On 12/02/2022, I conducted a telephone interview with the complainant. The complainant provided the same information stated in the allegations. On 12/02/2022, I interviewed Child A's Mother regarding the allegations. She stated that Child A's teacher is Lee McKenzie. Ms. McKenzie treats Child A differently from 2 the other children and takes her frustration out on Child A. Child A is a whiner and that is a problem for Ms. McKenzie. Child A told Child A's Mother that Ms. McKenzie took him to the basement of the school. Child A was screaming in Child A's Mother's face, and she asked him why he was doing that. Child A stated that the teacher does that to him. Child A has been sent home five or more times for different reasons (i.e., whining, head lice, coughing, etc.). According to Child A's Mother, there is no reason for Child A to be sent home as there is nothing wrong with Child A. Child A's Mother stated that Ms. McKenzie uses the remind application to complain about Child A and that she does not call the home. I asked Child A's Mother to provide me with verification of the communication between herself and Ms. McKenzie. She stated that she did not see the communication when she went on the remind application and could not send me verification. On 12/06/2022, I completed an unannounced inspection at Johnson Early Childhood Center. I spoke to program director, Ms. McKenzie, CCSMs Stella Kircos, Tonya Neilson, and Damain Trump regarding the allegation. I observed preschool classroom 15. There were three CCSMs present with 12 children, ages 4 to 5 years. According to Ms. McKenzie, she is the program director and principal at Johnson Early Childhood Center. Ms. McKenzie stated that Child A is in Ms. Kircos's class. Ms. McKenzie has never been alone with Child A. She stated that the school does not have a basement and she does not yell at the children. According to Ms. McKenzie, Child A has been sent home twice. Child A was sent home in September, and last Wednesday, 11/30/2022 due to Child A having head lice. Child A was brought to the office by Ms. Kircos. The school secretary and the nurse checked Child A for head lice. Child A's Father was contacted as they have no contact information for Child A's Mother. Child A is dropped off and picked up from school by Child A's Father. Child A was treated for head lice on Thursday, and he returned to school the following Monday. Child A's Father apologized for the text messages that were received from Child A's Mother. He asked them not to respond to Child A's Mother. Child A has not been sent home for whining or for coughing. According to Ms. Kircos, Child A is enrolled in her class. Child A has not displayed any major behavior concerns. At times he has emotional outbursts and language delay. They have been working with Child A, teaching him techniques to calm himself down when he has temper tantrums. Ms. Kircos stated that Child A went home early last week, Wednesday. Child A got up from his nap and began to scratch intensely. He was pointing at his head and Ms. Kircos put on gloves to check his head. There were nits on his scalp. Ms. Kircos attempted to contact Child A's Mother and Father by phone, but no one answered. She sent a message to the parents to inform them of the head lice on the remind application. Child A's Father replied to the message and stated that he was on his way to the school. Ms. Kircos stated that Child A has never been taken to the basement, as the school does not have a basement. Ms. Kircos denied screaming at the children and stated that she speaks to the children appropriately. She uses conflict resolution techniques with the children. They bring the children together and have them come up with a solution if 3 there is an issue. Ms. Kircos stated that she has not had any contact with Child A's Mother. She has only spoken to Child A's Father during drop off and pick up. Ms. Kircos stated that she does not call to complain about children's behavior. Ms. Kircos
