    On 06/24/2021, I completed an unannounced onsite inspection. I informed the program director, Ms. Krista Mason, of the allegations. Ms. Mason shared knowledge of a parent reporting they thought their child had Roseola, however, they never provided her with a doctor's note to confirm the diagnosis. She identified this child as Child B. She shared the parent took the child to the doctor after observing a rash but, again, she never received any paperwork with an actual diagnosis. Ms. Mason went on to share that a child in their Lyric classroom was kept out of care by her parent for a week (05/28/2021-06/07/2021) due to a fever and rash. She shared the parent took the child to the doctor and was told it looked like Roseola. The following weekend a child (Child A) came down with a fever. She was informed by the mother on 06/14/2021 that Child A would be staying home due to a high fever of 105 over the weekend. Child A stayed home Monday and returned on Tuesday. On Wednesday (06/16/2021), shortly after Child A arrived, he was placed in the Patel's classroom from the Lyric classroom due to ratio compliance efforts. Child Care Staff Member (CCSM), Ms. Deme'lah Pittman noticed the child had a slight rash in the morning and observed that the rash was spreading. The mother was notified and said rashes are typical for him after he runs a fever. I asked Ms. Mason if Child A was picked up due to the rash spreading. She shared he was not because he was not running a temperature and the mother indicated this was normal for him after running a fever. I interviewed CCSM, Ms. Pittman. Ms. Pittman shared approximately 3 weeks ago Child A was transitioned for the day from the Lyric classroom to her room, Patel's. When he transitioned to her room, she immediately noticed his face appeared red. She spoke with CCSM, Christine Lee who's familiar with Child A as she's an assigned caregiver in the Lyric room. Ms. Lee shared that she noticed his face was red, but he wasn't running a fever, nor did he appear to be ill. During diapering she noticed he had a rash from his thighs to his ankles and a little on his arms. Within a short time, she noticed it had spread and was all over his arms, chest area and appeared more red. She notified Ms. Mason who asked her to take a picture and send it to the mother. Ms. Pittman shared that she took his temperature, and he wasn't running a temperature and he did not appear to be in any discomfort. Child A's mother responded back through the parent app in which the picture was sent. She said for them not to be alarmed; the rash was nothing to worry about because when her children get fevers, they get Roseola afterwards. Ms. Pittman shared that she verbalized this to Ms. Mason and showed her the response in the parent app. I asked if Child A was picked up after the spread of the rash. Ms. Pittman said contact was made with the mother before lunch and after Ms. Mason was notified; Ms. Mason did not require Child A's mother to pick him up. Child A remained in care until 5pm. Ms. 3 Pittman shared that, to her knowledge, parents were not notified and confirmed a posting was not placed on their parent board, and she did not recall seeing any notifications placed in the parent app. I interviewed CCSM, Ms. Lee. She indicated she was aware of the rash on Child A, as Ms. Pittman inquired about Child A's condition when he transitioned to her classroom. She recalled thinking he was a little red in the face but did not observe any rashes prior to him transiting to another room. After interviewing CCSM Ms. Pittman, I spoke with Ms. Mason to ask about her knowledge of Child B's mother report that Child B had Roseola. She denied being told this by Child B's mother and denied that it was reported to her by Ms. Pittman or placed in their parent app. Ms. Mason opened the parent app and went to the date of the rash concerns (06/16/2021) for Child B to show that there was nothing noted from Child B's mother indicating the rash was a result o

    The facility developed an illness policy, however, they failed to implement the policy when Child A was observed to develop a spreading rash and contact was not made with his parent to pick him with within 1 hours of being notified.     On 06/15/2021, I completed an unannounced onsite inspection. I informed the program director, Ms. Mason of the allegations made against the facility. Ms. Mason was aware of the allegations due to a phone call she received yesterday by her Assistant Director, Jennifer Trawick. Ms. Mason shared that she was not working on 06/14/2021 (date of alleged incident); therefore, she did not have any direct contact with the person who expressed concerns. Ms. Mason was asked to share what she was informed about the incident by Ms. Tarwick. She shared a parent (Child E parent) called the facility and said her husband would be at the facility to pick their child up. When the father arrived, he informed Ms. Tarwick that his wife would be arriving shortly and wanted to discuss a concern with her. When the mother arrived, she shared that while watching the live feed from the parent app she observed a Child Care Staff Member (CCSM) grab a child by the arm in an aggressive manner and place the child on the cot in the Pratt classroom. After receiving this information from Ms. Tarwick, she informed her that a BCAL-4605 -Incident report- would need to be completed and she herself would contact the assigned Child Care Licensing Consultant the following day. She shared that Emily Keren and Haylee Cook were the CCSM's working in the classroom during the alleged incident. I inquired about the recordings that parents have access to, and Ms. Mason shared their system runs on a live feed. The feed doesn't record but will allow them to go back for a short timeframe and watch a feed. While present, Ms. Mason checked the timeframe the system allows her to go back and watch and confirmed it's 9 minutes. I asked Ms. Mason to follow up with her corporate office to see if they have access to recorded footage. Ms. Mason reached out at a later time and confirmed that the footage is not kept in the corporate offices, and they don't have access to footage. 3 Ms. Mason denied that any concerns regarding the temperament of Ms. Keren or Ms. Cook has ever been brought to her attention by other CCSM's or parents. I interviewed Ms. Tarwick regarding the allegations. She shared on 06/14/2021 she received a call from Child E's mother around 12:30pm. She informed her that Child E's father would be at the facility to pick Child E up. Since this was Child E's first day, she thought Child E's parents were picking him up early, so he didn't have to do a full day on his first day. When Child E's father arrived, he shard that his wife was coming and would like to discuss an issue with her. When she arrived, they met in the office, and it was at this time that she shared her observations from watching the cameras on their parent app. Child E's mother shared she observed a CCSM grabbing a child who was identified as Child A. Child E's mother described the grab as being aggressive and made her uncomfortable and believes that Child A was being mistreated. As a result, she no longer wanted her child to be enrolled and informed her that he would not be returning. I asked Ms. Tarwick about the live feed through their parent app. She shared they use an app called Nurture, which allows parents to log into their account and watch live feed from the classroom that their child is enrolled. I asked if she was able to review the footage after Child A parents left. She shared she was not because it's a live feed and wouldn't allow her to go back to see the classroom footage. Ms. Tarwick shared that she made contact with the two CCSM's working in the classroom during the time Child A was present. The two CCSM's were identified as Emily Keren and Haylee Cook. She was told Child B was dumping her food and milk on the table, so she was removed and placed on her cot since it was time to transition to rest time. Ms. Tarwick shared both denied witnessing the other being aggressive towards Child B. Ms. Keren shared she didn't observe any aggressiveness with Child A take place, but Ms. Cook is the CCSM t

    On 06/15/2021, I contacted Ms. Tarwick regarding ratio concerns. She shared during her contact with Child Es mother, she expressed concerns regarding the number of children there appeared to be on the camera. Child E's mother did not share the number of children she observed but expressed that it looked like too many children in one classroom. Ms. Tarwick shared that she explained there was a 1 to 12 staff to child ratio in the Pratt classroom where Child E is enrolled, and ratio was maintained during the day of her concerns. I asked how many children were in the classroom during this day. She shared 24 children with two staff members. I observed the attendance records for this day and confirmed this information. I contacted Ms. Mason regarding the ratio concerns. She shared that the Pratt classroom is licensed for 24 children aged 2'/2 and up. I confirmed this by reviewing the original licensing report. Due to how active the classroom is, Ms. Mason shared she decided to split the classroom up and will operate the rest of the summer program at a 1 to 10 staff/child ratio. On 06/15/2021, I spoke with CCSM Ms. Keren. During her 5 months of employment, she denied having any concerns of ratio issues. I spoke with CCSM Ms. Cook regarding ratio concerns in any of the classrooms in which she works in as a floater. She denied any knowledge of ratio concerns. I spoke with CCSM Ms. Marentette regarding ratio concerns. She denied any concerns regarding ratio issues. I spoke with CCSM Ms. Freeman. She denied any ratio concerns at the child care facility. On 06/17/2021, I interviewed Child E's mother. She shared while watching the live footage there appeared to be too many children in one room. She wasn't able to provide a head count but shared the room was "full of kids." She shared there were "like 25 cots and no social distancing." I asked if she specifically counted the number of cots, and she confirmed she did not. On 06/17/2021, I interviewed Child A's mother and asked about ratio concerns. She shared she believes there are too many children in the Pratt classroom, but she doesn't know if they're out of ratio or not. Ratio issues have never been brought to her attention by CCSM's or other parents. 7 On 07/07/2021 I interviewed Child B's mother. She shared her child has been enrolled in the facility since 2019. To her knowledge the classrooms her child has been in have always been in ratio. I interviewed Child C's mother. She shared during drop off times it seems like a lot of children are in the room, but she isn't sure of the specific number. She shared her child has never expressed concerns regarding supervision or the number of children in the classroom. I interviewed Child D's mother. She shared she consistently watches the live feed, and she's never had any concerns regarding the number of children she's observed.

    On 04/09/2021 I completed an on-site inspection at the center and interviewed program director Krista Mason. She stated there was one positive case of Covid 19 in the Faris classroom last Thursday, April 1, 2021. Ms. Mason contacted the Health Department, all staff members that worked in the classroom, and parents of children in the classroom right after she found out. Staff members that worked in the Faris classroom are quarantined until April 12 and the children are quarantined until April 15. The parents of the children were contacted by phone and emailed a letter on April 1. Ms. Mason is not aware of anyone else from the Faris classroom testing positive for Covid 19. Ms. Mason stated before the positive case there had been a few children in the classroom that had runny noses with low grade fevers of no more than 99 degrees and this was believed to be from allergies and teething. The children that had these symptoms had been sent home, and the parents had these children tested for Covid 19; none were positive. Ms. Mason stated the center follows CDC guidelines for Covid 19, and all staff wear masks. The children in the classroom are under 2 years old and do not wear masks. Ms. Mason stated the center had a positive case of Covid 19 back in November 2020, and the center was closed for a few days at that time. Ms. Mason provided me copies of the letter emailed to the Faris classroom parents and a letter that was emailed to all parents at the center. The letter to the Faris classroom parents documented that their child was in direct contact with an individual that tested positive for Covid 19 and instructed them to have their child quarantine for 14 days. This letter indicated their child could return to the center on Thursday, April 15 if they remained symptom-free. The letter sent to the other families at the center informed them there had been a confirmed case of Covid 19 at the center. Both letters included information about Covid 19 symptoms and the Center for Disease Control (CDC)'s website for additional information. I reviewed the center's Covid 19 Response plan which includes, "perform temperature screening of every child, parent, and team member who enter the building... children's temperatures will be taken again at lunch every day.. .those with a temperature of 100.4 or above will not be allowed access to the school. ..those who display any of the following symptoms will not be allowed in the school: new onset cough or worsening cough, sore throat, shortness of breath, fever now or in the last 48 hours". On 04/12/2021 I interviewed Staff Member 2. She stated she works in the Faris classroom with Staff Member 1 and Staff Member 3. She stated everyone in the classroom was notified immediately on Thursday, April 1 about the positive Covid 19 case. Staff Member 2 stated staff and children were sent home early that day. Staff Member 2 stated she came back to work today (04/12/2021). Staff Member 2 stated 4 there were a few children earlier that week sent home for runny noses, but none of these children tested positive for Covid 19. On 04/20/2021 I interviewed Staff Member 3. She stated she had just started working at the center a few days before the Covid 19 case and she worked in the Faris classroom. Staff Member 3 stated she quarantined for 10 days after this. Staff Member 3 did not know how other staff and parents were notified. On 04/20/2021 I interviewed Staff Member 1. She stated she works in the Faris classroom. She was aware of the Covid 19 case. Staff Member 1 stated prior to the positive case there were children in the Faris class that had colds including coughs and runny noses, but the children were not running temperatures of 100.4 or higher, and none of these children tested positive for Covid 19 as far as she knew. Staff Member 1 stated she was not sure how the parents were notified of the Covid 19 case. On 04/23/2021 I spoke with Child B's Mother and Child C's Mother. Both stated they had been called and

    On 10/27/2020 Child A's Parents stated that they observed Ms. Hunt on the center's being inappropriate with Child A on live video on the Nurture App. Child A's Father observed Child A playing near another child. They did not know the name of the other child. The other child appeared to be holding a toy and Child A took the toy out of the other child's hand. Child A's Father observed Ms. Hunt grab Child A's arm and pry the toy out of his hand. Ms. Hunt gave the toy back to the other child. When Child A reached his hand out for the toy, she then swatted Child A's hand away from her. They did not have a screen shot of the incident because it was a live feed. This occurred around 11:00 am on 10/27/2020. The second incident occurred shortly before 12:30 p.m. when Ms. Hunt held Child A down on his cot by placing her leg across his back. Child A was trying to get up, and Ms. Hunt's leg held him down. Child A's Father took a screen shot with Ms. Hunt's leg on Child A's back. Child A's Father observed two other caregivers in the classroom when the incident occurred, and they were not observed interceding in the situation. Child A's Parents did not know their names. After observing the situation, Child A's Father called the center. He spoke with Ms. Hyndman and stated that he had observed Ms. Hunt being aggressive towards Child A on the Nurture App, and he was heading to the center to remove Child A. Child A's Mother stated that before Child A was picked-up from the center, the live feed of the classroom was disconnected, and they did not know why they could not see the live feed of the classroom. Child A's Father spoke with Ms. Hyndman when he arrived at the center. Ms. Hyndman stated that she had spoken with Ms. Hunt and she admitted placing her leg on Child A's back when he was on the cot. Ms. Hyndman stated that she would check with her corporate office to see how the situation would be addressed. Ms. Hyndman stated that Child A could be moved to another classroom, but Child A's Parents decided to remove Child A from the center. On 10/28/2020 I received an incident report from Ms. Mason that stated that Ms. Linsenman had received a phone call from Child A's Father on 10/27/2020. Child A's Father stated that he was disturbed because he had witnessed Ms. Hunt on the center's app, place her leg across Child A, holding him down on his cot during rest time. He also stated that he was heading to the center to retreive Child A. Ms. Hunt was placed on administrative leave. 3 On 10/28/2020 Ms. Mason stated that she was not at the center when the incident occurred. She was informed by Ms. Linsenman that Child A's Father had observed Ms. Hunt on the center's app hold Child A down on his cot by placing her leg across his back. Ms. Mason had not spoken to Child A's Father. Ms. Hunt has been placed on administrative leave. On 10/30/2020 I received a written statement via email from Child A's Parents. The statement reiterated both of their concerns that were expressed on 10/27/2020. Child A's Parents stated that due to the treatment that Child A received at the center from Ms. Hunt, Child A would not be returning to the center. Child A's last day at the center was 10/27/2020. On 10/30/2020 Ms. Coyle and Ms. Shannon were in the classroom when the alleged incidents occurred. They did not observe Ms. Hunt with her leg on Child A's back during naptime and they did not observe her take a toy from and hit Child A, or any other child. They have never observed Ms. Hunt being inappropriate with the children. Ms. Coyle and Ms. Shannon stated that the children have naptime from 12:30 pm- 2:30 pm. If the children wake up before 2:30 pm, they can get off their cot and play with a toy until the other children wake up at 2:30 pm. Ms. Coyle and Ms. Shannon stated that Child A was signed out of the classroom when Ms. Hyndman removed him from the classroom during naptime. Ms. Hyndman stated that Child A's Father called the center and informed her that he had observ
