Based on the investigation, there is a lack of evidence to support the allegation that child care staff members failed to provide appropriate care and supervision of children at all times when Child A sustained a fractured tibia on 11/4/2024. CCSM 1 was present and immediately responded when Child A began crying. She did not see or hear anything to indicate that Child A fell, and no other children were nearby. Child A was not able to tell any adults how or where she was injured. CCSMs notified Child A’s Mother about her crying and inability to bear weight on her leg as soon as they realized there was a problem. Information obtained from Cleveland Clinic regarding tibia fractures like Child A’s indicate that they can happen from twisting while a foot is planted on the floor or falling and landing awkwardly.
