R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On 03/31/2021, I received an anonymous complaint stating child care staff members are leaving children unattended in the classrooms, child care staff members and children do not wear masks. Dates and times were not provided when this was occurring. There is an elementary school program and another licensed center operating in the same building. On 04/01/2021, I completed an unannounced onsite investigation at the center. I interviewed Mrs. Michelle Nighbert, licensee designee/program director, Jennifer Poster, Ashley Love, Elizabeth Fetter, Derbery Kelly, Brenda London, Ms. Marissa Ryder, Ms. Denise Davenport, Ms. Francine Whitney, child care staff members. I interviewed Ms. Nighbert. I informed Ms. Nighbert of the allegations; one which included that child care staff members and children are not wearing masks as 2 required. (Child care licensing does not investigate mask usage in child care centers). I completed observations in each classroom before interviewing Ms. Nighbert. There were two child care staff members in each classroom and a total of 37 children in total at the time of inspection. I observed the following: Llama room (eleven, 4 and 5 years-old child care children), Ducklings room (nine, 4-5 years-old child care children), Elephant room (nine, 4-5 years-old child care children) and Peacocks eight, 4-5 years old child care children). Although we do not investigate this matter, I observe in each of the four classrooms that was operating that all child care staff members and children were wearing masks. Ms. Nighbert stated some of the children do need reminders to pull their masks above their noses but are doing a good job of wearing them while in the classrooms. All child care staff members wear masks at all times. Ms. Nighbert stated since the children and child care staff returned to in-person learning (February of 2021), parents have limited contact inside of the building due to Covid-19. They only time a parent is allowed in the building if they have paperwork they need to complete or there is something going on with their child. Children are picked up and dropped off by parents at their designated doors. Ms. Nighbert stated since the return of in-person learning things have been going smoothly. They have been able to keep the same child care staff members working together. Ms. Nighbert stated they currently have 72 children enrolled with one virtual class running as well. Ms. Nighbert stated there is always two child care staff members in the classroom and if someone needs to leave a classroom she will step in or a floater will assist as needed. She is not aware nor has she observed any of the children in the classroom being left unattended. I interviewed Ms. Jennifer Poster. Ms. Poster been working at the center for the last six years. Ms. Poster stated children have adjusted well since returning to in-person learning. She stated there is always two child care staff members in each classroom and the children are never left alone. She has not observed any of the other child care staff members leaving children alone in the other classrooms. I interviewed Ms. Ashley Love. Ms. Love began working at the center October of 2020. She currently works in the classroom with Ms. Poster. Ms. Love stated children are never left alone in the classrooms as there always two child care staff members in the room. She has never observed any child care staff members leave children alone in a room. I interviewed Ms. Elizabeth Fetter. Ms. Fetter stated this was her third year working at the center. Ms. Fetter stated she has never left any children alone and has not observed children being left alone in the classrooms. Ms. Fetter stated there is always two child care staff members working together in the classrooms. I interviewed Ms. Derbery Kelly. Ms. Kelly been employed at the center for the last six years. Ms. Kelly stated there are two child care staff members that work in each 3 classroom. She has never left any children alone
