R 400.1903 · R 400.1903 Licensee responsibilities. (1) A licensee shall be responsible for all of the following provisions: (d) Inform parents when a child care staff member is providing care in the absence of the licensee.
On 12/17/2021 I spoke with Child A's Mother by telephone regarding the reported allegations. She explained on 12/14/2021 she dropped off Child A, male age 5 months, at the licensee's home. She then went to Starbucks which is approximately 10 mins. from the licensee's home. While she was waiting for her drink, she saw the provider in the same line. She was upset and frustrated that she left her son at her home without telling her she was leaving him with her husband, who is not an approved child care staff member. She sent texts to the licensee informing her she would be coming to pick up her son. When she arrived at the licensee's home she expressed her concern about the situation, got her son and left. (3) A licensee shall ensure that child care staff members and child care assistants, prior to caring for children, have training that includes information on all of the following: (a) Safe sleep practices to prevent sudden infant death syndrome. (b) Recognition of and the reporting of child abuse and neglect. (c) Prevention of shaken baby syndrome, abusive head trauma, and child maltreatment.
On 12/14/2021 the licensee left Child A, male age 5 months, at home with her husband who is not an approved caregiver.

Child B (Female, aged 2) disclosed twice that Ms. Race hit her on her bottom and Child A (Female, 6 months old) and Child B had scratches on their bodies. Child A has also been cold to the touch after picking up. Ms. Race did not feed Child A on several occasions.

On 03/05/2021 I spoke with the complainant. On 03/05/2021 I spoke with Child A and B's Mother. She stated recently, Child B first told her while they were driving home that "Ms. Lorie hit me" and she asked where and Child B stated, "On my butt." Child A and B's Mother asked her why this happened, and Child B responded because she was crying, and she did not want to go to sleep. The second time Child B mentioned this happening was in front of Ms. Race, last Tuesday on 02/23/2021. Child A and B's Mother explained she had put in her notice withdrawing from care on Monday and her and Ms. Race were discussing the deposit on Tuesday. Child B said, "Ms. Lorie hit me on my butt." Ms. Race did not respond to this, so Child A and B's Mother repeated "She hit you?" and Child B responded yes. Child A and B's Mother explained she then looked at Ms. Race and Ms. Race responded, "I most certainly did not." She became defensive. Child A and B's Mother explained Child B has never said anything like this before and she wanted to understand what this meant to Child B, so she asked Child B if Child B's Father hit her, and she said no. When she asked if Ms. Race hits her, Child B said yes. She stated this morning, Child B did not want to go to Ms. Race's and when asked why and also asked if Ms. Race was nice and Child B said No, so she asked if Ms. Race was mean, and Child B said yes and she "hurts my butt". Child A and B's Mother stated the next day, she texted Ms. Race and explained this was the second time Child B said Ms. Race hit her and asked Ms. Race why. Ms. Race responded with "I can't believe you would bring that into the conversation with the deposit, I am hurt by that." It was presumed by Child A and B's Mother that she was hurt because she was being confronted. Child A and B's Mother stated Child B reported this happened three times and there were no marks or bruises as a result of this happening. Child B also reported that this hurt. Child A and B's Mother explained that she patted Child B with an open hand on her bottom and asked if it happened like this and Child B responded yes. Child A and B's Mother explained Child B knows the difference between a pat and being hit as she is not spanked at home and she has never been exposed to spanking before. Child B has been at the child care roughly beginning at the end of November of 2020. Once Child B stated Ms. Race hit her a second time, she pulled her out of the child care immediately. Ms. Race never gave a response as to why Child B would say she hit her. When Child A and B's Mother told Ms. Race Child A and Child B would not be returning, Ms. Race asked if there was a reason why and explained that she never "laid a harmful hand" on Child B. Child A and B's Mother stated she noticed Child B never wanted to go to Ms. Race's home and she always cried when she had to go. She stated when she picked up Child B, she held her 3 head down until they left the child care and then she would open up. She stated Child B is now attending her previous child care and she completely turned around and is excited to go to child care. Child A and B's Mother explained when she picked up Child A from Ms. Race, she put her in her car seat that has a fleece cover that zips and a blanket. When they arrived home, Child A and B's Mother would change her pants and Child A's legs were really cold to the touch and her feet were freezing. She stated Child A's torso was really warm and so were her arms, but her legs and toes were very cold. She stated she asked Ms. Race if she was dressing Child A warm enough and Ms. Race stated her basement is pretty warm. Ms. Race also reported that Child A had difficulties keeping her socks on. Child A and B's Mother stated Child A also had scratches on her legs, so she believes that Child A did not have pants on while crawling on the basement. On 03/05/2021 I spoke with Child A and B's Mother. She stated Child A began care at the beginning of January 2021 and there have been numerous days where Ms. Race would only feed Child A five ounces for the whole day. Child A and B's Mother explained that Child A typically eats every three to four hours at home with her and other caregivers. She stated Ms. Race told her she could not get Child A to eat, and Child A was too fussy. She explained on several occasions, Ms. Race did not feed Child A until 11:00am or 11:30am and the last feeding time for Child A would typically be 6:00am, so Child A would go roughly five hours without feeding. When Child A first started, it did not seem that Ms. Race attempted to feed her as the recording of her feedings did not show this. Another day on 02/15/2021, Child A did not get fed until 11:15am and that day she only got 12 ounces with just over two 1/2 feedings. She explained Child A should be getting at least 18 ounces while in care or around that many ounces. She stated for some reason, Ms. Race is the only one that cannot get Child A to eat. Child A and B's Mother agreed to send me the feeding times that were documented. On 03/05/2021 I received the feeding times from Child A and B's Mother. This shows that Child A began care on 01/04/2021. Child A and B's Mother also noted that she had brought Child A into the doctor's and Child A had lost almost a pound from when Child A and B's Mother last weighed her roughly three to four weeks ago. On 01/18/2021 the recordings show Child A had 2 ounces at 10:30am and another 2 ounces at 10:50am and 4 ounces sometime that day, but no times were recorded. On 1/20/2021 Child A had 1 ounce and it was noted she was fussy, so Ms. Race provided gas drops (no times given for this feeding) and at 2:20pm, she had another 6 ounces, no other feeding times were recorded that day. On 01/25/2021 Child A 7 was given 2 ounces at 11:25am and 4 ounces after 3:45pm. On 01/26/2021 Child A had 5 ounces between 9:25am and 9:55am and another 3 ounces at 12:15pm, no other feedings recorded. On 02/01/2021 one feeding was recorded of Child A having 4 ounces sometime after 10:25am, this recording appears to be incomplete as Ms. Race did not finish the recording of Child A's naptime. On 02/03/2021 Child A had 4 ounces at 10:40am, 2 ounces at 12:30pm, 2 ounces at 3:45pm and a final feeding of 3 ounces sometime after 4:35pm. On 02/15/2021 Child A had 5 ounces at 1/2 11:15am, 2 ounces at 12:35pm and 5 ounces after 3:35pm. On 02/16/2021 Child A had "5 ounces throughout the day". On 02/17/2021 Child A had 1 ounce at 12:05 with gas drops, 3 ounces after 1:05pm and 2 ounces after 3:50pm. On 02/18/2021 Child A had 7 ounces at 11:10am and 2 ounces at 12:30pm. On 2/22/2021 Child A had 5 ounces at 11:25am, 2 ounces at 12:25pm and 3 ounces at 4:20pm. On '/2 02/23/2021 Child A had 2 ounces after 10:35am, 2 more ounces after 10:55am and 1 ounces at 12:20pm. On 02/24/2021 it was noted Child A had a "fussy am" and 1/2 was fed 5 ounces after 11:35am, 3 ounces at 1:15pm and 4 ounces after 4:00pm. On 03/09/2021 I made an unannounced visit. Ms. Race explained that most children that are breastfed struggle with the transition to being bottle fed. She stated sometimes she had difficulty with Child A on Monday's, after the weekend, or if she was out of the child care for a few days. She explained she had to play around with different bottles to find one that Child A would take too. Ms. Race stated when Child A first started, both herself and Child A and B's Mother would try different bottles to find one that would work, and she found that the baby brown bottles work best for Child A. She stated on Child A's difficult days she would eat once or twice that day, but she would try more often than that. Child A would not latch on or take the bottle. She stated she cannot force Child A to latch on or take the bottle if she does not want to. She stated she kept track of her feedings in a notebook that she p
