I conducted a telephone interview with the Complainant on 05/01/2023. She stated that the bathroom is in the hallway and the children are allowed to walk to the bathroom by themselves. She said this is a regular routine for the children. I conducted an unannounced onsite inspection with Child Care Licensing Consultant Tanara Abner on 05/02/2023. I interviewed the licensee designee, Michelle Nieman. Ms. Nieman said that generally a child care staff member (CCSM) is in the hallway if a child has to use the bathroom but sometimes the CCSM may stand at the doorway and watch them walk to the bathroom. Ms. Nieman said that sometimes a child may leave the classroom and start walking to the bathroom by themselves before the CCSM in the classroom yells out to the other classrooms that they have a child walking to use the bathroom. When the CCSM yells out that they have a child walking to the bathroom, a CCSM from another classroom goes to the doorway or to the bathroom. Ms. Nieman said that she is usually available to be in the hallway with them or another CCSM who is a floater. I interviewed CCSM 1, lead caregiver in the early preschool classroom. CCSM 1 has been employed with the center for approximately 2 years. CCSM 1 said that she 1/2 has children ages 2 to 3 years old in her classroom so when a child has to use the 1/2 bathroom, a CCSM goes with them. A CCSM walks them to the bathroom and goes in the bathroom but not in the stall unless they need help when toileting. I interviewed CCSM 2, floater and child care assistant. CCSM 2 has been employed with the center since September 2022. CCSM 2 stated that the classroom tries to use the bathroom before transitions such as before and after eating. Usually, a CCSM stands at the bathrooms and monitors the children. If a child has to go to the bathroom when they are in the classroom, a CCSM walks down to the bathroom with them if they can. If the CCSM can't leave the classroom, then they stand at the doorway and watch the child walk to the bathroom. I interviewed CCSM 3, lead caregiver in the blended GSRP classroom. CCSM 3 has been employed at the center for at least six years. CCSM 3 said that if there are two CCSMs in the classroom and a child has to use the bathroom, one of the CCSMs walks down to the bathroom with the child. If there is only one CCSM in the classroom, then the child can step into the hallway and walk to the bathroom. CCSM 3 said that he may stand in the doorway to monitor the child walking to the bathroom if possible. For the most part, there is always a CCSM in the hallway to monitor the children walking to the bathroom. I interviewed CCSM 4, assistant teacher in the GSRP classroom, who has been employed with the center for 1 years. CCSM 4 said that the procedure for their 1/2 3 classroom is that everyone uses the bathroom when they transition to snack or outside. The CCSMs walk down to the bathroom with them and wait in the hallway or by the lockers. If someone has to use the bathroom and there is only one CCSM in the classroom, then the CCSM yells down to the other classrooms to see if a CCSM from another classroom can monitor the child walking to the bathroom. I interviewed Program Director, Diana Binkley. Ms. Binkley has been the director and lead caregiver in the GSRP classroom for 13 years. Ms. Binkley said that the children are allowed to start walking to the bathroom by themselves and the CCSM will "catch up" with them. Ms. Binkley said there are extra CCSMs that the classroom can call to help monitor the children walking to the bathroom.

I interviewed the Complainant on 05/01/2023. The Complainant provided a 12-page document describing various incidents when Ms. Binkley yelled at and threatened the children during a 4-month period. The Complainant said that the yelling is taking place in front of the children. The Complainant described an incident when Child D was standing on top of the toilet refusing to listen, so CCSM 2 took Child D down to Ms. Binkley's classroom. The Complainant said that once they got to Ms. Binkley's classroom, Ms. Binkley told Child D that he had two choices: he can put the pull up on himself or she would put it on him in front of everyone. Ms. Neiman stated that the discipline policy at the center is when there is a conflict CCSMs work through conflict resolution, acknowledge the child's feelings, and teach them how to sort through the conflict. CCSMs talk to the children about how they could have done things differently. Ms. Neiman stated that there are some children with IEP's who respond differently and CCSMs may need to use a louder voice than 4 with the other children. If a child is not behaving, CCSMs give the child a warning that they will be removed from the center they are playing in and will have them make a choice at a different center or CCSMs will make a choice for them at a different center. If a child is trying to leave the classroom, building or play area or it's a safety issue, the child may need to be held using a CPI hold but that doesn't happen very often. When I asked Ms. Neiman about Ms. Binkley's interactions with children, she said that the children look at her as the principal of the school and that all of the children love her. Ms. Binkley is the "discipline person" meaning she tells the children, "This is how we do it." There isn't a child who doesn't go to her and love her. If Ms. Binkley says to do something, the children do it. If a child is giving another child a hard time, Ms. Binkley can just say, "Are we doing what we are supposed to be doing?" If one of the children in her classroom is yelling, Ms. Binkley may ask them to sit in the cube which is a quiet space for a few minutes to cool down. Ms. Binkley's voice is loud in general. Anytime she raises her voice at all it may sound like yelling. At times children may do something dangerous such as throw things and Ms. Binkley may yell their name loudly because she wants them to be safe. CCSM 1 said that the discipline policy in the center is that they give the child the option to make a different choice. CCSM 1 doesn't usually have to discipline the children in her classroom. If they are not doing what she needs them to do, then she asks the children to make a different choice. CCSM 1 has not heard any other CCSMs in the center using inappropriate discipline, yelling, or threatening children. The children they have this year are very "mellow" and they can talk to them and make them think about what they can do differently. CCSM 2 said that if a child is getting upset or angry, CCSMs ask them to make a different choice. There is a calm down area in each classroom. Sometimes the child may have to move to a different center in the classroom. When asked about the incident on 03/01/2023 with Child D standing on the trash can and then being brought down to Ms. Binkley's classroom, CCSM 2 said there was no such incident and she never brought Child D down to Ms. Binkley's classroom. CCSM 2 has never heard any CCSMs yell or threaten children. CCSM 3 stated that the discipline policy is that they always use their words. If a child is acting out or not using kind words, the CCSMs remind them to use kind words. If two children are fighting, the CCSMs would separate them, put themselves between the children, and then problem solve with the children. If the conflict continues, the children would be separated, and they would have to make a new choice. CCSM 3 has not heard any CCSMs yell unless there is a dangerous situation, and they are trying to get the child's atte

I interviewed the Complainant on 05/01/2023. The Complainant said that the center breaks ratio quite often, specifically in the previous two weeks from April 17, 2023, through April 28, 2023. On the day of the onsite inspection, the Preschool 1 classroom (2.5 to 3 years) had nine children and two child care staff members, the Pre-K/GSRP classroom (3-4 years) had 11 children and 2 child care staff members, and the GSRP classroom (4- 5 years) had 16 children and 2 child care staff members. I interviewed Ms. Nieman, Ms. Binkley, CCSM 1, CCSM 2, CCSM 3, CCSM 4 and CCSM 5 who all confirmed that they maintain a ratio of 1 child care staff member to 10 children in the Preschool 1 classroom, a ratio of 1 child care staff member to 12 children in the blended Pre- K/GSRP classroom, and a ratio of 1 c to 12 children in the GSRP classroom. I 7 received copies of the child attendance records and child care staff member attendance records for the weeks of April 17, 2023 and April 24, 2023. During the weeks of April 17, 2023 and April 24, 2023, there was a ratio of 1 child care staff member to 10 children for the Preschool 1 classroom, 1 child care staff member to 12 children for the Pre-K/GSRP classroom, and 1 child care staff member to 12 children in the GSRP classroom for both weeks. On 10/12/22, 1 reviewed the complaint for additional information. On 10/1 spoke wim me compiainanr to gain runner information regaramg e complaint. The complainant informed that they did not know the name of the child involved in the incident or what RAFRare staff member was involved as they only heard the commotion thorough the vents while using the bathroom. On 10/14/22, and I conducted an unannounced onsite inspection at the center. The center was closed for the day due to the child care staff members having a professional development training. and I arranged to have Ms. Michelle Nieman, licensee designee, come to the center to meet with us. and I informed Ms. Nieman of the allegation. Ms. Nieman denied any child staff member yelling or hitting any child care children as the center does not condone either and any form of physical discipline is prohibited. Ms. Nieman said although the allegation is vague, she knew exactly what incident the complainant was referencing. According to Ms. Nieman, on 10111122, just before dismissal around 4:00 p.m., one of the child care staff members, , brought Child A into the center from outdoor olav to use the bathroom. Ms. Nieman further explained that Child A has an that has a specific plan to Child A has and has been defiant and refusing to s Nieman said was in the hallway assisting another child care child wile Child A was in the bathroom. Ms. Diana Binkley, child care staff member was called to assist with Child A. Ms. Nieman explained to and 1, that Ms. 3 Nieman has a loud assertive tone to her voice when she is directing children. Ms. Binkley confirmed Ms. Binkley telling Child A that you do not tell your teachers no. Ms. Nieman explained that while Child A was in the bathroom by himself, and Ms. Binkley were standing in the doorway/hallway of the bathroom. Child A was being defiant about using the bathroom and kept saying no, he did not want to sit on the toilet. This was when Ms. Binkley told Child A that we don't tell our teachers no. Within a short time after that incident, the pastor from the church located on the upper level of the center came to their door asking what the commotion was. Ms. Nieman informed the pastor that everything was fine and explained that a couple of children were having a rough day. Ms. Nieman said the vents for the church bathroom are located just above the boy's bathroom in the center therefore sound travels and echoes throughout the church building. Ms. Nieman explained too " and I that throughout their 12 years of operation at the center there have been Mulple conflicts with the pastor, mostly regarding his boundaries with the child care. Ms. Nieman further explained that the child care is rented space located in the basement area of the church building and she has had to explain to the pastor on numerous occasions that he cannot intrude into their area and breach the security of the child care center. Ms. Nieman said they keep all the door locked during operation hours and the pastor would come downstairs and leave doors unlocked breaching their security protocol. Regarding Child A Ms. Nieman said that Child A has never required any physical intervention by child care staff member as he can be easily redirected through talking. Regarding the slapping sound, Ms. Nieman said she and Ms. Binkley both clap their hands in an attempt to motivate children. Ms. Nieman provided and I with contact information for Child A's parents and the child care staff members. On 10114122, and I contacted Child A's Mother via telephone. Child A's Mother informed and I that Child A was visiting at his grandparents' home located in Toledo, Ohio. She provided and I with the contact information _ for Child A's grandparents. On 10114.22, and I interviewed Child A's Mother at her mother's home. We informed herof the allegation. Child A's Mother said Child A only recently began care at the center as she was referred to the center by due to Child A having some behavioral issues Chi

On 10/11/22, the smacking sound heard was not from a child care staff member striking a child but rather from a child care staff member clapping their hands together to encourage a child to hurry up. Safe physical intervention is used rarely, safely, and only used if a child is in danger of hurting themselves or others. Ms. Brinkley stated that she is trained in how to provide safe physical intervention with children. She stressed that she used an approved and safe physical intervention hold with Child A as a last resort. As she is certified in crisis intervention, the other child care staff members know to seek out her assistance, even if she is not working directly in the room. Ms. Brinkley showed a training card from the Crisis Prevention Institute indicating that she has completed the Nonviolent Crisis Intervention Refresher program. The certific
