The program director does not assist caregiving staff and will not relieve staff members for breaks or to use the restroom. A staff member had to pee in a bucket in the classroom.

On 04/20/2023, I spoke to the complainant via telephone. The complainant stated that on 04/20/2023, while viewing the child care center's live stream cameras of the early preschool classroom, CCSM 1 was pulling Child B and Child D by their arms and legs. The complainant shared that the incident occurred around nap time from approximately 1:15 pm to 1:30 pm. As Child B and Child D continuously got up from their cot, CCSM 1 would grab them by their arms with significant force and put them back on their cots. The complainant shared that while unsure of how many children in total were present in the classroom, many of the children were on their cots either asleep or simply lying on their cots. CCSM 1 appeared to be the only staff member in the classroom. The complainant shared that this incident was not the first time that CCSM 1 had been witnessed grabbing various children by their arms. The complainant did not elaborate other than stating CCSM 1 would grab various children by their arms when they try to run away from CCSM 1. On 04/20/2023, I spoke to Child A's Mother. Child A's Mother shared that she has concerns regarding the way CCSM 1 conducts herself with the children. Child A's Mother stated that Child A has attended the child care center since mid-2021 and has enjoyed the child care center until CCSM 1 has been Child A's staff member. Child A's Mother has witnessed CCSM 1 yelling at the children and grabbing children whenever they run away from CCSM 1. Child A's Mother stated that she has had conversations with CCSM 1 regarding Child A's behavior but has never addressed her concerns with CCSM 1. Child A's Mother also shared that CCSM 1 is often alone with the children in the classroom. Child A's Mother is unsure of the ratio but believes it is eight children to one staff member. Child A's Mother stated that because CCSM 1 was the only staff member in the classroom that CCSM 1 was seemingly frustrated with the children. On 04/21/2023, I completed an unannounced onsite inspection to the child care center. I informed the acting program director, Whitne Campbell, of the allegations. 3 Ms. Campbell informed me that she has been acting program director since the beginning of April as the program director is out on maternity leave. Ms. Campbell denied the allegations against CCSM 1 and shared that she was surprised by the allegations. Ms. Campbell stated that she has never witnessed CCSM 1 yelling at children, grabbing any child by their limbs or holding children down on their cots. Ms. Campbell shared that there are 21 children enrolled in the early preschool classroom with different schedules and with the age range of 2 to 3 years. Ms. 1/2 Campbell stated that CCSM 1 is the assigned staff member of the classroom and there is no consistent second staff member assigned to the classroom. Because of this, there are typically eight children in the classroom. If more than eight children are present in the classroom, then a second staff member is placed in the classroom. Ms. Campbell shared that parents have access to view their child's classroom through SproutAbout, an app the center utilizes. While parents can view the live stream cameras of the classroom, it does not record. Recording for specific dates and times can be obtained from the licensee designee, Tanya Zoro. Ms. Campbell stated that there are lots of children in the early preschool classroom with behavioral issues. The child care center does not utilize time out. The center has access to resources to assist child care staff members with behavior issues called MyPath. All staff members have access to the resource that offers strategies that staff members can use in the classroom. Ms. Campbell stated that nap/rest time is from one to three pm and children are not forced to nap. If after 45 minutes of lying down on the cot and children are still awake, they are given a book or other quiet activity. While on site, I reviewed the attendance records. A review of the attendance

On 05/10/2023, 1 made an unannounced onsite inspection to the child care center from 12:02 pm to 12:58 pm. I informed CCSM 2 of the new allegations as Ms. Campbell was not present at the center. CCSM 2 was surprised by the new allegations. CCSM 2 stated that staff are allowed to use the restroom and staff have scheduled breaks. When I asked CCSM 2 about the allegation of a staff member peeing in a bucket in the classroom, CCSM 2 shared that the staff member no longer works at the child care center and does not know if it actually happened. CCSM 2 stated that it was rumored that a staff member had to use the bathroom and could not hold it, so the staff member peed in a bucket in a closet in the classroom. The staff member was no longer employed at the center during my initial onsite inspection on 04/21/2023. The staff member, CCSM 8 had officially quit on 04/19/2023. CCSM 8 worked in the toddler classroom and had four children to maintain ratio. When I asked about CCSM 1, CCSM 2 informed me that CCSM 1 recently quit. CCSM 2 shared that CCSM 1 took offense to the current investigation and believed it was too much. CCSM 2 shared that while she mainly has administrative duties at the child care center, CCSM 2 has been in the classroom due to staffing shortages. Other staff at the center such as the cooks have stepped in to relieve staff and cover breaks. The center has since hired five new child care staff members. On 05/10/2023, I interviewed CCSM 6. CCSM 6 has worked at the child care center for seven years. CCSM 6 denies that staff are not allowed to use the bathroom and that classrooms are not out of ratio. CCSM 6 shared that ratio and coverage was an issue at the center a long time ago but has not been an issue in a long time. CCSM 6 shared that she believes Ms. Campbell sits in the office and does not help. CCSM 6 stated that CCSM 9 or CCSM 2 will provide relief or coverage when called. CCSM 6 stated that it is hard to believe that a staff member peed in a bucket in a classroom because there is always someone available to relieve staff for bathroom breaks. CCSM 6 shared Ms. Roberts always provided relief to staff when needed prior to her maternity leave. On 05/10/2023, I interviewed CCSM 7. CCSM 7 shared that at times it can feel as if the program director does not provide relief for bathroom breaks or assist with ratio coverage when staffing is short. CCSM 7 shared that Ms. Campbell recently has been in her office more than before, however, Ms. Campbell is great at supporting staff in other ways. Ms. Campbell would encourage staff to use the bathroom during their scheduled breaks. CCSM 7 had no knowledge of a staff member who had to pee in a bucket in their classroom because there was no one to relieve them for a bathroom break. CCSM 7 stated that the center is currently short staffed but that is beginning to change as new staff have recently been hired. CCSM 7 shared that two staff members have recently quit including CCSM 1. CCSM 7 heard that a staff member walked out but was unsure if that staff member was CCSM 1. On 05/10/2023, I observed the following classroom ratios. Ms. Campbell stated that whenever staff call the office for assistance of any kind, someone gets there as soon as possible. Ms. Campbell shared that she or CCSM 2 would step in the classroom to relieve staff. Ms. Campbell stated that the availability of staff to cover varies depending on the day, especially if they are short staffed. Ms. Campbell has been going back and forth between child care centers, so she has not been stepping in the classrooms as much as she been. On October 7, 2022, I called and left a message for the Complainant. On October 7, 2022, I completed an unannounced on-site inspection. I interviewed program director and licensee designee, Ms. Cynthia Roberts, and child care staff members, Ms. Taylor Sorrels, separately. Child care staff members, Mr. Chris Johnson and Ms. Caylee Bell were absent. Ms. Roberts said she's aware of the allegation and that it was brought to her attention on October 4, 2022. She received a telephone call from Child A and Child B's Father who informed her of the incident. Ms. Roberts said she also called and spoke with Child A and Child B's Mother regarding steps to prevent it from happening again. Ms. Roberts said Child A (male, 3 years old) and Child B (female, 3 years old) 1/2 1/2 were left in the same pull-ups all day. The incident occurred in the Preschool 2 Classroom on October 3, 2022. Ms. Sorrels is the lead child care staff member in the classroom, but she was absent that day. Ms. Roberts said Mr. Johnson was in the Preschool 2 Classroom from opening until 3:00 P.M. Mr. Johnson left the classroom and Ms. Bell came in from 3:00 P.M. until closing. Ms. Roberts said she checked the SproutAbout app and did not see any potty- training entries for Child A and Child B. The corporation, Tutor Time Learning Centers, LLC, created their own app called SproutAbout. The app tracks supervision, attendance, and daily records such as food intake, sleeping patterns and diaper changes. Ms. Roberts said she spoke with Mr. Johnson who said he checked diapers and pull- ups every two hours. Mr. Johnson admitted that he didn't log in the entries in the SproutAbout app. According to Ms. Roberts, Mr. Johnson said Child A and Child B both used the toilets and did not have soiled pull-ups. Ms. Roberts said diapers and pull- ups are checked every two hours. Child care staff members are supposed to log each entry, even if the diapers/pull-ups are dry, in the SproutAbout app. Since the incident, she implemented a new policy. There is a posted list of children's names who are in diapers and/or pull-ups located in the classroom. Ms. Roberts said Child A and Child B are potty training. During the inspection, I received copies of the children's information cards, toilet learning procedures and attendance records for October 3, 2022. According to the company's policy regarding toilet learning, " Learning to use a toilet is a gradual process that takes place over a period of time as a child matures physically and emotionally. Successful toilet learning 5 depends upon the physical, cognitive, and language development of the child. For example, for a child to be ready for toilet learning he or she must: • Be aware of bowel and bladder fullness. • Have the muscle development to control elimination. • Have the language and physical skills to signal the need to the caregivers. • Have the large and small motor skills to get to the toilet on time, remove clothing, and then to actually use the toilet. • Be willing to participate. As you can see these are complex abilities that develop over an extended period of time. Children show readiness to begin toilet learning when they recognize their diaper needs to be changed. At this point a child may be ready to learn and be able to control his or her bowels and bladder. Beginning the toilet learning process too early will cause frustration for children. Toilet learning is recommended for children between the ages of two and three years old. A child's cues and mannerism initiate toilet learning these may include verbal requests, gestures of pulling down pants, leading the caregiver to the bathroom, squirming in place, and pointing gestures. We will be sensitive to these cues by asking the child to use the toilet, assisting the child on scheduled visits to the bathroom when they are most likely to need to use the toilet, given frequent verbal reminders during the day, posting pictures of sequenced potty routines, and communicating with you t

On October 7, 2022, I called and left a message with the Complainant. On October 7, 2022, I completed an unannounced on-site inspection. I interviewed Ms. Roberts and Ms. Sorrels, separately. Ms. Roberts denied the allegation and said children are offered water throughout the day. In each classroom, there is a pitcher of water and cups. Children may also bring water bottles. Children are offered milk at breakfast and lunch, and water at morning and afternoon snacks. Ms. Sorrels said the children drink water and milk during lunch time. During the day, she offers water and helps them pour water into their cups. Ms. Sorrels said there's always a pitcher of water in the classroom. During the inspection, I inspected the Preschool 2 Classroom and saw a pitcher of water and cups located by the window. On October 10, 2022, I called and spoke with Child A and Child B's Mother. Child A and Child B's Mother said she noticed that when the children come home, they're always thirsty. They drink so fast, at least two full cups of water. Child A and Child B's Mother said it doesn't seem like they were given water at the center. Child A and Child B's Mother said Child A and Child B do not have water bottles. Child A and Child B's Mother said this happens all of the time, and she had addressed it with Ms. Roberts last week. Child A and Child B's Mother said Child A and Child B have special needs. They don't communicate and probably didn't let the child care staff members know if there was a problem. Child A and Child B's Mother said she didn't ask Child A and Child B if they were given water at the child care center. She just noticed how thirsty they were when she picked them up. On October 12, 2022, I completed an unannounced on-site inspection. I interviewed Mr. Johnson, and Ms. Bell, separately. Mr. Johnson said children are given milk and water every day. Some children have water bottles and others use cups. There are cups and a pitcher in the classrooms. He usually offers the children water, or they will ask for water. Mr. Johnson said they also bring water outside for the children to drink. Ms. Bell said the children usually bring water bottles to school. If not, children are given cups of water. Child care staff members pour water for the younger children and the older children can pour their own water. Ms. Bell said pitchers of water are available inside the classrooms as well as outside on the playground. On November 2, 2022, I called and spoke with Child C's Mother and Child E's Mother. I left a message with Child D's Mother. rj Child C's Mother said Child C (male, 3 years old) drinks a lot of water. Child C's Mother said the center provides cups and water. She believes that if Child C asked for water that they would give it to him. Child E's Mother said she sends a water bottle to school with Child E (female, 3'/2 years old). The child care staff members refill the water bottle when it is empty. Child E's Mother said Child E is very talkative. Child E would tell her if anything was wrong or if she wasn't given water to drink. Child C's Mother and Child E's Mother both said they have no concerns or complaints. On November 7, 2022, I called and spoke with Child D's Mother. Child D's Mother said Child D (female, 3 years old) has a water bottle. However, Child D's Mother noticed that the water bottle is empty at the end of the day, and that Child D is always thirsty during pick up. This has been a daily occurrence. Child D's Mother keeps a water bottle in the car when she picks up Child D from the center. On November 9, 2022, I completed an unannounced on-site inspection. I interviewed child care staff members, Ms. Ashley Somjak and Ms. Disha Bhanani, separately. Ms. Somjak and Ms. Bhanani are child care staff members in the Early Preschool Classroom. They both said the children are offered milk and water during meal time, and water throughout the day. Ms. Somjak and Ms. Bhanani said they have a pitcher of water and cups available to the

On October 3, 2022, the Preschool 2 Classroom was out of ratio: • Mr. Johnson was out of ratio for 15 minutes from 8:15 A.M. to 8:30 P.M. with nine children. The youngest child is 32 months old. Therefore, the ratio is one child care staff member to eight children. • Mr. Johnson was out of ratio for three minutes from 9:53 A.M. to 9:56 A.M. with 11 children. The youngest child is 3 years old. Therefore, the ratio is one child care staff member to ten children. • Mr. Johnson was out of ratio for 19 minutes from 10:00 A.M. to 10:19 A.M. with 11 children. The youngest child is 3 years old. Therefore, the ratio is one child care staff member to ten children. • Mr. Johnson was out of ratio for 34 minutes with 11 children from 10:36 A.M. to 11:10 A.M. The youngest child is 3 years old. Therefore, the ratio is one child care staff member to ten children.

On August 18, 2022, I called and spoke with the Complainant. The Complainant said Child A (male, 3 years old) has had more injuries since Ms. Annette Lewis became the child care staff member in the Preschool 1 Classroom. The Complainant said the child care center is not consistent with informing parents when the children are injured at school. Child A had a massive bite mark on July 26, 2022 and none of the child care staff members knew what had happened to Child A. On a different date, Child A had a black eye and no one knew how he got hurt. The date is unknown. The Complainant said child care staff member, Ms. Taylor Sorrels, is great with communication and providing incident reports. However, the Complainant has never received any reports from Ms. Lewis. On August 24, 2022, I completed an on-site inspection. I interviewed program director, Ms. Cynthia Roberts, and child care staff members, Ms. Taylor Sorrels, and Ms. Lewis, separately. Ms. Roberts was recently hired as the program director on August 24, 2022. Ms. Roberts said when a child is sick or injured, an incident report is completed and signed by the parent and management staff. The incident report is not available in the SproutAbout app. The child care center uses the SproutAbout app which tracks 3 supervision, attendance, and daily record such as food intake, sleeping patterns and diaper changes. Ms. Roberts said Ms. Lewis worked alone in the Preschool 1 Classroom with approximately 10 children in care. After meeting with Child A's Mother, Ms. Roberts said she closed Preschool 1 and the children were sent to either Early Preschool Classroom or Preschool 2. Ms. Lewis was sent to Preschool 2 to work with Ms. Sorrels. Ms. Sorrels is the lead child care staff member in Preschool 2. I interviewed Ms. Sorrels who is the lead child care staff member in the Preschool 2 Classroom. Ms. Sorrels said Child A was in the Preschool 1 Classroom with Ms. Lewis. However, in the last week, Preschool 1 closed and Ms. Lewis is currently working in the Preschool 2 Classroom with her. The children were either sent to Early Preschool or Preschool 2. She said written incident reports are completed for head bumps, any broken skin like cuts and scrapes, and marks. The report is signed by management and the parent. The parent is given the yellow copy and the white carbon copy is saved in the child's file. Ms. Sorrels said there has been many parents complaining at the end of the day during pick up. Parents are asking about bruises and scratches on their children but there are no incident reports. Ms. Sorrels said it's difficult because Ms. Lewis leaves at 12:00 P.M. or sometimes 2:30 P.M., so she's not present during pick up time to speak to parents. Ms. Sorrels said Child A's Mother had messaged her about a month ago regarding Child A's eye and a bite mark. Apparently, Child A had a black eye and a bite mark on his upper shoulder and neither incident was documented on an incident report. Ms. Sorrels does not recall seeing Child A with a black eye nor did she see the bite mark. I interviewed Ms. Lewis who said she worked in the Preschool 1 Classroom with approximately 10 children. Ms. Lewis said she had a few children with behavioral issues so there were always children pulling hair, scratching, or biting. Any time there is an accident, she would complete an incident report for parents. Ms. Lewis admitted that there have been times when a child care staff member forgot to complete an incident report. Ms. Lewis said Child C (female, 3 years old) suffers from anxiety and acts out when she's upset. Child C bites, hits, or scratches other children. One day last week, Ms. Lewis said she had already left for the day when Child C bit Child D (male, 3 years old). She didn't know about it until the next day when Child D's Father showed her a picture of the bites on Child D's arm and back. On August 18, 2022, I called and spoke with the Complainant. The Complainant said Child A (male, 3 years old) is scared to go to school. According to the Complainant, Child A has been consistent and said on different occasions that child care staff member, Ms. Annette Lewis, hit him. Child A refers to Ms. Lewis as the bad guy. The Complainant said Child A has had many unexplained injuries and most recently "weird" marks on his lower back. The exact date is unknown but the Complainant said it occurred within the last week or two. On August 24, 2022, I completed an on-site inspection. I interviewed program director, Ms. Cynthia Roberts, and child care staff members, Ms. Taylor Sorrels, and Ms. Lewis, separately. Ms. Roberts said she is aware of the allegations. She and Ms. Tanya Zoro, the district manager, met with Child A's Mother. Child A's Mother informed them that Ms. Lewis was harsh with Child A. There was no mention of Ms. Lewis hitting Child A, nor did Child A's Mother give them dates when this occurred. Ms. Roberts said Ms. Lewis worked alone in the Preschool 1 Classroom with approximately 10 children in care. Since meeting with Child A's Mother, Ms. Roberts 7 said she closed Preschool 1 and the children were sent to either Early Preschool Classroom or Preschool 2. Ms. Lewis was sent to Preschool 2 to work with Ms. Sorrels. Ms. Sorrels is the lead child care staff member in Preschool 2. Ms. Roberts said there are cameras in the classrooms; however, it's live feed. I interviewed Ms. Sorrels who said she is currently working with Ms. Lewis in the Preschool 2 Classroom. Ms. Sorrels has worked with Ms. Lewis before and noticed that she is loud, harsh, and aggressive. Ms. Lewis' tone is angry and at times, unpleasant. According to Ms. Sorrels, Ms. Lewis uses very short and demanding language when she speaks with the children which may come across as being mean. However, Ms. Sorrels said she has never heard Ms. Lewis use inappropriate words with the children. Ms. Sorrels said she has seen an improvement this past week, and that Ms. Lewis is using "teacher's words" like " no, thank you" versus just yelling, "no." Ms. Sorrels said she used to help provide coverage and on a couple of occasions, she observed Ms. Lewis grab the children's wrists and "yank." Ms. Sorrels isn't certain, but she believes Ms. Lewis yanked Child B (male, 3 years old) and Child C (female, 3 years old) by their wrists. Ms. Sorrels has not seen Ms. Lewis hit Child A or any of the children in care. I interviewed Ms. Lewis who said she worked in the Preschool 1 Classroom with approximately 10 children. However, the Preschool 1 Classroom was closed and she recently moved to Preschool 2 Classroom. Ms. Lewis admitted that she has a big voice because she's hard of hearing. She needs to be loud to get the children's attention. Ms. Lewis said she has a loud voice, but she's never used inappropriate language with the children. Ms. Lewis denies hurting or hitting Child A or any of the children in care. She said she would never hurt a child. When asked if she has ever yanked or pulled a child's arm, Ms. Lewis admitted to grabbing a child's arm to prevent a child from fighting, biting, or hitting. Ms. Lewis said she loves the children and would never harm them. On October 5, 2022, I called and spoke with Child B's Mother and Child C's Mother left a message with Child D's Mother. Child H1's Mother's phone number was disconnected. Child B's Mother said she had a lot of issues with Ms. Lewis. She noticed that the classroom was always chaotic and that Child B's behavior had worsened and his potty-training regressed. Child B didn't want to go to school. Child B's Mother said she worries about Child B, so she watches the live feed for his classroom daily. In August, she saw Child B leave the bathroom and went to lie down on the classroom floor. On July 19, 2022, I called and spoke with the Complainant. The Complainant said the children's diapers are not being changed. According to the Complainant, children are going home with dried feces stuck to their bottoms. There have been times when children are picked up from the child care center with full soiled diapers. The Complainant said the child care center is using an app to track when diapers are changed. The Complainant doesn't think the app is updating or working. On July 21, 2022, I completed an unannounced on-site inspection. I interviewed program director and licensee designee, Ms. Jenifer Buller, and child care staff members, Ms. Jamie Sturgill, Ms. Julianne Lister, Ms. Michelle Empson, Ms. Maureen Edens, Ms. Natalie Cleary, and Ms. Nina Wax, separately. Child care staff member, Ms. Amora Wilson, was absent during the inspection. Ms. Buller said diapers are checked and changed every two hours. Diaper cream is applied upon request from the parents. She has not received any complaints from parents regarding diapering. 3 Ms. Buller said they used to record the daily activities such as diapering, meals and naptime on the Bright Wheel application. However, the corporation, Tutor Time Learning Centers, LLC, recently created their own app called SproutAbout. The app is glitchy and often goes down. The app has gotten better but there are still problems. When asked if they're writing down the daily activities on paper logs when the system does down, and Ms. Buller said no. I provided technical assistance and informed Ms. Buller that the written daily record should be provided to parents if the SproutAbout app is down. Ms. Sturgill is the lead child care staff member in the Toddler 2's Classroom. She works Monday through Friday from 7:30 A.M. to 6:00 P.M. Ms. Sturgill described herself as being obsessive compulsive when it comes to diapering. She does 90% of the diapering in her classroom. Diapers are checked and changed every two hours, starting at breakfast and throughout the day. Diapering is tracked using the app on the tablet. Ms. Sturgill said she is also the team leader for the center. She assists with training new hires. Ms. Sturgill said she has high standards in her classroom. She also stays on top of the other classrooms as well. The children are changed and thoroughly cleaned. Ms. Lister is a child care staff member in the Toddler 2 Classroom. She works Monday through Friday from 7:30 A.M. to 5:30 P.M. or 6:00 P.M. Ms. Lister said diapers are checked every two hours and changed, if needed. Each time they change a diaper it is entered in the SproutAbout app. Ms. Lister said if a child has diaper rash, parents may request that the child's diapers are changed hourly. Ms. Lister said she has no concerns regarding diapering and that the children are cleaned really well. Ms. Empson is the director in training. She works Monday through Friday from 8:00 A.M.- 4:00 P.M. Ms. Empson said she works in different classrooms and assists with coverage. However, she's mostly in the office assisting Ms. Buller. Ms. Empson said she has changed diapers in the infant and toddler classrooms. Diapers are checked constantly and changed every two hours. Ms. Empson has no issues or concerns regarding diapering. Ms. Edens is a floater and may cover all the classrooms, if needed. She is in the Two's Classroom today. She works part-time from 8:00 A.M. to 6:00 P.M. on Monday, Wednesday, and Thursday. According to Ms. Edens, diapers are changed every two hours and logged in the SproutAbout app. Parents have access to the app and can view the logs at any time. Ms. Edens has no concerns regarding diapering. Ms. Cleary is a floater in the Pre-K, toddler classrooms. On July 19, 2022, 1 called and spoke with the Complainant who said the toddler classrooms are out of ratio, specifically the Toddler 2 Classroom. The Complainant said there were two child care staff members with at least fifteen children in the Toddler 2 Classroom on July 18, 2022. The Complainant said the children are dropped off in the morning in one classroom. The children are moved back and forth from one room to the next. The Complainant doesn't know why they're doing that, but she assumes it's to maintain ratio in the classrooms. The Complainant said they're always short-handed and never have enough staff. On July 21, 2022, I completed an unannounced on-site inspection. I interviewed program director and licensee designee, Ms. Jenifer Buller, and child care staff members, Ms. Jamie Sturgill, Ms. Julianne Lister, Ms. Michelle Empson, Ms. Maureen Edens, Ms. Natalie Cleary, and Ms. Nina Wax, separately. She does not recall if the Toddler 2 Classroom was out of ratio on July 18, 2022. Ms. Buller said staffing is an ongoing issue. She is advertising and constantly hiring. Ms. Buller said she tries her best to provide coverage and move the children to other classrooms to maintain ratio. The child care staff members are not assigned to a specific classroom except for the lead child care staff members. Ms. Sturgill is the lead child care staff member for the Toddler 2 Classroom, and a team leader for the child care center. When asked if her classroom has been out of ratio, Ms. Sturgill said, "Yes, of course. We're out of ratio every day, throughout the day due to staffing." Ms. Sturgill said staffing has been difficult. There has been a lot of no -shows and call- ins. Ms. Sturgill said there were four child care staff members that called off today. The center is out of ratio at least a couple times a week. She said some days are great when staff show up to work. Ms. Sturgill said she came up with a solution to help staff from being overwhelmed when they're over ratio. Ms. Sturgill said if one classroom is over ratio, she moves the children to other classrooms. For example: Toddler 1 2 child care staff members with 12 children Toddler 2 2 child care staff members with 8 children Two's 2 child care staff members with 8 children In this situation, Ms. Sturgill said she would move two children from Toddler 1 to Toddler 2 and the Two's: Toddler 1 2 child care staff members with 10 children Toddler 2 2 child care staff members with 9 children Two's 2 child care staff members with 9 children Ms. Sturgill feels that it is safer to have three classrooms out of ratio instead of one classroom. She said being over ratio by that many children in one classroom is overwhelming to the staff. Ms. Wilson signed in at 3:50 P.M. Ms. Wilson, Ms. Sturgill and Ms. Lister were in ratio with eleven children. On August 11, 2022, Toddler I and Toddler 2 classrooms did not maintain the maximum group size. The program director, Jennifer Buller, submitted an incident report regarding the allegations on 4/28/2022. I contacted Ms. Buller on 4/29/2022 and set an appointment to view the video footage of the incident. I requested written statements from staff. On 5/3/2022, I conducted an inspection at the center. Ms. Buller stated that on 4/27/2022, staff member Annette Lewis came to her and reported that staff member, Jordan Glisan, grabbed Child A "wrong". Ms. Lewis checked Child A and there were no marks or bruises, but she yelled at Ms. Glisan for grabbing Child A by the arm. Ms. Buller let Ms. Lewis take a break to calm down and took her place in the room. Ms. Buller addressed Ms. Glisan. Ms. Glisan stated that she did accidently grab Child A's arm and squeeze it. Ms. Glisan stayed the rest of her shift that day and then was put on administrative leave. Ms. Buller confirmed that Ms. Glisan will not be returning to work at the center. I viewed the video footage recorded by the camera in the classroom. Ms. Glisan grabbed Child A by her arm to stand her up in the block area. I saw Ms. Lewis attend to Child A immediately and take her to a different area of the room. Shortly after, Ms. Buller came to the classroom and spoke with Ms. Glisan. I reviewed the written statements of Ms. Lewis and Ms. Glisan. Ms. Lewis wrote that Ms. Glisan was yelling at the children to clean up the toys. She observed Ms. Glisan grab Child A by the top of her left arm and "squeeze it hard and kind of twisted her arm" as Ms. Glisan "pushed" Child A out of the block area. Ms. Lewis stated that Child A started crying and Ms. Lewis told Ms. Glisan to "never touch a child like that again." Ms. Lewis then told Ms. Buller what she saw. Ms. Glisan's written statement says that Child A was asked multiple times to pick up the toys. Ms. Glisan admitted that when Child A threw a block at her, she "grabbed her arm and accidently squeezed and brought her up to her feet." Ms. Glisan admitted that Child A started crying. On 5/3/2022, I spoke with staff member, Annette Lewis. Ms. Lewis stated that she has worked with Ms. Glisan only a few times before 4/27/2022. On that day, Ms. Glisan was not feeling well and told Ms. Lewis she was hung over and sick. Ms. Lewis stated she had to remind Ms. Glisan that morning not to snap at the children or yell at them. During clean up time, Ms. Lewis observed Ms. Glisan grab, squeeze and twist Child A's arm. Child A cried immediately. Ms. Lewis stated that she checked Child A and there were no injuries. Ms. Lewis reported yelling at Ms. Glisan to never do that again. 3 On 5/10/2022, I spoke with staff member, Jordan Glisan over the phone. She stated that she repeatedly told the program director, Jennifer Buller, that she never wanted to work in the preschool classroom. She preferred working with older children. Ms. Glisan stated she was having a bad day on 4/27/2022 and had gone to Ms. Buller with her frustrations. She asked to switch to the school age classroom, and Ms. Buller told her, no. Ms. Glisan stated she does not work well with Ms. Lewis, and Child A was giving her a "hard time". Ms. Glisan stated she told Ms. Buller that she was going to have a mental breakdown and needed a breather. Ms. Glisan was told by Ms. Buller that she was not allowed to leave the classroom for a break because it would leave Ms. Lewis alone and out of ratio. Nobody was available to cover a break. Ms. Glisan stated that during clean up time, she asked Child A to pick up the toys. Child A threw a block at Ms. Glisan. Ms. Glisan stated that she was trying to slowly help Child A up, but Child A jumped up and pulled her legs up. Ms. Glisan confirmed that she would no longer be working at the center. On 5/10/2022, I called Child A's mother. She confirmed that Child A had no marks, bruises, or injuries. On 0311812022 I interviewed Child A's Father, who stated that Child A informed her mother that the "man teacher" hurt her when he put his finger in her butt (she refers to her butt as her vagina) when she was in the bathroom at the center, and it hurt. Child A's Mother then asked Child A's Father to speak with Child A and she said the same to him. The alleged incident occurred on Thursday 03/17/2022, which was Child A's- day attending the center. Child A's Mother and Father did not know the names the male child care staff members that work at the center. Child A's Mother looked on the centers app and learned that there are two males that work at the center, Mr. Mills and Chris Johnson. She asked Child A which of the two had touched her, and Child A stated that it was Mr. Mills. Child A's Father stated that after Child A's statement, they contacted M On 03/18/20221 interviewed Child A's Mother, who stated that Child A was picked up from the center on 03/17/2022 by her mother. It was Child A's day attending the center. Child A was upset at pick-up and did not want to go to e park to play. When they arrived home Child A went to the bathroom, and she said that her butt hurt. Child A's Mother asked Child A if someone hurt her and she said, "Yes", the "man teacher" hurt her. Child A's Mother asked how he had hurt her, and she said with his finger, and he had sharp nails and it hurt. Child A's Mother touched Child A's vaginal area and asked if that was where he had touched her, and Child A said, "Yes'. When questioned Child A stated that he had put his finger inside her. When she asked where it happened, Child A said in the bathroom. On 0312512022 Ms. Buller stated that Mr. Mills is the child care staff member in the two-year-old classroom The lead caregiver left the center the week prior, and since that point Ms. Buller has assigned various caregivers to work in the classroom with Mr. Mills to maintain ratio. Child A is in the preschool two classroom with Ms. Sorrels and Ms. Glisan. Mr. Mills was with Child A at the end of the day on 0311712022 when the classrooms combined at the end of the day. That would have been the only time that Child A was with Mr. Mills. Ms. Buller provided aily attendance for 03/1512022, 03/1612022, and 0311712022; that Child A attended the center. Mr. Mills was only with Child A on 03/17/2022. Mr. Mills does not work in the classroom with Child A. On 031/5/2022 the preschool 2 children did not combine with another class at the end of the day. On 0311012022 Child A was signed out at 5:52 pm. The preschool 2 class combined with the pre-k class at 5:30 pry and Mr. Mills was not present when the classrooms combined. On 04!0312022 1 interviewed Ms. Glisan, a floater, who stated that she has worked with Mr. Mills in the evening when the classrooms combined at 5:00 pm. On 0311712.022 she was leaving when the preschool 2 and toddler 2 classrooms were combining. Ms. Sorrels and Mr. Mills were present when she left for the day. She did not see Mr. Mills interacting with Child A. Ms. Gilsan stated that Mr. Mills is not inappropriate with the children. On 0410812022, 1 interviewed Ms. St r ill, who stated that she was on the playground with Mr. Mills at the end of the day when Ms. Sorrels left for the day on 03,1712.022. At 5:00 p.m., Mr. Mills, Ms. Sorrels and Ms. Sturgill were all on the playground, but then Ms. Sorrels signed out at 5:11 pm. She was there when Mr. Mills went inside the preschool 2 classroom to take Child B to the bathroom. He took Child A with him because she was upset and wanting her mother so he thought that it would help her to walk with him. To her knowledge, Child A did not have to go to the bathroom_ She works with Mr. Mills every day in the afternoon when the classrooms combine, and she has never observed him being inappropriate. On 2/8/2022, Jenifer Buller, program director and licensee designee, self-reported that Child A had been left alone in a classroom for about 5 minutes when her class was transitioning to a different classroom. On 2/10/2022, I spoke with Ms. Buller on the phone and requested that she submit written statements from the staff involved and asked to view the video footage. She submitted written statements from herself and staff member, Matthew Mills. She also requested that her area manager, Tanya Zoro, obtain the video footage. In a written statement from Mr. Mills, he admits to not doing a name to face attendance check as they left the Preschool 1 classroom to combine with another classroom and unintentionally left Child A behind on 2/7/2022. 2 Ms. Buller's written statement says that at about 3:45 p.m. on 2/7/2022, she went into the Preschool 1 classroom to retrieve some clothing for a child and found Child A in the room alone. Child A seemed happy and asked where her mother was. Ms. Buller took her back to Mr. Mills in the room where the class had transitioned. Ms. Buller's statement says that Child A was left alone about 3:40 p.m. and was found approximately five minutes later. On 2/14/2022, I called Child A's mother. She stated that nothing bad happened and things were "all good" with the center. She did not have any concerns. On 2/14/2022, I completed an onsite inspection. Ms. Zoro was present, and I viewed the video footage of the Preschool 1 classroom for 2/7/2022. It appeared that Child A was inside the classroom bathroom when the rest of the class left around 3:40 p.m. When she exited the bathroom, she was alone. Child A appeared to be confused, but not distraught. About four to five minutes later, Ms. Buller entered the room and calmly talked to Child A, then took her to be with her class. I observed the Preschool 1 classroom and viewed Child A interacting with her classmates.

On 09/21/2021, I conducted an unannounced on-site inspection. Upon entering the center, I walked through all open classrooms to verify the ratios in each room. They were as follows: 2 • Infant classroom (birth to 12 months-requiring 1:4 ratio)- 3 staff members with 11 children. • Toddler 2 classroom (18 months to 2 years-requiring 1:4 ratio)- 2 staff members with 11 children. • Two's classroom (24 months to 30 months-requiring 1:4 ratio)- 1 staff member with 7 children. • Preschool classroom (30 months to 4 years-requiring 1:8 ratio)- 2 staff members with 14 children. • PreK classroom (4-5-year-old-requiring 1:12 ratio)- 1 staff member with 13 children. I interviewed Mary Wolner (assistant program director), Andrea Pipa (lead infant caregiver), Jamie Sturgill (lead toddler 2 caregiver), Elizabeth Mitchell (assistant toddler 2 staff member), and Christopher Johnson (lead two's caregiver). All interviews were conducted in the classrooms, as there were no staff members available to cover for staff members to allow for interviews in a separate room. Ms. Wolner stated that since the beginning of September 2021, the center has had issues maintaining ratio in all the classrooms. Ms. Wolner indicated that this is the result of numerous staff members leaving, and not having enough staff members to staff the center appropriately. She added that the center had lost three staff members last week, resulting in most of the classrooms being out of ratio at some point during the week. Ms. Wolner also indicated that management at the corporate office is aware of the staffing issue and had promised to send her temporary staff members until new full-time staff could be hired and trained. Ms. Pipa stated that the infant classroom has been routinely out of ratio for the last few weeks, and management continues to enroll more children despite the center already being short-staffed and unable to maintain ratio. In addition, Ms. Pipa disclosed that staff members are often forced to skip rest breaks and routinely eat their lunches in the classrooms while providing care for the children. She also indicated that it is common practice to blend classrooms together to try to maintain ratio, but that has caused the room to be over group size. Ms. Pipa indicated that she had personally emailed Ms. Zoro on 09/13/2021 to inform her of the ratio and capacity issues that the center is facing daily. She added that Ms. Zoro visited the center on 09/14/2021 and was able to observe that many of the classrooms were out of ratio during her visit. Ms. Pipa added that earlier in the morning she and another staff were both caring for 11 children. She provided a copy of the schedule for the rest of the week which showed that there are 15 children scheduled to be in the infant classroom on Wednesday 09/22/2021 with 3 staff, and that Friday 09/24/2021, she was scheduled to be alone in the infant classroom with 12 children. Ms. Sturgill stated that for the past month, the toddler 2 classroom has been out of ratio numerous times. Ms. Sturgill indicated that there were only 2 staff caring for 13 children this morning. Ms. Sturgill said that she has spoken to Jennifer Buller (program director) and Ms. Wolner regarding these ongoing issues, but things have 3 not improved. Ms. Sturgill stated that Ms. Zoro visited her classroom on 09/14/2021 at around 1:30pm and saw that she was out of ratio. Ms. Sturgill said that she spoke directly to Ms. Zoro and informed her of the ongoing issues. Ms. Sturgill stated that the center continues to enroll new children even though they keep losing staff, and staff are unable to take breaks and often rush through bathroom breaks to minimize the time the classrooms are even more out of ratio. Ms. Sturgill stated that she eats her lunch in the classroom because there is no one to give her a lunch break.
