After interviewing the complainant, licensee designee, Misti Papuga, teachers and parents of the Heavenly Blessing's classroom, I find that the required temperatures in the Heavenly Blessings' classroom were maintained at a safe and comfortable level so that children in care were not chilled.

On 12/03/2021, Ms. Sweeten emailed an incident report, and according to the incident report, at about 1:45 p.m., on 12/03/2021 child care staff member Shakeela Younas walked in the bathroom to dump out mop water and allowed the bathroom door to close behind her leaving the children in Shepherd Flock Two classroom unattended. She was in the bathroom for one minute, popped her head back in the classroom and went back in the bathroom for another minute until another child care staff member walked in the classroom. After Ms. Sweeten spoke with her, she decided to quit. On 12/07/2021, Ms. Papuga said Ms. Younas was the only staff member present in the classroom during the incident. The ages of the children in the class are between 18 months and 30 months old. She was not present at the center when the incident occurred. She received a text message from Ms. Sweeten notifying her that when Ms. Herndan walked in Shepherd Flock Two classroom, no one was in the room with the children until Ms. Younas walked out of the bathroom. Ms. Papuga reviewed video of the incident. According to Ms. Papuga, Ms. Younas took a bucket into the 2 bathroom, looked out of the bathroom, and went back into the bathroom. The bathroom door almost closed completely and then Ms. Herndan walked into the classroom. Ms. Younas said she allowed the bathroom door to close because she did not want the light to bother the sleeping children. Ms. Younas decided to return to working at the center. She has not been and will not be left alone with the children. If a staff member needs assistance or needs to leave the classroom, they are supposed to use the intercom to call someone to relieve them. Ms. Herndan stated during naptime, around 2:00 p.m., she was passing by Shepherd Flock Two classroom to drop off something in the room. She went into the classroom and did not see anyone. Less than a minute after she went into the classroom, Ms. Younas walked out of the bathroom. She did not say anything to Ms. Younas and Ms. Younas did not say anything to her. According to Ms. Herndan, a staff member is always to be in a classroom with the children. If a staff member needs to leave the room, they are supposed to call someone at the front to assist them. Ms. Younas stated during naptime she mopped the floor. She said the first time she went into the bathroom the door was open. The second time she went into the bathroom she dumped the mop water out of the bucket and the door closed. She allowed the door to close because she did not want the sleeping children to be disturbed by the light. She could see the children when she went into the bathroom. She understands now that the children must not be left alone for any reason. If she needs to leave the classroom, then she must buzz the intercom to ask someone to relieve her. Ms. Younas said there were eight children sleeping in the classroom and she was the only staff member in the classroom while the children were sleeping. The other staff member who was in the classroom prior to naptime was taking her break. She could not recall the other staff member's name. Ms. Robbins stated she worked with Ms. Herndan in Shepherd Flock Two classroom until she went on break around 1:00 p.m. When Ms. Younas relieved her for her break, she left Ms. Younas alone in the classroom with the children. She believes Ms. Awwad went into the classroom after she left for her break. She returned to the classroom at 2:00 p.m. and Ms. Younas was the only staff member in the classroom. Ms. Robbins said if a staff member needs to leave the classroom or needs assistance, they are supposed to use the intercom to call for help. Ms. Awwad stated she went to Shepherd Flock Two classroom at 1:00 p.m. to relieve Ms. Robbins for her break. She stayed in the classroom with Ms. Younas until the children were sleeping. Ms. Younas, Ms. Herndan, Ms. Robbins, Ms. Awwad, and Ms. Papuga stated on 12/03/2021, Ms. Younas was the only caregiver in Shepherd Flock Two classroom with the children during naptime. The video footage showed seven children in the classroom with Ms. Younas during naptime. On 12/03/2021, the center did not meet the required ratio of child care staff members to children. The center had one staff member present with eight children between the ages of 18 months and 30 months old during the children's naptime.
