On 01/25/2023 The complaint stated that the Fox 2-year-old classroom frequently has nine children with one child care staff member. On 01/27/2023 Ms. Koendarfer stated she is the lead caregiver in the Fox classroom. The children are ages 23 months to 30 months and the child care staff member to child ratio is 1 to 4. Since September 2022 she has worked in the Fox classroom alone with more than five children, mainly on Wednesdays and Thursdays. She has six children alone on Wednesday and five children alone on 2 Thursday. Ms. Brown, the program director, told her that she could have 8 children alone because the state rules have changed. She could not locate this change in the licensing rules, but she followed Ms. Brown's instructions. There are seven children enrolled in the class with six children that attend regularly. She could not recall having nine children enrolled or present. Ms. Lane, pre-k lead caregiver, stated that Ms. Brown informed her that the child care staff member to child ratio had changed in September for the Fox classroom from 1:4 to 1:8. Ms. Brown stated that she had received an email, and the state law had been amended. Ms. Lane thought that the Fox classroom ratio was 1:4 until Ms. Brown told her that the law had changed. Ms. Valente is a floater, and she has worked in the Fox classroom breaking Ms. Koendarfer. She has worked with more than four children on several occasions. She has worked with five and six children alone. This started in September of 2022. Before September the child care staff member to child ratio was 1:4 in the Fox classroom. She was told by Ms. Koendarfer that she could be alone with more than four children because there was a change in the state law. On 01/27/2023 there were four children in the Fox classroom with Ms. Koendarfer. I observed the room to be in compliance. On 01/31/2023 Ms. Brown stated that all of the children in the Fox classroom were 2 years old which was why Ms. Koendarfer could have more than four children '/2 alone in the classroom. She stated that the staff misunderstood what she was saying when she informed them that the child care staff member to child ratio is 1 to 8 when the children turn 2 She did not tell the staff that the law had changed. I requested 1/2. the child information cards for the children enrolled in the Fox classroom. On 02/06/2023 I received the child information cards for the Fox classroom from Ms. Brown. On 02/15/2023 I reviewed the seven child information cards for the children enrolled in the Fox classroom. Five of the seven children were under 2 in September 2022; 1/2 Child A (2 years 2 months), Child B (2 years 4 months), Child C (2 years 1 month), Child D (1 year 10 months), and Child E (2 years old); four were under 2 in '/2 November 2022 Child A (2 years 4 months), Child C (2 years 3 months), Child D (2 years old), and Child E (2 years 2 months), three were under 2 in January 2023 1/2 Child C (2 years 5 months), Child D (2 years 2 months), and Child E (2 years old 4 months), and two were under were 2 in February 2023 Child D (2 years 3 months) 1/2 and Child E (2 years 5 months). (10) All child care staff members who work directly with children are required to be trained in first aid and pediatric, child, and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center, and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child, and adult CPR. Each of these child care staff member's first aid and CPR certificates must be valid and retained on file in the center.
I spoke with the complainant; she stated none of the infant and toddler staff members have current CPR, First Aid, and Bloodborne Pathogen training. The complainant stated she observed the cards were expired by at least a year. I spoke with the licensee designee, Nicole Brown. Ms. Brown stated all staff members are required to complete CPR, First Aid, and Bloodborne Pathogen training at date of hire and every two years before the expiration date. I reviewed 30 staff files. All 30 staff files contained valid cards through the American Red Cross for pediatric and adult CPR, First Aid, and Bloodborne Pathogen training dated April 12, 2019. The cards will not expire until April 12, 2021.

I spoke with the complainant who stated staff members in the infant room do not check diapers frequently. Infants sit in dirty diapers for hours at a time. The infant room smelled strongly of feces. Staff members would only use bleach to clean the diaper changing tables and did not wash and rinse the diaper changing area between each use. I reviewed the center's diaper changing policy. It illustrated that staff must wash with soapy water, rinse, and sanitize the diaper changing area after each diaper change. Staff are required to check diapers every two hours. Ms. Brown stated during observations of the classroom, she observed that all staff cleaned and sanitized the diaper changing tables using the three-step process. No parents or staff have brought concerns regarding diapers not being changed frequently. I spoke with Child A's Mother and Child B's Mother; they both stated their children's diapers were always clean at pick-up time and they did not have any rashes or other evidence of not having diapers changed frequently. Both parents stated they receive daily records that show diapering was completed at least every two hours. They did not have any concerns regarding the cleanliness of the center or cleanliness of the diaper changing area. Deborah Williams stated she has observed diapering in the infant room. She has seen diapering checks completed at arrival, every two hours, before nap, after nap, and before pick-up. No parents have approached her with any concerns regarding diapering policies or procedures. There have been no complaints regarding infants with rashes. Staff clean the diaper changing area using the three-step process of washing the area with soapy water, rinsing the diaper changing table, and then sanitizing the diaper changing table.

I spoke with the complainant who stated she had concerns regarding inappropriate supervision in the infant room. She stated in September of 2019, she observed staff grabbing infants by the back of the arm and yelling at them. She stated every staff member employed at the center has been observed yelling at and pulling on the infants' arms. She saw a staff member pull a one-year old female up from sitting to standing position, resulting in two finger marks above the elbow. The complainant stated the fingerprint marks went away after a minute. The complainant also observed a staff member placing their legs over a child to keep him or her from getting up. The complainant stated she also observed a child crying during naptime in the infant room. The staff member placed her leg over the child and bopped the child on the mouth repeatedly. The complainant stated she did not bring these concerns up with the director or licensee designee because they always ignored everything she shared with them. I reviewed the center's discipline policy, which states staff members and parents will address children's behavior together. Staff will re-direct children and talk to them at eye level. The licensee designee, Nicole Brown denied observing any inappropriate discipline at the center. She stated staff members always use re-direction and talking at the child's level. Staff and parents are supposed to communicate to decide cooperatively what type of discipline should be used with each individual child to ensure that only positive forms of discipline are used. Ms. Brown denied that any staff member or parent has ever approached her with concerns regarding appropriate care and supervision. Child A's Mother, Child B's Mother, and Child C's Mother all stated that staff members use appropriate discipline at the center. They denied having any concerns with any of the staff members at the center. 5 Deborah Williams stated she has not received any telephone calls from parents reporting any concerns regarding infant caregivers' interactions with children. No staff members or parents have approached her with any concerns.

The Licensee Designee Nicole Brown stated a ratio of one staff member with four infants is maintained at all times. There is never a time when the ratio exceeds four children with one staff member. Ms. Brown is available to step into the classroom if additional assistance is needed. Child A's Mother, Child B's Mother, and Child C's Mother all denied concerns regarding ratio. Child A's Mother stated Child A was often the only child present in the room at pick up and drop off. There are sufficient staff present to supervise children. Child B's Mother stated she has never seen more than three infants with one staff member at the facility. Child C's Mother stated she has never seen more than three or four infants present with one staff member. Deborah Williams stated she is not in the infant rooms regularly but the times she has visited the rooms, there have never been more than four children with one staff member. No parents or staff members have brought up any concerns regarding ratio.
