children in her care. Ms. Buckley made all the same statements as Ms. Smith but could not say for certain how many children are related. She guessed it was around 5 or 6 children. On 04/28/2021 I spoke with Child B's Father. Child B has been attending Ms. Smith's home for care five days a week for about a year. Child B's Father has never counted children but said "I've never seen too many". He has no concerns regarding Ms. Smith or her child care home. Child B's Father denied being related to Ms. Smith or her child care staff members. On 04/28/2021 I spoke with Child C's Mother. Child C has been attending Ms. Smith's home for four days a week for about a year and a half. She has never counted children but said "I don't think she has too many". She said it might seem like Ms. Smith has more children than she really does because of the small size of her home. Child C's Mother said that Ms. Smith "is a good day care lady... she's so good with these kids". Child C's Mother denied being related to Ms. Smith or her child care staff members. I spoke with child care staff member Shyanna Lawrence on 05/03/2021. Ms. Lawrence said that seventeen children are enrolled, and they have had up to 3 seventeen children at one time. Six of the seventeen children are school age children. She could not say how many children are related but estimated it to be between 6 and 7. She said the related children are related to Ms. Smith or Ms. Buckley. Ms. Lawrence denied that 32 children have been present in Ms. Smith's care. I attempted telephone calls to Child A's Mother, Child D and E's Mother and Child F and G's Mother. I left voice mail messages with all of them, requesting return calls. I did not hear back from any of them. It should be noted that at the time I reviewed child information records. Ms. Smith advised that she was not related to Child A, Child B, or Child C. She stated that she was related to Child D, Child E, Child F, and Child G.
