    R 400.8125 · ............ R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 06/20/2023, I interviewed the Complainant via telephone. The Complainant stated approximately two weeks ago, Child B's Mother arrived at the center to pick up Child B. When she was in the room, CCSM 1 was holding another child and Child A began to cry. CCSM 1 attempted to pick up Child A by one of her arms, but Child B's Mother intervened and picked up Child A and placed her in the bucket seat at the table. Child A has no injuries. On 06/21/2023, I interviewed Child B's Mother via telephone. Child B's Mother stated approximately two weeks ago, she arrived at the center to pick up her child. When she was in the room, CCSM 1 was holding another child and Child A began to cry. As CCSM 1 went to pick up Child A by one of her arms, Child B's Mother asked CCSM 1 if she wanted her to pick up Child A since she was holding another child. CCSM 1 told her that she did not want her to pick up Child A. Child B's Mother insisted, and she picked up Child A and placed her in the bucket seat at the table. CCSM 1 never picked up Child A by one of her arms. Child B's Mother has no concerns regarding CCSM 1's interaction with her child. On 06/21/2023, I completed an unannounced on-site inspection. I interviewed Ms. Cagle. She was informed on 06/20/2023 by CCSM 3 that CCSM 1 attempted to pick up Child A by one of her arms, but Child B's Mother intervened and picked up Child A and placed her in the bucket seat at the table. Ms. Cagle spoke to Child B's Mother and Child B's Mother did not state that CCSM 1 picked up Child A by one of her arms. Child B's Mother had no concerns. She told Ms. Cagle if she had any concerns regarding CCSM 1's interaction with the children, she would have informed her right away. On 06/21/2023, I interviewed CCSM 1 via telephone. CCSM 1 denied picking up any child by one arm. Child B's Mother arrived at the center to pick up Child B. When Child B's Mother was in the room, CCSM 1 was holding another child and Child A began to cry. Child A was sitting in a bouncy seat on the floor. As CCSM 1 bent down to comfort Child A, Child B's Mother asked CCSM 1 if she wanted her to help and place Child A in the bucket seat at the table. CCSM 1 told her no because it was not Child B's Mother's responsibility to care for the children. If CCSM 1 was going to pick up Child A, she was going to put the child she was holding down on the floor and then pick up Child A. She was never going to pick up Child A while holding another child. Child B's Mother probably thought that she was going to pick up Child A because she reached down to comfort her. On 06/21/2023, I interviewed CCSM 3 via telephone. CCSM 3 stated Child B's Mother told her that when she was in the room to pick up her child, CCSM 1 was holding another child and attempted to pick up Child A by one of her arms. She told 3 her that CCSM 1 did not pick up Child A because Child B's Mother picked up Child A and placed her in the bucket seat at the table.

    On 06/20/2023, 1 interviewed the Complainant via telephone. Child A's Father witnessed CCSM 1 yelling at the children in the pre-k classroom. On 06/21/2023, I completed an unannounced on-site inspection. I interviewed Ms. Cagle and CCSM 2. They both stated CCSM 1 has a loud voice and they have never heard her yell at the children. They have no concerns about CCSM 1. Ms. Cagle has not received any complaints from parents or staff about CCSM 1 yelling at any children or about any other concerns. On 06/21/2023, I interviewed CCSM 1 via telephone. CCSM 1 denied yelling at the children. She said she has a loud voice and speaks to the children in the pre-k classroom with a stern voice when discussing with them things that they are not supposed to do such as running in the classroom. On 06/21/2023, I interviewed CCSM 3 via telephone. CCSM 3 stated CCSM 1 once made a comment that Child A's cries makes her want to kill herself. On another occasion, Child A was crying and CCSM 1 yelled at Child A, "shut the fuck up." CCSM 3 informed Ms. Cagle about the two incidents. After interviewing CCSM 3, I called Ms. Cagle again. She denied CCSM 3 informing her that CCSM 1 said Child A's cries makes her want to kill herself. She also denied CCSM 3 informing her that CCSM 1 yelled "shut the fuck up" when Child A was crying. After interviewing CCSM 3, I called CCSM 1 again. CCSM 1 denied saying that Child A's cries makes her want to kill herself. She admitted saying that Child A's cries makes her cringe because they are so loud, and she is not used to children 4 crying like Child A cries. CCSM 1 denied yelling at Child A, "shut the fuck up" when she was crying. She would not say that to her own children; therefore, she would not say that to the children that she is caring for at the center. On 06/21/2023, I interviewed Child A's Father via telephone. Child A's Father stated approximately two or three months ago, he arrived to pick up Child A and the children were outside. He went inside the center to retrieve Child A's belongings, and as he walked by the pre-k classroom, he heard CCSM 1 yell "stop" to the children who were in the room. He does not know why she yelled stop and he does not know if any other staff was in the room with CCSM 1. He said CCSM 1 has a lot going on in her personal life and does not always seem to be in the best mindset to provide the best care for children.

    The complainant did not leave any contact information; therefore, I was not able to speak to anyone to obtain additional information. On 07/22/2022 Ms. Arroyo stated that Ms. Pritchard informed her last week (she was not sure of the exact date) and yesterday 07/21/2022 about Ms. Tharp's tone with the children not being respectful. On both occasions Ms. Arroyo spoke to Ms. Tharp about her tone with the children and Ms. Tharp stated that she would work on her tone. On 07/22/2021 Ms. Arroyo added the following reminder statement to the written "plan of the day" that is sent out to the staff. The statement stated, "please watch your tone when speaking to the kids. They're little, tiny humans and they deserve our respect. This also goes for how we physically treat them. Would you want to be yelled at and mistreated? Would you want to be yanked up? We're 2 modeling appropriate behavior and attitudes for them." She has never heard Ms. Tharp using an inappropriate tone or call the children names. Ms. Pritchard stated that she was concerned about Ms. Tharp's tone and the way that she was speaking to the children. It was not what she said, it was how she was talking to the children. She told Ms. Tharp that they were babies, and their actions were normal when they would climb on the shelves or crawl under the table; just normal two-year-old behavior. Over the past couple of days, Ms. Tharp has been frustrated and using a sharp tone with the children; she was just not using a gentle tone. She thinks Ms. Tharp might be under stress outside of work but that is not an excuse to speak to the children in a sharp tone. She has not heard Ms. Tharp call the children names. She informed Ms. Davis and Ms. Arroyo yesterday 07/21/2022 about her concerns with Ms. Tharp's tone. Ms. Tharp stated that she does use a harsh tone with the children, but it is not directed towards the children, it is directed at the child care staff members that are not helping with the children in the classroom. She is frustrated and is harsh with the children. She gets frustrated when the children have to be redirected, and she is the only one working with the children. Ms. Davis spoke to her about her tone a few months ago and she does not remember what Ms. Davis said to her about her tone. Ms. Tharp stated that she has never called the children names. On 08/26/2022 Ms. Davis stated that she could feel the tension with Ms. Tharp in the toddler classroom, so she spoke with her a month ago about her tone with the children and the staff. She has not heard Ms. Tharp calling the children names. Ms. Tharp terminated her employment at the center on Monday 07/25/2022 when Ms. Arroyo tried to speak with her about the concerns from the special investigation.

    The complainant did not leave any contact information; therefore, I was not able to speak to anyone to obtain additional information. On 07/22/2022 Ms. Arroyo stated that she has not observed the exits blocked with the shelving units in the toddler classroom during nap time. Ms. Tharp and Ms. Pritchard stated that they move the shelves to divide the classroom so that the children that sleep are on one side of the classroom and the children that do not sleep are on the other side. They will move the shelves end to end to divide the classroom. When they move the shelves there is not an opening between them, and they have to move the shelves that are on wheels to go between the two sides. They cannot reach the exit without moving the shelves. On 08/26/2022 Ms. Davis stated that she had spoken to Ms. Tharp and Ms. Pritchard about making sure that the shelving units were not blocking the exits during nap time two or three times. She told them to make sure there was an opening and she thought that they understood that they needed an opening between the shelves.

    On 3/12/20, I received a phone call from the program director, Ms. Stevenson, stating that Child A was left unattended on the toddler playground for a few minutes. Ms. Stevenson stated that she had not reviewed the video yet to understand the details of the incident, but she would be sending the incident report about the same. On 3/13/20, I reviewed the incident report sent by Ms. Stevenson stating that on 3/12/20, at about 11:25 am, the older toddler staff members, Ms. O'Bryan and Ms. Seymore, had left Child A on the playground for about 3 to 5 minutes. Ms. O'Bryan directed Ms. Wall to take some children inside to start the diapers at about 11:15 am. At about 11:25 am, Ms. O'Bryan and Ms. Seymore gathered the other children to line up at the fence. They counted the children and Ms. O'Bryan looked around to see if there were any children left on the playground and she did not see anybody. They proceeded into the building and did not realize that Child A was left outside. On 3/14/20, 1 left a voice mail for Child A's mother and did not get a return call. The center staff contacted Child A's mother the same day and informed her about the incident. Ms. Stevenson stated that Child A's mother wanted to watch the video and was extremely upset that they could not show her the video due to confidentiality. On 3/18/20, I interviewed Ms. O'Bryan who said that on 3/12/20, at about 11:05 am she told Ms. Wall to take some children inside to start the diapering process. Ms. O'Bryan did not see Ms. Wall taking the children inside but thought that she had taken four children with her to change the diapers. At about 11:15 am, Ms. O'Bryan and Ms. Seymore gathered the children on the playground and got ready to go inside the building. They had a total of ten children in the classroom that day with Ms. O'Bryan, Ms. Seymore and Ms. Wall. Ms. O'Bryan counted the children at the door and scanned the playground to make sure that there were no children left on the playground. She could not see anybody. She said that she was far from the playground since she was first in the line and assumed that Ms. Seymore had checked the playground since she was last in the line towards the playground. Ms. O'Bryan was heading the line and Ms. Seymore was at the end of the line. Ms. O'Bryan did not think twice because she thought that Ms. Wall had taken four children inside with her. She went into the hallway and the children removed their jackets and went into the classroom. Ms. Wall and Ms. Seymore were changing the diapers, helping children with bathroom, while Ms. O'Bryan started to lay out the plates for lunch. At this time, she realized that there were ten plates and only nine children were present in the classroom. Ms. O'Bryan said that it was about five minutes from the time they entered the hallway to the time that they realized a child was missing. At the time she did not realize who was 611 W. OTTAWA • P.O. She immediately ran outside to the playground and did not see anybody there. She asked the preschool staff members if they saw a child and they told her that Ms. Harris had taken the child inside with her. She came inside to walk into the reception area when she saw Child A with Ms. Hack. Child A was not crying and did not look distressed. Ms. O'Bryan said that she took Child A and walked into the classroom. Ms. O'Bryan said that she made a careless mistake by assuming that Ms. Wall had taken four children inside with her. Ms. O'Bryan said that she was not very proud of what happened but will make sure that it will not happen again. On 3/18/20, I interviewed Ms. Seymore who said that she knew that a group of children had gone inside the classroom with Ms. Wall to be changed. This was the normal procedure every day, and on 3/12/20, she knew that some children went inside with Ms. Wall but did not know the number of children
