After CCSM 1 admitted drinking alcohol on her lunch break and bringing an alcoholic beverage onto the premises, Acting Director removed her from the classroom and placed her on administrative leave pending an internal investigation. Acting Director did not follow the organizations’ written Drug, Tobacco and Alcohol-Free Workplace Policy which includes completing the Controlled Substance and/or Alcohol Observation Checklist and transporting the employee to a collection site for drug/alcohol testing,

On 01/28/2022, I received an incident report from Ms. Tracia Prior, program director. The incident report stated the following: "Child was running around the classroom when he tripped over the foot of a chair and fell on his left side striking his left ear and head on the floor. Shortly after incident child was playing as usual and did not display any signs of distress. Caregivers monitored him thought out the day." (Ice pack and TLC given) On 02/02/2022, I interviewed Child A's Mother by telephone. Child A's Mother stated on 01/26/2022, she received a text that "Child A got hurt really bad today and don't forget incident report" from Child A's Grandmother. This was the first time she was aware that something happened. Child A's Mother did not arrive for pick-up until 6:00 p.m. Child A's Mother was given a center incident report of his injury. Child A had a bruised on his left ear and on his head behind his ear. Took him home and he appeared to be okay. None of the child care staff members are really aware how it occurred. On 01/26/2022 Ms. Jenna Haney, child care staff member told her that Child A, slipped and fell on the chair as she was still at the center for pick-up; Child A told her that he slipped and fell on the floor. Child A is not always reliable with information. She did ask Ms. Pryor on Thursday morning if there was video was available but the video tapes over within 24 hours. Child A returned to child care on 01/27/2022. Child A's Mother took Child A to Children's Hospital in Troy to be checked out on 01/27/2022, she was told to watch and monitor Child A. Child A's Mother would provide me with a copy of the discharge papers. Child A's Mother gave me verbal permission to interview Child A at the center. On 02/02/2022, I Interviewed Mrs. Tracia Pryor, Yvette Gerace, child care staff member, Stephanie Galloway, assistant program director, Jenna Haney, child care staff member, and Child A. Mrs. Pryor stated Child A was injured on 01/26/2022. She was told by Ms. Haney at approximately 8:15 a.m. that Child A had fell and hit his head. She spoke with Child A's Mother at the end of the day about the matter. She understood Ms. Haney did not see how Child A was injured and the video is not available as it tapes over within 24 hours. Child A appears to be doing well. I interviewed Ms. Gerace (she lives with Child A and Child A's Mother), she arrived at the center at approximately 8:00 a.m. and she observed Child A crying in the 3 classroom. She asked Child A what happened. He told her he fell and hit his ear on the chair. She also asked Ms. Haney what happened but she told her she did not see how he was injured. Ms. Gerace observed Child A's ear to bruised and swollen. As she was leaving for the day at approximately 5:00 p.m. Child A was observed laying down in the gym and wanting to go home. Child A was calm and quiet. There was no throwing up at home or at night. I interviewed Child A. Child A was able to discern the difference between a truth and a lie. I asked Child A if he could tell me how he was injured. Child A stated he was drinking yogurt, some of the yogurt was on the floor and he slipped hitting his head. asked if Child A could show me where on the table and he pointed to the corner of the table. Child A identified Ms. Haney and Ms. Gerace were in the room. He cried after hitting his head and once his head stopped hurting, he stopped crying. I interviewed Ms. Galloway. Ms. Galloway stated she was not in the room when Child A was injured. She was making breakfast. She was told by Ms. Haney of Child A's injury. I interviewed Ms. Haney. The children were in the Discovery Preschool classroom in the morning before they go to the individual classroom. Ms. Haney was attending to another child that was being dropped off and was having difficulties wanting to leave his mother. This child was attempting to pull open the door and go after his mother. She heard Child A crying and asked him what happened. Child A told her he

On 02/02/2022, I interviewed Child A's Mother by telephone. Child A's Mother stated she was unaware Child A had been injured until she received a text on 01/26/2022 by Ms. Gerace although the injury had occurred early in the day at approximately 8:00 a.m. On 01/27/2022, Child A became ill, throwing up after lunch. She was not notified until she picked Child A up from the center later in evening. She did not know why no one had contacted her on either day when the injury happened and when he became sick. She did receive a telephone call from Ms. Galloway on 01/27/2022, apologizing for not contacting her on 01/26/2022, as she became busy making breakfast. On 02/02/2022, I Interviewed Mrs. Tracia Pryor, Yvette Gerace, child care staff member, Stephanie Galloway, assistant program director, Jenna Haney, child care staff member, and Child A. Mrs. Pryor stated she though that Ms. Galloway had contacted Child A's Mother about Child A's injury. She did not follow-up herself because she believed that staff had made contact as required. Mrs. Pryor was upset with herself that this matter had fallen through the cracks and understood why Child A's Mother was upset. A stomach virus had made its round through the center and when Child A vomited she thought he had come down with the stomach bug afflicting the center. She told Ms. Haney to contact Child A's Mother, she did not know until later that Child A's Mother was told at pick-up and not sooner. I interviewed Ms. Gerace, . Ms. Gerace stated on 01/26/2022, she told Ms. Haney to make sure she contacted Child A's Mother as soon possible about the injury. Ms. Gerace sent a text to Child A's Mother before she was leaving for the day at 5:37 p.m. for her to ask for an incident report because Child A was injured at the center. Child A returned to the center for care on 01/27/2022 and appeared fine. It was not until around 7:30 p.m.-8:00 p.m. that Child A was not acting himself and was taken to the hospital to be checked out. 5 On 02/02/2022, I interviewed Ms. Galloway. Ms. Galloway stated Ms. Haney did tell her about the injury Child A received at the center on 01/26/2022 and she told Ms. Haney she would make the telephone call to Child A's Mother about the injury. Ms. Galloway stated she forgot about making the telephone call as she was assisting in other classrooms. On 01/27/2022, she was aware that Child A threw-up after lunch, she made a note about the vomiting but did not contact Child A's Mother. She did speak with Child A's Mother earlier on 01/27/2022 at approximately 8:30 a.m. to apologize for not contacting her the previous day. Child A returned to the center on 01/28/2022 and appeared to be doing well with no issues. Child A's Mother has always been pleasant but did voice her concerns about how everything had been handled with communication. I interviewed Ms. Haney. Ms. Haney stated when Child A was injured she alerted Ms. Galloway about the matter as she is usually the person to follow-up with the parents. Ms. Haney thought everything had been taken care of with the communication between the center and Child A's Mother. It was not until the next day that she knew Child A's Mother had not been contacted. On 01/27/2022, Child A did vomit after lunch and was not acting his normal active self. She asked for his temperature to be taken, if a child vomits twice then a parent is contacted. She did not contact Child A's Mother on that day. On 01/28/2022, Child A returned to the center and it was relayed that Child A either had a stomach bug or a mild concussion. Child A's Mother was contacted throughout the day about his health. Child A was fine throughout the day, no vomiting and back being active. On 02/28/2022, I received a copy of the Warren KinderCare's illness/accident policy. The written policy stated, "After an incident or accident, your manager will communicate with parents, report to licensing and accrediting agencies as needed... On April 1, 2021, I conducted an unannounced onsite inspection and arrived at 2:20 p.m. I observed all the rooms that were currently open at the center—Infant Room #1, Toddler Room #1, Preschool Room #1, and the Pre-Kindergarten Room. Infant Room #1 had a total of eight infants with two child care staff members, Pamela Weatherwax and Kayla Anderson. Toddler Room #1 had a total of nine children with two child care staff members, Corey Brown and Lubna Kawaneh. Preschool Room #1 had a total of fifteen children with two child care staff members, Stephanie Galloway and Alia Graves. This room combined ages with the youngest child being 30 months old. Pre-Kindergarten Room had a total of twelve children and one child care staff member, Cali Vreven. During the onsite inspection, all the classrooms were in compliance with their required ratio of child care staff members to children except for Toddler Room #1. Ms. Pryor explained that the center had a couple child care staff members unexpectedly out and she has been filling in the classrooms as needed. Ms. Pryor expressed that she was assisting in the Toddler Room #1 prior to licensing arriving. Ms. Pryor was also assisting me throughout my onsite inspection and there was no other child care staff member who came into Toddler Room #1 to assist while Ms. Pryor was out of the room. Ms. Pryor provided me a copy of a letter the center sent to all their families dated March 30, 2021, explaining that due to staffing shortages the center's operating hours would be adjusted to 7:00 a.m. — 5:30 p.m. beginning 5th April — April 30th to support the existing child care staff members. The letter also offered existing families the option of temporarily transferring to another KinderCare center where the facility was open longer hours. On May 21, 2021, I interviewed child care staff member Alia Graves. Ms. Graves expressed that she is the Assistant Director at the Bloomfield KinderCare location and was assisting the Warren location at the time of the onsite inspection because the center has been short staffed. Ms. Graves stated that she knows that the center is trying to do their best to maintain ratio under the circumstances. Ms. Graves explained that the days she would assist at the Warren location she observed the staff were working hard but equally stressed due to the staffing shortages. 3 On May 24, 2021, I interviewed child care staff members Pamela Weatherwax, Kayla Anderson, Corey Brown, Lubna Kawaneh, and Stephanie Galloway. Ms. Weatherwax, Ms. Anderson, Ms. Brown, Ms. Kawaneh, and Ms. Galloway all expressed that they have been understaffed at the center due to unexpected loss of their existing staff but doing everything possible to keep the classrooms within ratio. Ms. Weatherwax, Ms. Anderson, Ms. Brown, Ms. Kawaneh, and Ms. Galloway all stated that even during these difficult staffing shortages, they feel supported and for the most part maintain ratio. They explained that Ms. Pryor assists in any of the classrooms whenever there is a need to maintain ratio. Ms. Weatherwax, Ms. Anderson, Ms. Brown, Ms. Kawaneh, and Ms. Galloway all stated that the center reduced the child care hours and closed classrooms to support the existing child care staff members. Also, the center has been transparent and open in their communication with their families about their staffing challenges and most the families have been understanding. On May 24, 2021, I interviewed Licensee Designee/Program Director Tracia Pryor. Ms. Pryor stated that staffing has been a challenge and recently she was appointed as the new program director since the prior director left KinderCare due to personal reasons. The previous director was doing the best she could to support staff but was out a lot. KinderCare cooperate has been a support to the center and appointed a recruiter to assist in hiring additional staff. The center recognized that because of being short staffed they needed adjust their day-to-day operations to continue to
