    R 400.8158 · R 400.8158 Incident, accident, injury, illness, death, fire reporting. (2) A licensee, licensee designee, or program director shall report to the child's parent and the department, directly or 4 via phone, fax, or email, within 24 hours of the occurrence of any of the following: (b) An incident involving an allegation of inappropriate contact.

    On 10/20/21, I received a phone call from the program director, Ms. Watkins stating -year I that the day before, Child A -old male), Child B -year-old male) and Child C a -year -old male) had been playing in the bushes on t e playground and inappropriately touched each other. The boys stated that they exposed themselves 2 to each other. Ms. Watkins said that the parents were informed about the incident the same evening and the incident was reported to the Department of Health and Human Services (DHHS). Ms. Watkins said that she would send the incident report. Following up on the incident, Ms. Watkins said that even though the incident occurred on 10/18/21 late in the evening, they did not know details about the incident until later on 10/19/21 when the children and parents were called in to the principal's office for further investigation. Therefore, the incident was reported to the department on 10/20/21. On 10/20/21, I received the incident report in which it was stated that on 10/18/21, at 5 pm, Child A, Child B and Child C went to the far side of the playground and hid behind a bush. They had a stick between their legs pretending it was their penis. Ms. Norwood saw them in the bushes and asked them to come around and not play there anymore. The boys started to come towards her. When Ms. Norwood turned around to address another child, the boys went back again to the bushes. Child A pulled down his pants and Child B kissed his penis. Child B pulled down his pants and Child A kissed his penis. Child C pulled down his pants and yelled "I am the king of Dick town". The program director, Ms. Watkins was not present at the site when the incident occurred. On 10/26/21 I inspected the large school playground. There were 3 large areas; the first area has a basketball court on the far end of the playground, the second area has a climbing equipment and a slide and the third is the athletic track. The bushes were not very thick, but the landscape was much lower than the playground (track field). If staff members stood on the playground (track field), they could not see the children in full sight if they were in the bushes. I observed orange cones around the bushes, and children are not allowed to play there anymore. On 10/26/21, I interviewed Ms. Norwood who said that she was on the playground when the incident occurred on 10/18/21. She said that she saw five boys go down to the bushes and play. Ms. Norwood said that the boys always like to go there and collect sticks and play with them. Ms. Norwood said that she told them to come back up to the playground (track field), but they would not listen. Ms. Norwood said that she could see the boys going down and coming up with the sticks several times. One of the children came up to her and said that the boys down there (meant bushes) were being "bad". They were showing their "butts" and "weaners". Ms. Norwood said that she did not witness anything but called out to Ms. Weakland and told her what she had heard. Ms. Weakland went down to the bushes, got the boys and took them inside. Ms. Norwood said that she stayed outside with the other children and Ms. Wilhelm. Ms. Wilhelm was on the other side of the playground and was not aware of anything that had occurred. Ms. Norwood said that she had not spoken about this to anybody or dealt with any of the children regarding this incident. Ms. Weakland took care of everything else from there. Ms. Norwood said that she 3 did not see any part of the incident. Ms. Norwood said that she never had issues with children hiding in the bushes or getting involved in any such incidents before. On 10/26/21, I interviewed Ms. Wilhelm who said that she had not seen anything or heard anything about the incident until much later. Ms. Wilhelm said that she had not seen any such incidents before. On 10/26/21, Ms. Watkins, Ms. Norwood and Ms. Wilhelm indicated that after the incident, the area of the bushes had been sectioned off with cones and children are not allowe
