Child A was sleeping on the Boppy pillow on the floor for approximately 5-10 minutes and Child B was sleeping on the Boppy pillow on the floor for approximately five minutes before the parent came into the classroom and pointed the unsafe environment out to CCSM 1. At that time, she turned both children over and placed them on their backs on the Boppy pillows to continue sleeping. CCSM 1 did not move the children to the crib at that time; the total time Child A and Child B were sleeping on the floor on Boppy pillows is unknown. ..........

On June 11, 2021, I interviewed the Complainant. The Complainant stated it is believed Stephen Maher has completed the proper documentation to be a child care staff member, but the Complainant does not believe he has the proper documentation. Mr. Maher has been working since February of 2021. Pauline Schieb the program director put out a document of all employees missing information. The Complainant is unsure if he had completed his background check or not. On June 22, 2021, I completed an on-site inspection. I interviewed Sarah Kaiser, lead caregiver in the infant classroom. Ms. Kaiser stated she is not aware of any child care staff members that are working or have been allowed to work without their required background check and notification of eligibility. On June 22, 2021, I interviewed Paula Sprague, child care staff member in the infant classroom. Ms. Sprague stated she is unaware of anyone working in the classroom without having their background check and notification of eligibility. On June 22, 2021, I interviewed Kelly Bohland, lead caregiver in the toddler 1 classroom. Ms. Bohland stated she is unaware of anyone working without their required background check and notification of eligibility. On June 22, 2021, I interviewed Sarah Amrose, lead caregiver in the preschool 1 classroom. Ms. Amrose stated Ms. Schieb and/or Ms. Maher does let the child care staff members know if someone has not had their background check/eligibility notification and lets the child care staff members know they cannot be alone with children and then they are never left alone with children. On June 22, 2021, I interviewed Brooke McClellan, child care staff member in the preschool 2 classroom. Ms. McClellan stated she has no knowledge of anyone working unsupervised before they are allowed to. On June 22, 2021, I interviewed Briahna Todoroff, child care staff member in the preschool 1 classroom. Ms. Todoroff stated she is not aware of anyone being allowed to work before they are able to. If someone cannot be left unsupervised due to background check not being back, Ms. Schieb and/or Ms. Maher makes child care staff members aware of it and they know not to leave the staff alone. On June 22, 2021, I interviewed Megan Pedelose, child care staff member. Ms. Pedelose stated she is not aware of child care staff members being allowed to work unsupervised before they are approved to. Staff are allowed to ask if a child care staff member has the clearance to be alone with children and most of them know if someone does not have their clearance to be alone with children. On July 29, 2021, I interviewed Ms. Pedelose and she stated when she spoke with me on June 22, 2021, there was one day prior to that day that she worked alone with children, but she does not remember the date. She stated once she became eligible, which was shortly after she saw me on the 22nd of July, she received notice from Ms. Schieb and/or Ms. Maher that her background check was back; she was cleared to work alone with children. On June 22, 2021, I interviewed Riley Moody, child care staff member in the toddler 1 classroom. Ms. Moody stated there is one person that she knows of working alone with children without her approved background check and that is Megan Pedelose. She does not have her background check and has been left alone with children in the classrooms. She knows this because Ms. Pedelose has said to her, "I do not have my background check and I should not be working alone." Bethany Bryan, child care staff member, was left alone before her background check was approved. She knows this because Ms. Bryan was really upset about it and told her about it. Those are the only two current child care staff members she knows of that have been left alone when they should have been supervised. On June 11, 2021, I interviewed the Complainant. The Complainant stated Stephen Maher is working as a child care staff member who floats where he is needed, and recently he was alone in the infant classroom with seven infants. This occurred at the end of the day near closing and the extra children left quickly. It has happened other times that the center classrooms are out of ratio, the Complainant is not sure on exact dates but knows it happens "pretty frequently." Ms. Schieb and/or Ms. Maher have had to close the center "pretty frequently" as there is not enough child care staff members. On June 22, 2021, I completed an on-site inspection. All of the classrooms were checked for ratio. No concerns were noted. I interviewed Pauline Schieb, program director for the past 13 years. Ms. Schieb stated at opening there are two child care staff members that begin at 6:30 a.m., a third that comes in at 6:45 a.m., and a fourth that arrives at 7:00 a.m. Staff continue to arrive in intervals until they are fully staffed between 8:30 a.m. and 9:00 a.m. As the children and staff arrive, the classrooms are opened, and children and child care staff members are moved to their respective classrooms. At opening all children are combined regardless of age. They do not document when children move to their respective classrooms or which staff if any leave the opening classroom when an additional classroom is opened. The parents 10 are under contracts for specific start times, and they adhere to those times as closely as possible, but they do try to be flexible if they can. Ms. Schieb stated she is not aware of the opening classrooms being out of ratio. Ms. Schieb stated she is not aware of ratio being a concern. I recommended Ms. Schieb they begin having each classroom do a paper copy of the opening, closing, and each classroom to note what children are present and what time children leave those classrooms. This should be done with staff as well. This would give proper documentation of how many children are in the classrooms and how many child care staff members. I interviewed Sarah Kaiser, lead caregiver in the infant classroom. The ratio for infants and toddlers is 1:4. She stated her classroom has never had an issue being out of ratio, and she has not heard of any other classrooms being out of ratio. When she goes on break someone always relieves her; there are12 infants and three child care staff members in the classroom or one child care staff member for every four infants in the event there are fewer than 12 children. She knows sometimes when she arrives someone is working in her classroom. Today for example, when she arrived Pauline Schieb and Meghan Bomia were in the classroom with five children. On June 22, 2201, I interviewed Katie Roark, child care staff member in the infant classroom and she also works as a floater. The ratio for infants and toddlers is 1:4. She stated the ratio in the infant classroom is one child care staff member to every four infants. She is not aware of the infant classroom or any classroom ever being out of ratio. She has opened a few times, and now she is the third person arriving at 6:45 a.m. At one point there were a lot of infants being born at the beginning of June 2021. At that time four infants started at the same time and there were a few random days when two infants came earlier than they were scheduled. She does not believe the classroom was ever out of ratio, but at that time she did not come in until 9:30 a.m. She is not sure of the date in June 2021, but there was one day that she came in at 7:30 a.m. and she was told that there were four infants at 6:30 a.m. in the morning. That is when Ms. Schieb and/or Ms. Maher switched the schedule so that more people started earlier. Prior to that there was just two child care staff members opening and then Ms. Schieb and/or Ms. Maher added the 6:45 a.m. position. When asked if there was ever a time when Mr. Maher was alone with six infants, Ms. Roark reported
