    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 09/29/2020, I interviewed Complainant by telephone. Complainant stated, Ms. Ojo is always falling in the center. She usually falls 2-3 times a week. One of her falls in front of the children resulted in Ms. Ojo having a black eye. Complainant stated about a month ago (in August 2020, date not provided), Ms. Ojo was outside and came back in with a head injury. The Complainant questioned one of the 3 children and they told her that Ms. Ojo had fallen. Ms. Ojo was taken to the hospital but returned to work the next day. Complainant is unaware why Ms. Ojo is having problems at the center. Complainant has not had any contact with the center since sometime in August of 2020. On 10/20/2020, I interviewed child care staff members, Mrs. Elizabeth Ojo, Ms. Deborah Ojo, Ms. Cecilia Camak, Ms. Davonna Mills, Ms. Dance Marshall, Ms. Markesha McHenry, Ms. Sheila Milton, and Ms. Mary Sanders. I interviewed Ms. Ojo. Ms. Ojo stated she has not had any recent falls. She does not remember if she has ever fallen at the center and hurt herself. Ms. Ojo stated her medical condition does not affect her ability to care for the children. Ms. Ojo stated she would never hurt or harm a child. Ms. Ojo stated that Mrs. Ojo monitors her and ensure that there are no issues with her medical condition around the children. Ms. Camak stated she the last time she observed Ms. Ojo having a medical issue was approximately 3-4 months ago. Ms. Camak stated Ms. Ojo did hit her head when she fell but was able to get up and no medical treatment was needed. Ms. Camak stated she has never seen a child placed in harm's way in Ms. Ojo's care. Ms. Mills stated she has been working at the center since July of 2020 and she has never observed Ms. Ojo falling at the center. None of the children she has worked with has told her of any incident of Ms. Ojo falling in front of them. I interviewed Ms. Marshall. Ms. Marshall stated she works in the infant and toddler room. She has never observed Ms. Ojo having any issues or problems at the center. She has not observed Ms. Ojo falling at the center or in front of the children. Ms. McHenry stated she works in the preschool classroom. Ms. McHenry stated the children in her classroom are talkative and none of the children have told her of any incidents of Ms. Ojo falling in front of them. She herself has not observed Ms. Ojo falling in the center. Ms. Milton stated she recently started working at the center in August of 2020. Since she has been working at the center, she has not observed Ms. Ojo falling or having any problems. Ms. Milton stated the children appeared to be well cared for in Ms. Ojo's care. I interviewed Ms. Sanders. Ms. Sanders stated she is at the center usually every day. She has observed Ms. Ojo while at the center have a medical situation, but it did impact the children's care. Ms. Sanders stated this incident she observed occurred several months ago. She has not observed Ms. Ojo have any recent medical incidents. On 12/23/2020, I received a copy of medical documentation from Mrs. Ojo for 4 Ms. Deborah Ojo, dated 12/17/2020 from Henry Ford Health System. The document stated Ms. Ojo was medically cleared to work. On 01/05/2021, I received an email from Mrs. Ojo with a copy of the BCAL-3704cc Medical Clearance Request form for Ms. Ojo. The Medical Clearance Request was dated for 12/31/2020. The document checked that Ms. Ojo had "No physical/mental condition or health problem exists that would limit the ability to provide independent care of children (birth to age 17) in a child care setting."

    On 09/29/2020, I interviewed Complainant by telephone. Complainant stated she was aware that Mrs. Ojo was taking children to her office to "spank" if the children were being difficult. Complainant stated she has never witnessed Mrs. Ojo hitting a child but stated Mrs. Ojo reportedly used this form of punishment at another child care center. Complainant also stated children were being restrained in wooden chairs in Ms. Camak's room. Complainant stated children are able to stand and walk with the chairs while being restrained. On 10/05/2020, I interviewed Child A's Mother. Child A's Mother stated she also has a second child that attends the child care, Child B. Child A and Child B's Mother stated Child A is in Ms. Camak's classroom and she has never had any concerns about how Child A is being treated. Child A and Child B's Mother stated Child B will tell everything that happen while they are at the child care and she has never told her anything that had her concern about their care. On 10/20/2020, I interviewed Mrs. Ojo at the center. Mrs. Ojo was extremely upset when provided with the allegation. Mrs. Ojo stated she did have an investigation at her Detroit location with the same allegation. Mrs. Ojo stated in all of her years working with children she would never think someone would be so angry as to deliberately say she would harm a child. She stated she has never brought a child into her office to physically discipline. Mrs. Ojo stated if a child care staff member is having difficulties with a child and need assistance she will talk to the child or redirect them. She has never punished a child physically. Mrs. Ojo also stated she has never observed a child being physically restrained in a chair in the toddler room. Mrs. Ojo stated there are no chairs in the room that have any restraints. Mrs. Ojo stated the children and parents love Ms. Camak and there have not been any reports from parents of concerns. I observed Ms. Camak room and equipment. There were no wooden chairs or playing equipment with restraints in the room. I interviewed Ms. Ojo. Ms. Ojo stated she has never observed Mrs. Ojo spank or bring children into the office to discipline. Children are spoken to or redirected. She has not observed any of the child care staff members harm a child. She works in the toddler room with Ms. Camak and has never observed Ms. Camak restraining children in wooden chairs. Ms. Ojo stated she has never restrained a child. Ms. Camak stated she does not have any chairs in her room with restraints. She would never harm a child that is in her care. Ms. Camak also stated she has never observed any child being sent to Mrs. Ojo's office to receive a spanking. Ms. Camak has not observed any child being physically disciplined by Mrs. Ojo. A I interviewed Ms. Mills. Ms. Mills stated she works in various rooms depending on where the need is. Ms. Mills stated she has worked with Ms. Camak in the toddler room and has never observed Ms. Camak restrain a child in a chair. Ms. Mills stated they will redirect or talk with the child. She has never observed any child being sent to the office for discipline. Ms. Mills stated she has not observed Mrs. Ojo physically discipline any child. Ms. Marshall stated she has not observed Mrs. Ojo physically discipling any child in the center. Children are not sent to the office to be discipline by Mrs. Ojo. Ms. Marshall stated if a child is upset will attempt to calm them down by talking to them. She is unaware of child care staff member restraining children in a chair. Ms. McHenry stated all the children in her classroom are verbal. None of the children have ever told her that they are being spanked by Mrs. Ojo. Ms. McHenry stated children in her room like to talk and are not afraid to speak about anything. She has never observed Mrs. Ojo physically discipling a child or children being restrained in chairs.     I interviewed Complainant by telephone on 09/29/2020. Complainant stated a couple of months ago (no specific date given). Child A was playing outside and had a nose bleed. Complainant stated no one told Child A's Mother about the nose bleed occurring. On 10/05/2020, I interviewed Child A and Child B's Mother by telephone. Child A and Child B's Mother stated Child A will have nose bleeds if he over exerts himself or get too hot. Child A and Child B's Mother stated Child A had a nose bleed at the center a couple of months ago. She stated the center will inform her if there is an issue or problem with any of her children. Child care staff members will send a message through the application (Brightwheel) they use at the center or call. On 10/20/2020, I interviewed Mrs. Ojo at the center. Mrs. Ojo stated if a child becomes sick or has an accident during the time they are at the center. Child care staff members will contact the parents either through the application they use or by telephone. Mrs. Ojo stated Child A had a nose bleed a couple of months ago and Child A's Mother was contacted about the nose bleed. Mrs. Ojo stated especially during this time of COVID-19 they are not taking any chances when there is a change with a child. Mrs. Ojo provided me with a copy of her "Parent Notification Plan" the plan stated, "Kids' Avenue Christian Learning Center to notify the parents when a child experiences accidents, injuries, incidents, or illnesses. In addition, when the center staff observes changes in the child's health, or when a child is too ill to remain in the group; and when incidence or allegations of inappropriate touch occurs or is observed. Staff/Director will notify the parents, via... • Written injury report received at pick-up time. • Phone call • Brightwheel App. On 10/20/2020, I interviewed Ms. Ojo. Ms. Ojo stated Child A and Child B's Mother told them that Child A sometimes get hot and his nose will bleed. Ms. Ojo stated Child A was playing outside when his nose began to bleed. Child A was treated and his nose bleed stopped. Child A and Child B's Mother was contacted. On 10/20/2020, I interviewed Ms. Camak. Ms. Camak stated she did not know the specific date when Child A had nose bleed but the children were playing outside when Child A's nose began to bleed. Ms. Camak stated she spoke with Child A and Child B's Mother about Child A's nose bleed as Child A and Child B's Mother told her she typically removes Child A's shirt to keep him cool. Ms. Camak contacts parents as soon as possible when there is a problem. On 10/20/2020, I interviewed Ms. Mills and Ms. Marshall separately. Ms. Mills and Ms. Marshall stated they are unaware of Child A having a nose bleed. If there is an issue with a child the problem and issue is reported quickly to the parent. On 10/20/2020, I interviewed Ms. McHenry. Ms. McHenry stated child care staff members are responsible for contacting parents immediately if a child becomes sick or there is an incident. She also stated child care staff members will complete an incident report if needed.

    Z On 09/29/2020 I interviewed Complainant by telephone. Complainant stated Mrs. Ojo will not buy paper towel for child care staff members to use and they have to use non single serve towels to clean tables. Complainant stated child care staff members have to use hand soap to clean tables. Mrs. Ojo is trying to save money. On 10/20/2020, I interviewed Mrs. Ojo at the center. Mrs. Ojo stated all the rooms that are operating use the three steps cleaning method. Mrs. Ojo stated bleach water solution is made in the morning in the kitchen in a large jug. She has the test strips to ensure the bleach solution is the right mixture. Bleach is kept under the sink in the kitchen. She stated child care staff members will come and fill their spray bottles in the morning. If they need more they will refill during the day. Mrs. Ojo stated she had a child care staff member that no longer works at the center that complained that there was not enough bleach being used in the water. Mrs. Ojo stated she explained to the child care staff member that it is a certain bleach to water solution that must be used. Mrs. Ojo stated she had to speak with the child care staff member as she was buying and using her own bleach in the room and the smell was overpowering. She also found towels in the preschool room that belonged to a previous child care staff member. Mrs. Ojo stated there is supply of paper towels for child care staff to use. I observed in the center's kitchen bleach/water solution. Mrs. Ojo used a test strip for the bleach water solution which turned darked blue color. Mrs. Ojo also showed where the paper towel was being stored for center use. I observed three spray bottles in each room that child care staff members used to wash, rinse, and sanitize equipment in the rooms. I interviewed the following child care staff members: Ms. Ojo, Ms. Camak, Ms. Mills, Ms. Marshall, Ms. McHenry, Ms. Milton, and Ms. Sanders, on 10/20/2020 at the center. All of the child care staff members stated there has never been an issue with not having supplies to clean the tables and equipment. They use single use towels and are aware where the supplies are kept.

    On 08/27/2020, I interviewed Complainant by telephone. Complainant initially stated Ms. Camak would "spank" kids. Complainant then stated she observed Ms. Camak hit Child A's hand because he was attempting to take something off the wall. She stated Mrs. Ojo, licensee designee/program, was not in the building when this occurred. Complainant stated she discussed this incident with Ms. Camak (date not provided) and was told by her that she had been given permission from Mrs. Ojo to "spank". Complainant stated she spoke with Mrs. Ojo (date not provided) about Ms. Camak spanking children. Mrs. Ojo told her that she has never given permission for a child care staff member to spank or hit a child. Complainant stated she has not had any recent contact with the center or Ms. Camak. On 09/01/2020, I completed an unannounced onsite investigation at the center. I interviewed Mrs. Ojo, Ms. Debora Ojo, Cecelia Camak, Helen Scott, Markesha McHenry, and Sheila Milton, child care staff members. Mrs. Ojo stated she currently had one child care staff member on a leave of absence, but the other child care staff members were present. Mrs. Ojo stated Ms. Camak has been one of the most consistent child care staff members at her center. She has not had any concerns brought to her on how Ms. Camak cares for the children in her classroom. She has not received any parents or child care staff members complaint. Mrs. Ojo stated Ms. Camak is firm and very fair and she has never observed her being physical with any of the children. Mrs. Ojo stated she would not tolerate any child care staff member hitting and/or spanking a child. She would fire any child care staff member that harmed a child. I interviewed Ms. Debora Ojo. Ms. Ojo stated she primarily works in the toddler room but will assist in the infant room if needed. She has worked with Ms. Camak on several occasions. She has never observed Ms. Camak hitting or spanking a child. Ms. Ojo has observed Ms. Camak talking to the children, remove them from a difficult situation and redirect the children to a different activity. The children appear to respond well to Ms. Camak. She has never observed any of the child care staff members harm a child in the center. 3 Ms. Camak stated she has worked in the toddler room for approximately year. She said it just does not make sense that all of sudden she is being accused spanking and hitting children. Ms. Camak stated she keeps to herself, but the other child care staff members congregate together and talk. Ms. Camak stated she comes in and does her job and leaves at the end of her shift. She stated she would never harm a child and has never hit any of the children in her care. Ms. Camak stated she has been working with children for a long time and has not had any complaints from parents. I interviewed Ms. Scott. She has only been working at the center for the last two months. Ms. Scott stated she works in the toddler room from 7:30 a.m.-3:30 a.m., Monday — Friday. Ms. Scott stated children are redirected and/or separated if they are having a difficult time in the classroom. She has never observed Ms. Camak hitting or spanking a child. Ms. Camak will take the children by the hand and lead them away but never in a harsh manner. The children appear to be happy in the classroom when they are around Ms. Camak. Ms. McHenry stated she currently works in the preschool classroom. Ms. McHenry stated she has not worked in the toddler and is unaware of any issues or concerns. She stated she is able to talk to the children in her classroom when they are not getting along. She has never observed any of the staff hitting or spanking a child. Ms. Milton stated she has only been working for the last two weeks at the center. She has worked in several of the classrooms. Since the time she has been working at the center she has never observed any of the children being hit by a child care staff member. She has no concerns about how the child care staff interact with the children. On 10

    On 08/27/2020, I interviewed Complainant by telephone. Complainant stated the preschool classroom is constantly out of ratio. Complainant stated there are usually 15 children in the classroom and only 1 child care staff member as additional child care staff members are constantly quitting. Complainant could not provide a specific date as to when the room was out of ratio. Complainant does not know if the room continues to be out of ratio as of the date of this interview. On 09/01/2020, I completed an unannounced onsite investigation at the center. I interviewed Mrs. Ojo, Ms. Debora Ojo, Cecelia Camak, Helen Scott, Markesha McHenry, and Sheila Milton, child care staff members. Mrs. Ojo stated she has worked hard to make sure that the classrooms are in ratio as she has hired more child care staff. Mrs. Ojo stated she typically has more staff (which includes a floater staff) than children at the center as she did not want any issues or problems as it relates to ratio. Mrs. Ojo stated she was having a problem keeping additional child care staff members in the preschool room however there was always someone to fill in. She thought that she was not hiring the right child care staff members, as assistants were quitting frequently in the preschool classroom; however, since the lead child care staff member has not been working the classroom is running smoothly. Mrs. Ojo stated she should have completed exit conferences with the various staff that quit to determine the problems in the room. 5 Ms. Ojo stated she works in the toddler room with Ms. Camak and sometimes she will also help out in the infant room. Ms. Ojo stated there is always enough staff in the rooms that she works in. She has not observed the toddler or infant room to not have enough staff or being out of ratio. I interviewed Ms. Camak. She stated she is unaware of any issues in the preschool room as she does not provide care for any preschool children. Ms. Camak stated she stays in the toddler room and there are always two child care staff members in the toddler room. Ms. Scott stated she works in the toddler room. She stated there is always enough staff in the room with the children. Ms. Scott stated they have been busy but not with a lot of children. She usually works only in the toddler room. I interviewed Ms. McHenry. She has worked for the center for the last year and most recently in the preschool room Ms. McHenry stated she has not observed 20 children with having only 1 child care staff member. There are always 2 staff in the room if needed. Ms. McHenry stated the most she has had in the classroom is 14 child care children. Ms. Milton stated she has not observed the center not having enough staff. There is always someone to fill in if needed. She has been in the preschool classroom. Today is the most children that she has seen in the classroom at 14, normally they have no more than 10. On 09/01/2020, I observed the following: the preschool classroom had 14 children with two child care staff members, infant room had 5 children with two child care staff members, and toddler room had 10 children with two child care staff members. The center had the appropriate ratio of staff to children at the time of the unannounced investigation. I interviewed Child C and D's Mother by telephone on 10/22/2020. Child C and D's Mother stated she was unaware of any issues with staffing. The center appears to have enough staff however parents are not allowed past the front door due to COVID-19. I interviewed Child E's Mother by telephone on 10/22/2020. Child E's Mother stated she has never had any concerns about staffing. Child E's Mother stated due to the pandemic children are dropped off and picked up at the door. I interviewed Child A's Mother by telephone on 10/22/2020. Child A's Mother stated she has not had any concerns with the center not having staff when her children attended. A I completed the Exit Conference with Mrs. Ojo by telephone on 10/22/2020. I informed Mrs. Ojo of th
