I interviewed the complainant via telephone on 10/11/2021. There is one child at the center who is high strung. At nap time the staff hold the child tight in a cradle position while sitting on the floor. Last week Thursday there was a child with a fever. On Friday the child had diarrhea and was not sent home. On 10/11/2021 I completed an onsite inspection and interviewed child care staff members. I interviewed Ms. Marcie McClellan, the manager for this center while on site. Ms. McClellan reported that on Thursday 10/07/2021 Child A had a mild fever and was taken to the doctor. Child A was diagnosed with an ear infection and placed on antibiotics. On 10/08/2021 Child A was present. There was no fever. At the end of the day as Child A was changed child care staff noted that Child A was experiencing diarrhea. Child A was scheduled to be picked up in 10- 15 minutes, so staff informed Child A's family at pick up. Child A does not like to go to sleep. She has to be rocked to sleep every day. Child A is never held tightly. The child care staff always hold her gently with arms open because Child A would cry or scream. Child A has the same issues at home. The child care staff developed this procedure at the beginning of the year so that there were no misunderstandings like this if people hear her cry or scream at nap time. I interviewed child care staff member Ms. Leanne Williams onsite 10/11/2021. She reported that there is one child, Child A who gets overtired and emotional. When that 2 happens, she screams and is restless. Child care staff members help console her by rubbing her back or rocking her. They never hold her tightly and Child A can freely move. Child A was out on 10/07/2021. She had a slight fever and was taken to the doctor. She was placed on an antibiotic for an ear infection and was present on 10/08/2021. At the end of the day 10/08/2021 Child A had diarrhea about 10 minutes before being picked up. Child care staff member Ms. Shelainia McClaine was interviewed onsite 10/11/2021. Ms. McClaine reported Child A has had a "difficult situation in her background". Child A is unable to go to sleep without being rocked and will get overtired if she isn't rocked to sleep. Child care staff members have been working with Child A's family to be sure Child A's needs are being met while in care. Child care staff sit on the floor and rock Child A to sleep. They keep their hands and arms open and away from Child A's body so that nobody thinks they are holding Child A too tight when they hear Child A scream. I reviewed the center's records including Child A's Daily record sheet for 10/08/2021 which documented a diaper change at 2:45pm listed as loose diarrhea. Child A was picked up at 3:00pm. I was also informed that the room is monitored by security cameras. I requested to review the footage from 10/08/2021. The footage shows during rest time on 10/08/2021 one child care staff member rubbing the back of a child laying on a cot in the left corner of the room closest to the office. A male child care staff member was sitting at a table with a child who was finishing their food. And a third child care staff member was on the opposite side of the room sitting on the floor rocking Child A. I was able to clearly observe that Child care staff member's hands in an open position and her arms outstretched away from Child A's body. I observed Child A squirming around and at a couple times getting up and going over to the other side of the rug. After several seconds Child A went back and laid in the lap of that same child care staff member. I did not observe any inappropriate interactions between child care staff members and Child A. I did point out one area of possible concern to Ms. McClellan which was the male child care staff member on the video who was sitting by the table with a child who was finishing their food. Child care staff members are restraining children for nap time. They are not sending sick kids home. The center is not following CACFP guidelines. Lunch food only temped to CACFP guidelines which is 135 degrees one time.

I interviewed the complainant via telephone on 10/11/2021. The complainant stated, "food is not properly temped at lunch". He reported that on Friday 10/08/2021 the French fries were only 111 degrees Fahrenheit. The food temperatures are not checked at the kitchen they have to be checked at the center. On 10/11/2021 I completed an onsite inspection. I observed the posted menu with temperatures written in ink on the typed menu. I did not notice any issues with the temperatures listed for the week of 10/04/2021-10/08/2021. I interviewed Marcie McClellan, the manager for this center while on site. Ms. McClellan reported that they were having issues with a "disgruntled employee", Mr. Chris Martin. Mr. Martin would refuse to do tasks and would get confrontational when asked to do them. It was Mr. Martin's job to take the temperatures of the food when it arrived at the center. When asked Ms. McClellan reported that the first couple weeks the center was open, they had issues with the food not being at the correct temperature when it arrived at the center. They purchased a warming box that plugs into the vehicle to keep the food warm in transit, since then they have not had an issue. I interviewed child care staff member Ms. Leanne Williams onsite 10/11/2021. Ms. Williams stated she was just hired on 09/27/2021 and had no knowledge of any issues with the temperatures of the food. Child care staff member Ms. Shelainia McClaine was interviewed onsite 10/11/2021. She reported the center's food is temped in Oscoda in the kitchen before being transported and then again at the center when it arrives. The week of 10/04/2021- 10/08/2021 Mr. Martin was seen submerging the thermometer in water which caused it not to work. The thermometer was replaced but Mr. Martin was seen using a new thermometer that was intended to take the temperatures of children not food. Mr. Martin became verbally aggressive when it was pointed out to him. Ms. 4 McClaine stated it had been very difficult having Mr. Martin at the center. Ms. MacLaine reported she was unaware of any other issues with food temperatures.
