On March 10, 2023, I conducted a telephone interview with Child A's Father. He said Child A has attended Fischer Head Start for a year and he considered it a good program until now. He said he picked Child A up yesterday from child care and Child A said back was hurting during the ride home. She said, CCSM 1 put her knee in her back. After Child A disclosed what happened, school director Monica Bancroft called and told him that CCSM 1 restrained Child A to the nd today for misbehaving. After speaking to the director, he took Child A to ■ for an evaluation. An x-ray of Child A's back was taken and was n Motrin for pain. On March 21, 2023, Fischer Head Start Program Director, Monica Bancroft ofacilittattedd a Zoom meeting with me and to view the video footage. Fisher ead start oom 106 video footage was reviewed. The footage was dated for March 9, 2023, which is the date in question of the alleged incident. Witness 1, CCSM 1 and CCSM 2 were in the classroom with the children. CCSM 2 was interacting with a separate group of children then CCSM 1. Child A was observed with several other children holding a pink bag and it appeared as though CCSM 1 was talking to her. CCSM 1 picked up Child A and placed her on her lap. Child A was observed moving her legs and hands and CCSM 1 put Child A on her lap and wrapped her legs around Child A. After approximately two minutes Child A was released. CCSM 1 was never observed putting her knee in Child A's back. Notably, the audio was very bad, and I could not hear what was being said to Child A or anyone else in the video. On March 21 2023, Child A's medical records were received Child A's medical records were reviewed from "an in ild A was treated on March 9, 2023, for back fpraoW TrheeWcors indicated Child A underwent an X-ray and there was no evidence of an acute rib 3 fracture or other acute process with the chest. Child A was and instructed to take the medicine as needed. On April 5, 2023, I conducted an unannounced site inspection at Fischer Head Start Program. Director Monica Bancroft was interviewed and said the incident happened as the complaint details. She did not witness the incident firsthand, but the information was reported to her by their Witness 1. Witness 1 told her that CCSM 1 was struggling with Child A' behavior and that she held her between her legs and put her in her lap. Witness 1 felt CCSM 1 crossed the line by constraining Child A between her legs and restraining her to a specific area in the classroom. Ms. Bancroft said CCSM 1 has been employed for 13 years and never had a complaint. She is currently the assistant teacher in classroom 106 and her actions were not aligned with Fischer's child management policy. CCSM 1 was placed on administrative leave for two days following the incident and suspended for one day without pay. CCSM 1 will also participate in child management training. Ms. Bancroft said CCSM 2 was in the classroom during the time of the incident and that Child A no longer attends the program. Ms. Bancroft gave me a copy of their behavior management policy. CCSM 1 was interviewed during the onsite and said she was working in classroom 106 and Child A snatched a toy from another child. The child was crying and wanted the toy back. She told Child A to give the toy back and Child A threw the toy across the room instead. After Child A threw the toy, she started acting out by hitting her and she repeatedly asked Child A to keep her hands to herself. Eventually, she stopped hitting her and went and took a make-up bag from another child. CCSM 1 said she told Child A to give the bag back and to come sit with her. She spoke with Child A about her behavior and Child A started kicking her and hitting her again. She also threw the remote she had in her hand and hit another child with it. She told Child A to sit in the safe area to calm down and she refused

On 10/06/2022, Child A's Mother witnessed child care staff member (CCSM) Lydia Coyne physically redirect Child A (3-year-old, male) in an inappropriate way.

On 09/19/2022, Child A (3-year-old, male) fell while running in the classroom and injured his left eye. Child A's Guardian is concerned about the lack of supervision. f Vi!A*11Le1GII[iih On 09/19/2022, the center director Monica Bancroft reported Child A's accident to the department. She believes the staff were providing appropriate supervision when the incident happened. On 09/21/2022, I interviewed Child A's Guardian. He is doing well and has returned to the facility but she is uncertain if he will remain. She is "wondering" if the accident could have been avoided and if children were being supervised. The facility immediately notified her about the incident. She went to the center and was "surprised' to see how big the bump was over his eye. Childcare staff members (CCSMs) told her Child A was running and fell. She transported him to Beaumont Hospital of Taylor and diagnosed with a facial contusion over the left eye. The bruise had no broken skin and the swelling ultimately went down. On 09/27/2022, I conducted an unannounced investigation at the center. I inspected the classroom where the accident happened and talked briefly with the CCSMs. The room was clean, organized and the children were being properly supervised. There are no blind spots to prevent direct supervision. On 10/06/2022, I interviewed the two CCSMs, Angela Reeves and Lydia Coyne, who were present during the accident. They stated Child A was repeatedly told not to run in the classroom and to use his "walking feet." He would stop running, start again, and ultimately tripped and hit his eye. Ms. Coyne was sitting on the opposite side of the classroom and turned to talk with another child. She heard someone fall and saw it was Child A. Ms. Reeves helped him up and checked for bruises. She saw the bump over his eye and applied an ice pack. After applying first aid, Ms. Reeves called Child A's Guardian and informed her of the accident and injury. Ms. Coyne and Ms. Reeves believe they always provide appropriate care and supervision. There were 14 preschoolers and two CCSMs present on the day of the incident. APPLICABLE RULE R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. There is no evidence to support inappropriate supervision was a ANALYSIS: factor in Child A falling and sustaining an injury. Child care staff discouraged him from running in the classroom, but he continued to do so and tripped. CONCLUSION: VIOLATION NOT ESTABLISHED IV. On 12/19/2022, I conducted an unannounced inspection at the center. I interviewed program director, Monica Bancroft. She stated that child care staff members, Alyson Smithson and Shannon Lee were placed on paid leave while conducting in-house interviews. CCSM, Mara Johnson found Child A (3-year-old, male) in the hallway and notified Ms. Bancroft. Child A's classroom left the gym, and he was in the group with Ms. Smithson behind Ms. lee. There was a gap between the two groups of children. Ms. Lee entered the classroom first and Ms. Smithson entered after. Both groups were sitting at the table for small group when Ms. Johnson brought Child A to the room. They were not aware Child A was missing. Ms. Lee thought Child A was with Ms. Smithson and Ms. Smithson thought Child A was behind her. According to the video footage, Child A entered the staff lounge and the sick room where there are toys. He peeked his head out and eventually entered the welcome area. During my inspection, I interviewed Ms. Johnson. The day of the incident she was sitting at her desk and heard a teacher in the gym yell for assistance to clean something in the gym. Child A was left in the welcome area. She asked if Child A belonged to her class, and he responded "no". Child A was calm when she found him. Ms. Johnson walked Child A to his classroom and informed Ms. Bancroft. reviewed the video footage and observed the location where Child A was found by Ms. Johnson. The welcome area is located between the front door and the gym. At 8:37a.m., Child A walked down the hall and entered the staff lounge. At 8:38 a.m., he stuck his head out the door. A few seconds later, Child A ran across the hall to the sick room. At 8:41 a.m., Child A walked into the hallway back to the welcome area where he was found. On 12/29/2022, I interviewed Child A's Mother. She was made aware of the incident and received an email from Ms. Smithson that she resigned. She has no concerns regarding the incident and feels that the situation was handled to the best of the staff's ability. On 12/29/2022, I interviewed Ms. Smithson. She stated it was 11 children between her and Ms. Lee. She was at the back of the line with her group of children. Child A was having a tantrum and she was trying to keep him from hitting his head. She was not sure why Ms. Lee left her and was so far ahead of her. Another child in her group was trying to play with toys in the hallway. Ms. Smithson was trying to get all the children back to the classroom so she could start small group. Once in the room with the children, Ms. Johnson brought Child A to the room after finding him in the hallway. 3 On 12/29/2022 and 1/23/2023, I attempted to interview Ms. Lee. Her phone is not set up to leave voicemail messages. I have not received a return call.

On 10/06/2022, an onsite investigation was conducted, and a copy of any classroom video was requested to aid in the investigation. Program director Ms. Monica Bancroft states Child A's Mother witnessed Ms. Lydia Coyne aggressively grab Child A (3-year-old, male) by the arm. There were no signs of injury. The facility does not allow any form of physical discipline and immediately conducted an internal investigation. After interviewing staff and reviewing classroom video, the facility did not find any evidence to substantiate the allegation. On 10/12/2022, I interviewed Child A's Mother. The day of the incident at approximately 02:00 p.m., she arrived to pick up Child A during dismissal. As she entered the room, Child A was collecting his personal items and walked toward her. He apparently "forgot something" and turned to walk toward another part of the room to retrieve it. Ms. Coyne immediately grabbed his right arm in a "forceful way" and told him not to go in the area. According to Child A's Mother, children were getting up from nap and she assumed Ms. Coyne did not want him disturbing them. She understands the other children should not be disturbed, but the "grabbing" of Child A made her uncomfortable and she felt it was inappropriate and a better method of redirection could have been used. She immediately reported the incident. On 10/19/2022, I interviewed CCSMs Lydia Coyne and Angela Reeves. Ms. Coyne denied the allegation. She has never aggressively grabbed Child A, or any child, and does not know why the allegation was made. She recalls Child A's Mother coming to pick him up and Child A was walking toward another area of the classroom. She does not recall why he started to go in another direction, but admits to saying something like "No, it's time to go" but she never touched him. Ms. Coyne told them to have a good weekend as they exited the classroom and was surprised to hear about the allegation later. Ms. Reeves was present during the incident. She was interacting with other children and turned toward Ms. Coyne when she heard her talking to Child A. Ms. Reeves did not see or hear anything inappropriate. She has never witnessed Ms. Coyne be inappropriate toward any child and is uncertain why the allegation was made. On 10/20/2022, I requested and received a copy of the classroom video. I observed Child A's Mother enter the room with a child's coat and other items in her hand. Ms. Coyne was standing close to the door. Ms. Reeves was on the opposite end of the classroom assisting other children. Child A saw his mother and walked toward her. He then stopped and turned to go in another direction. Although the video has audio, I was unable to determine if anything was said to make him change his course. I could hear Ms. Coyne say, "We'll take care of it. Go. This is quiet time." Child A turned around and begin walking toward his mother. They left the room 3 and Ms. Coyne can be heard telling them to have a good weekend. The video did not have any incidents of her grabbing or touching Child A in any way.
