    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On March 30, 2023, I made an unannounced visit to the center to interview center staff and to observe the child in the allegation (Child A). I interviewed licensee designees Anna Fryer and Molly Porter. Child A was not attending the center the day I made the unannounced visit. Ms. Fryer stated the child was not at the center because it was spring break and he was 2 staying home that week. Ms. Fryer said about a month prior to my onsite visit, two parents talked with Ms. Fryer about their concerns for Child A's aggressive behavior to other children in the classroom. A support staff member was hired to provide 1:1 services to Child A to prevent injuries to other children. When the support staff member cannot be at the center, Child A does not attend. The support staff member had been working with Child A for about two weeks. I reviewed the list of incident reports for the past month. The incidents involving Child A had decreased after the support staff member started working with Child A. Child care staff member (CCSM) 1 stated since Child A has been with the support staff member, the classroom management has gotten much better. When Child A starts to escalate, the support staff member can remove him from the classroom and distract him with other activities where he's not over stimulated. Child A's aggressive behavior incidents have greatly reduced since he began receiving 1:1 services. I also interviewed CCSM 2 who said having a support staff person for Child A has helped; the child care staff members can continue teaching and the support staff member can focus on Child A. On April 19, 2023, I made an unannounced onsite visit to the center to observe Child A in his classroom with his support staff member. Ms. Fryer said Child A never returned to the center after spring break. Child A has been unenrolled from the center.

    On 06/02/2021, I conducted an unannounced onsite inspection at Teddy Bear Daycare and Preschool 14th St. I interviewed program director and licensee designee Ms. Anna Fryer regarding the allegations. She stated that the incident with Child A being left unsupervised happened when she and other center management staff members had left for the day on 05/28/2021. Ms. Chloe Boudjalis was in charge during that time. Recently, another incident of a child being left unattended prompted Ms. Fryer to hold an active supervision training with all of the child care staff. The training included implementing a system where staff are expected to conduct name-to-face checks regularly throughout the day, but 2 especially when staff and children transition from indoor to outdoor play and back again. On 05/28/2021, Ms. Warren was responsible for the Maples classroom, which included children from two to three years of age. After learning of the incident, Ms. Fryer dismissed Ms. Warren from her position at the center. On 06/02/2021, I conducted an interview with child care staff member Ms. Chloe Boudjalis regarding the allegation. She stated that Child A was left alone in the classroom on 05/28/2021 when the Oaks and Maples classrooms were combining after naptime. It was a confusing time because some staff were combining and switching rooms, while others were leaving for the day. Ms. Boudjalis was in the Pines classroom with child care staff member Ms. Natalie Rahe. She saw Ms. Warren walk out the door to the playground with a group of six children from the Maples classroom. A few minutes later Ms. Rahe went back to get her water bottle from the Maples classroom. She called out to Ms. Boudjalis and asked if Child A was supposed to be in the Maples room by himself. Ms. Boudjalis estimated that about two or three minutes had passed between Ms. Warren leaving the Maples classroom and Ms. Rahe finding Child A unattended. During the 06/02/2021 onsite investigation, child care staff member Ms. Rahe stated that in order to ensure proper staff member to child ratios, she was switched from the Maples to the Pines, then to the Oaks classroom on the afternoon of 05/28/2021. Just before moving to the Oaks room, she saw Ms. Warren go out the Maples classroom door. About two to three minutes later, she realized that she left her water bottle in the Maples room, so she went back to get it. When she entered the Maples room, she saw Child A sitting at the snack table by himself. She took Child A outside to Ms. Warren and told her that he had been left behind. On 06/02/2021, Ms. Kailey Groleau stated that on the afternoon of 05/28/2021, she was in the Pines classroom with Ms. Rahe. Staff were switching rooms to maintain staff to child ratios and it was somewhat chaotic that afternoon. The Oaks room and the Maples room combined; they went outside at the same time as the Pines room. Ms. Groleau asked Ms. Warren if she counted her children and questioned if she was missing one. Ms. Warren told her that she did a headcount and everyone was accounted for. Shortly after that, Ms. Rahe went back to the Maples room for her water bottle and came back outside with Child A. On 06/02/2021, Ms. Megan Clark stated that she was working in the Oaks room on the afternoon of 05/28/2021 when they combined with Ms. Warren's Maples room on the playground. They had only been outside minute or two when Ms. Rahe brought Child A out to the group. On 06/04/2021, I conducted a telephone interview with Ms. Aiden Warren regarding the allegation. She stated that on the afternoon of 05/28/2021 she was in the Maples room by herself with six children, but it felt like more than six. Most of the class had finished snack when one of the children opened the door and ran outside. The majority of the class ran out the door too and Ms. Warren "freaked out." She 3 chased the children outside and began talking to them about how it was unsafe to leave the classroom without an adult. She spent about two minu
