On 03/14/2023, I observed a Forensic Interview of Child A in Traverse City. were also present Forensic Interviewing protocol baseline questions. He was asked what he liked and did not like about the YMCA Child Development Center. Child A stated that he did not really like going to school any more. He did not like CCSM 1 but did not know why he did not like her. Child A stated, "I don't feel safe at school." He does not know why he does not feel safe. He was questioned about getting in trouble at school and getting hurt. He reported that CCSM 1 pulled him "so fast" and that he turned After that, the was no but it and CCSM 1 gave him ice. Child A and Child B are in the same classroom with CCSM 1, CCSM 3, and a new staff person who's name she did not know. She stated that Child A has attended the center for the past two years and CCSM 1 has been his teacher the entire time. Recently, Child A was placed on a behavior plan due to an increase in what staff described as Child s Mother has not observed any of this behavior at ome. Child A told her that the teachers are nice and that they do fun things, but he does not like going to school because no one plays with him, and he does not have any friends. On 03/08/2023 Child A's Mother picked him up around 4:00PM. She knew about Child A's because she received a Brightwheel message earlier in *h dday ~ about it. We interviewed program director and licensee designee Ms. Galla "aaboouut the gations. She stated that she was present at the center but did not see what happened when Child A was injured. She spoke with CCSM 1 about it and was 1 aware that it was immediately reported to Child A's Mother in Brightwheel. CCSM 1 told Ms. Galla that the injury happened when she left the room with Child A because he was being disruptive. As they were walking back to the classroom, he walked followed up with her about it, and Child A has not been back in care since 03/08/2023. Child A is on a behavior plan due to recent CCSM 1 and CCSM 3 have been giving him more one on one attention"inte classroom and working with Child A's Mother by giving her tips and strategies to try at home. Ms. Galla thought that things have improved with Child A's behavior since implementing these strategies. Ms. Galla does not have any concerns about CCSM 1. She does not have any writeups, nor have there been any complaints from parents or other staff about her. During the onsite inspection on 03/14/2023, , and I discussed the allegations with CCSM 2. CCSM M2 statqe tthat she sionally works in the pre-k classroom with CCSM 1. She was not working in the re-k classroom on 03/08/2023 and did not know anything about Child A or being injured. On 03/08/2019, I received information that the bruise that was discovered on the evening of 03/06/2019. Child A had been at child care all day that day. The information that I received also indicated that when Child A's Mother questioned her about the bruise, Child A associated it with the center. 5 On 03/11/2019, I spoke with MDHHS Workers Ms. Brittany Follen and Ms. Kim Schaub. Ms. Schaub was investigating the bruise on Child A's leg and had spoken with Child A's Mother. Ms. Schaub stated that Child A's Mother did not indicate that a caregiver hurt Child A. Ms. Schaub showed me a picture of the bruising on the upper outside of Child A's right leg taken the previous week. There were three round greenish-brown bruises in a line just above Child A's right knee toward the outer side of her leg and one round greenish-brown bruise above the three bruises toward the center of the front of her thigh. Ms. Follen and I conducted an on-site investigation at the center and met with Program Director, Ms. Shannon Galla. Ms. Follen read the allegation to Ms. Galla and Ms. Galla explained that she knew about the bruising on Child A's leg and she had seen it the previous week. Ms. Galla explained that she became aware of the bruises when Caregiver, Ms. Mindy Winslow, Child A's Mother, and Child A came to her office on Thursday, 03/07/2019 shortly after Child A's Mother had come to pick up Child A from the center. At that time, Lead Caregiver, Ms. Mindy Winslow had asked Child A's Mother to speak with Ms. Galla and tell her about the bruising. Ms. Galla stated that Child A's Mother had said that she did not know what caused the bruises and Child A had told her grandmother that Child B (female,4 years), a child who attends the center, had caused the bruises. Ms. Galla described the bruises to Ms. Follen and me as looking like "somebody squeezed her leg" and indicated that the bruises may have looked like four finger tips and were turning brownish in color when she saw them. We continued to discuss the bruises and Ms. Galla stated if the bruises were from a hand squeeze, it would have been an adult hand because of the size and spacing of the bruises. Ms. Galla indicated that she did not feel that the bruises could have come from a child's hand squeezing Child A's leg. Ms. Galla also explained that there have been ongoing issues and communication with Child A's Mother regarding Child A's Mother not wanting Child A to sleep at the center and there has been tension as a result. Ms. Galla explained that Child A's Mother requested that the center not allow Child A to take nap while she is at the center because Child A's Mother believes this causes problems for Child A's sleep schedule at home. Ms. Galla explained that she has had multiple conversations with Child A's Mother that indicate that the center will allow Child A to sleep if she is tired and she (Child A) will be offered a rest as that is what is required to be in compliance with child care licensing rules. Ms. Galla continued to explain that Child A's Mother had furnished the center with a doctor's note which asked the center to abide by Child A's Mother's wishes regarding sleep and Child A's Mother was very frustrated that Child A would be allowed to sleep at the center if she was tired even after a note was provided. Ms. Galla explained that this situation had caused tension and upset with Child A's Mother and there has been conflict over this issue. However, Child A remained enrolled at the center and was expected to continue to attend. Ms. Follen and I spoke with Lead Caregiver, Ms. Mindy Winslow. Ms. Winslow expressed that she was confident that Child A did not receive the bruises at the center. She stated that she knew this because Child A very seldom plays with Child A B and if Child A had received the bruises at the center, Ms. Winslow would have known because Child A would have cried or come to her and told her she was hurt and that had not happened.
