Staff provided appropriate care and supervision of Child A and Child F on the playground. Teacher 1 was in close proximity to both children, and the situation was handled appropriately.

On 01/24/2022, 1 conducted an onsite inspection to discuss the allegations with licensee designee Ms. Brigid Wilson, program director Ms. Kathie Kogge, and child care staff members (CCSMs). Ms. Wilson stated Child A has attended the center for about two years. Recently, staff members in Child A's classroom observed changes in Child A's behavior that included an increase in physical aggression. He mostly directed his aggression toward staff members, but there were a few instances where other children in the classroom were involved. Supports have put in place as much as possible, but the center is short-staffed and management is not able to provide one-on-one supervision of Child A throughout the entire day. The center has a "no disenrollment" policy, so they are doing everything within their power to keep staff and other children safe. For example, an education specialist from the intermediate school district was present at the center today to evaluate the situation. During onsite inspections on 01/24/2022, and 02/22/2022, I conducted interviews with CCSM 1, CCSM 2, and CCSM 3. CCSM 1 stated that s/he had seen an increase in violent behavior from Child A such as spitting and hitting. S/he recalled only one or two incidents that happened between Child A and Child B. On 01/18/2022, Child A and Child B were next to each other in line when Child A turned around and started punching Child B in the stomach. On 01/20/2022, Child B reported that another student punched her. CCSM 1 did not witness that incident directly and Child B did not specifically name Child A as the one who hit her. There was no way to know that an altercation was about to happen because Child A's behavior was random and unpredictable. Sometimes staff can prevent him from using physical aggression toward other children, but other times it happens so quickly and without warning that they cannot. Children were occasionally the target of Child A's physical aggression, but it seemed to be happening more often with staff. On 01/20/2022 Child A kicked CCSM 1 in the shins, punched CCSM 1 in the hip and in the thigh, and spit at him/her. Multiple instances occurred each day where Child A engaged in physical aggression toward CCSM 1 and other staff members. CCSM 1 believes that Child A needs on-on-one attention, but there are not enough staff to have someone shadow him all day. S/he brought this up to center management but was told that it was not possible due to staffing shortages. On 01/24/2022, CCSM 2 stated that s/he had concerns about Child A's behavior because he was too unpredictable. When he did not get the attention that he wanted when he wanted it, he would engage in destructive actions or pick on another child. S/he did not recall any specific incidents between Child A and Child B. However, all 3 of the children in the classroom often told Child A to leave them alone. They also told their parents that Child A was mean and hurtful. CCSM 2 knew Child A's triggers, but s/he could not have prevented him from acting out physically because he was so unpredictable. CCSM 2 believes that s/he could provide appropriate care and supervision of children most of the time when Child A was present. S/he thought the only real solution to making sure everyone was safe would be to have someone available to Child A for one-on-one attention. On 01/24/2022, CCSM 3 stated that Child A's behavior was predictable from the standpoint of that when he does not get attention, he acts out. There was no way for CCSM 3 to know when Child A would decide to hit someone. S/he was present when Child A punched Child B in the stomach while lining up. Child B stepped away from Child A in line, and that was when Child A punched her. CCSM 3 thought there were at least two other altercations between Child A and Child B, but s/he was unable to recall the specifics.
