On July 1, 2022, I interviewed the complainant by telephone regarding the allegations. The complainant stated that there is a supervised volunteer, Garrett Jackson, who has no qualifications to be working in a child care facility and is often left alone with the children. Not only is this a safety issue for the complainant but it leaves the room out of ratio. The complainant has heard multiple children complain that the Child Care Staff Members are not around, and they (the children) are left alone. In the summer there are more children due to summer vacation, and the school aged child care room is not staffed appropriately. The volunteer, Mr. Jackson, has been overheard being mean to the children, taking away items from them that came from their home, and not listening to the children if there is a problem. On July 6,2022, I conducted an unannounced inspection to the Honey Bear facility in Swartz Creek. Upon arrival, I met with owner Peggy Wittbrodt. Ms. Wittbrodt and I discussed the allegations, she provided me with the staff attendance and child attendance sheets for a two-week period. While I reviewed the paperwork, Ms. Wittbrodt explained that due to a paperwork issue one of the three school aged child care staff members (CCSM) were not working in the center. Currently, CCSMs Madison Warden and Bridget Reed were working together to cover the ratio requirement in the school aged room. They both took turns supervising volunteer Mr. Jackson. She also explained that Mr. Jackson was in the process of being hired and would be officially hired once the results of his fingerprints came back. According to the attendance sheets produced by Ms. Wittbrodt, the ratio of school aged children to CCSMs was in compliance for the two-week period. The CCSMs work hours over lapped during the times the number of children exceeded 18. Ms. Warden and Ms. Reed also had the help of Mr. Jackson for supervision purposes. Ms. Wittbrodt stated that Mr. Jackson worked very well with the children (mostly the boys) because he followed the rules. The children will complain when not allowed to do what they want. She has had no behavioral problems from school aged children over the summer. I then interviewed both Ms. Reed and Ms. Warden. Both caregivers agreed that they supervised Mr. Jackson when he was available to volunteer. Neither ever heard him being mean to the children. Only reminding them of the rules before the children got hurt. Neither had a problem with Mr. Jackson. 3 While I was getting ready to leave the facility Mr. Jackson arrived. He confirmed that he was always in a room with another caregiver when he was there. He has no problems with any of the children. On July 21, 2022, I interviewed Child A's (9-year-old male) Mother over the telephone. She stated that her son really likes Mr. Jackson and had no problem with Mr. Jackson or the other two caregivers. During my conference with Ms. Wittbrodt, I reminded her that she would need to check the criminal clearance system regularly and that a "supervised" designation meant the caregiver could not be alone with the children but supervised by another caregiver. They could also not supervise any volunteers. Prior to completing the report, I checked the criminal background system and found that Mr. Jackson had been cleared to work as a regular Child Care Staff Member.

On February 1, 2022, an anonymous complaint was received alleging that Zachary Wittbrodt, licensee designee, was dangerous and strung out on drugs. The complaint source did not provide any examples of concerning behavior, dates, or times that incidents may have occurred. Contact information was not provided in which to conduct a follow up interview. 2 On February 1, 2022, I completed an unannounced onsite inspection and reviewed the allegations with Margaret Wittbrodt, licensee. Ms. Wittbrodt was upset regarding the allegations and that anyone would make concerning allegations against Mr. Wittbrodt. Mr. Wittbrodt does a lot for the facility in terms of fixing things, installing new equipment, cleaning the fish tank, and maintaining the premises. Ms. Wittbrodt has never received any concerns or complaints regarding Mr. Wittbrodt. Mr. Wittbrodt occasionally may act as a child care staff member, but generally does maintenance work at the facility. The child care children love that Mr. Wittbrodt comes into the facility; he always interacts in a positive manner with child care children. Ms. Wittbrodt does not have any concerns regarding Mr. Wittbrodt. On February 1, 2022, I interviewed Kayla Clary, program director. Ms. Clary does not have any concerns with Mr. Wittbrodt's behavior. She has never observed him act in a dangerous or unsafe manner. Ms. Clary has not received any concerns from child care staff members or parents of enrolled children regarding Mr. Wittbrodt. Mr. Wittbrodt does a lot of maintenance work at the facility and always interacts in a positive manner with child care children. On February 1, 2022, I interviewed Sherry Carter, child care staff member. Ms. Carter works in the preschool classroom and often observes Mr. Wittbrodt come into the facility to clean the large fish tank in her classroom. Ms. Carter has not observed Mr. Wittbrodt act in a dangerous or unsafe manner. His interactions with child care children are always positive. Ms. Carter has not received any concerns regarding Mr. Wittbrodt. On February 1, 2022, I interviewed Mr. Wittbrodt. Mr. Wittbrodt was very upset that anyone would make such horrible allegations against him. Mr. Wittbrodt often comes into the facility to install new equipment, preform maintenance activities, and cleans the fish tank. He denied any dangerous or unsafe behavior at the facility. Mr. Wittbrodt stated he enjoys interacting with the child care children and often receives positive comments from parents of enrolled children care children about his interactions. On February 3, 2022, I reviewed the child care background check system and observed that Zachary Wittbrodt was determined eligible on November 19, 2018, to be connected to the child care facility.

On February 1, 2022, I received an anonymous complaint regarding the facility not following safe sleep practices and rules. The complaint source alleged that unnamed child care staff members reported that the infants sleep better in swings with blankets and would remove the blankets when the complaint source arrived at the facility. The complaint source did not provide contact information for a follow-up interview. On February 1, 2022, I completed an unannounced onsite inspection at the facility. I observed the infant classroom with Ms. Wittbrodt at approximately 12:18 pm. Upon arriving in the infant classroom, I observed Child A (female, age 1) and Child B (male, age 10 months) asleep in swings. Child B also had blanket in the swing. Child A had been asleep in the swing since 11:40 am and Child B had been asleep in the swing since 11:30 am per their daily sheets. During the onsite inspection, I interviewed Ms. Wittbrodt. Ms. Wittbrodt confirmed all child care staff members present in the classroom has completed safe sleep training. Present child care staff members were Megan Hiller, Renee Pelky, and Julia Dilley. Ms. Wittbrodt stated infants are not allowed to sleep in swings and she is unsure why this practice was occurring. It will be addressed immediately. Ms. Wittbrodt understands that all infant child care staff members will need to retake safe sleep training.

On June 14, 2021, I received an incident report from Margaret Wittbrodt, licensee, indicating that on June 11, 2021, Child A (male, age 6) was swinging on a piece of playground equipment when he fell hitting his right wrist. Child A was later taken for medical treatment and diagnosed with a broken right radius. Mrs. Wittbrodt reported that Child A was sent to her office following the injury. Child A was given ice for his wrist and was monitored by Mrs. Wittbrodt. Child A did not complain to Mrs. Wittbrodt about his injury. He asked to return to his classroom, and Mrs. Wittbrodt allowed him to return upon viewing him able to use his wrist in a normal manner. Mrs. Wittbrodt has frequent contact with Child A's Mother and would have contacted her right away if she was concerned that Child A had an injury that required medical treatment. An incident report was filled out and provided to Child A's Father at pick up. On June 14, 2021, I interviewed Child A's Mother. Child A was picked up from the facility by Child A's Father on June 11, 2021, between 4:00 pm and 5:00 pm. Child A had a swollen right wrist at pick up from his fall that occurred prior to lunch. Child A's Mother was not contacted regarding the injury, and incident report was provided to Child A's Father at pick up. Child A was not acting like himself and was taken for medical evaluation. He was diagnosed with a broken right radius. Child A's Mother did not have a photograph of Child A's injury. Child A's Mother is concerned that Child A was present at the facility for five hours following his injury and medical treatment was delayed. Child A's Mother does not have any concerns with how Child A was injured, it was an accident. 3 On June 16, 2021, I completed an unannounced onsite inspection at the facility. I interviewed Kayla Clary, Program Director. Ms. Clary was present at the facility on June 11, 2021. Child A was with Child Care Staff Member 1 playing outside when he fell. Child A was sent to Mrs. Wittbrodt following his injury for monitoring. Ms. Clary observed Child A in his classroom at approximately 3:30 pm. Child A was observed using his right arm and wrist. He was playing Nintendo Switch, playing in the gym, and using a cup with his right hand. Child A did not state to Ms. Clary that he was in any discomfort or pain. If Child A was not acting like himself Ms. Clary would have contacted Child A's Mother or Child A's Father immediately. No swelling or redness was observed, and Child A was not crying or complaining at pick up. The parent notification plan for injuries for the facility is that any head injury receives a telephone call to a parent. If a child receives more than a minor scratch or scrape a telephone call is made to a parent for notification. Ms. Clary would rather let a parent know about an injury, if warranted, so they are not surprised at pick up. Ms. Clary does not have any concerns with the facilities notification policy. On June 16, 2021, I interviewed Child Care Staff Member 1. On June 11, 2021, Child A was outside playing when he fell off a swinging bar. Child A was taken to Mrs. Wittbrodt and an ice pack was applied. Child A returned from being monitored by Mrs. Wittbrodt and was acting normally. Child A did not complain about his injury to Child Care Staff Member 1. Child A is right handed and consumed his lunch without any issues or complaints. Child Care Staff Member 1 had a photo of Child A's injury following his fall. The wrist was observed with slight bruising. The photo did not show visible swelling to the area. Child Care Staff Member 1 did not contact Child A's Mother and was unsure if she was contacted by Mrs. Wittbrodt. If a child receives a significant injury an incident report is filled out and a parent is contacted regarding the injury. Minor injuries receive an incident report and notification at pick up. On June 16, 2021, I completed an unannounced onsite inspection at the facility. I interviewed Child Care Staff Member 2. On June 10, 2021, Child Care Staff Member 3 made Child B (male, age 3) run laps around the playground in 90 degree weather, as punishment for negative behavior. Child Care Staff Member 2 indicated she reported the concern to Ms. Clary. The discipline policy at the facility is that children 5 are spoken to regarding their behavior. If needed Mrs. Wittbrodt and the child's parent will be contacted. On June 16, 2021, I interviewed Child Care Staff Member 3. Child Care Staff Member 3 denied that she made Child B run laps as punishment. On 06/09/2021, during an unannounced onsite inspection, I spoke with Ms. Wittbrodt. She confirmed that there have been many children sick in the toddler room. The room has been cleaned thoroughly, especially since the spread of COVID they have been meticulous in regard to keeping the room clean. There were postings in the center (toddler and infant room building) stating, "Dear Parent, the state requires us to post any illness in every classroom regardless of whether or not your child has been in any contact with that child. Sorry for any confusion this may cause". I observed the toddler room and the infant room and there were messages posted on the wipe boards in both rooms "Case of: 6-4 Bronchitis-Toddlers; 6-3 RSV-Toddlers; Rhinovirus X 2; Parainfluenza; Rhinovirus-Infants. Ms. Wittbrodt also provided me a copy of the center's parent handbook that outlines the guidelines for illnesses with children at the center. On 06/09/2021, during the onsite inspection, I spoke with Kayla Clary, Shanyn Carter, Sara Strong, Shelby Zellar, Hannah Leedy and Haley Raup who are all staff at the center and work in the toddler room and/or the infant room. They are confirmed that the rooms are cleaned thoroughly and the toys are washed as the children use them. They were all concerned about the number of children who were ill at the center. Some of the staff felt that it would be beneficial to close the center and do a thorough clean of everything and give a chance for the illness to subside. On 06/09/2021, I spoke with Ashley Pittsley and Danielle Lederer, both are nurses at the Genesee County Health Department. I shared the concern of the young children becoming ill at the center. Ms. Pittsley and Ms. Lederer both agreed that there is really nothing the staff could do at the center to prevent the spread of some of these illness as they are respiratory in nature and even closing the center for several days would probably not stop the spread. They both confirmed that cleaning the rooms thoroughly and often, as they are doing is the best that they can do. Ms. Lederer indicated that she would reach out to Ms. Wittbrodt to help in any way she could. 3 On 06/15/2021, I spoke with Child A's Mother who confirmed that Child A (2-year- old, male) has been sick frequently. There are signs posted in the center indicating what illnesses have been contracted by some of the children who attend care at the center. She did not require a doctor's note upon returning Child A back to the center. Child A did not have a fever or other symptoms upon his return to care at the center. On 07/09/2021, I spoke with Child B's Mother who confirmed that Child B (1- year- old, female) has been sick frequently. There are messages on the wipe boards at the center alerting parents of the illnesses at the center. She would really appreciate an email or a letter sent home. She has concerns about why there are so many children sick at the center. She was recently told by one of the staff that all of the children have diarrhea and it wasn't anything to worry about.

After the incident, Child A did not use ■ left arm that morning and seemed to e avoring it. ■ was not playing normally or engaging, so Ms. decided to contact Child A's Mother around 11:30am. She informed her that Child A had an incident and had not been using arm for the last two hours. Child A's Mother came to get at the center shortly therea er and took Eto the doctors. She observed Ms. and Child A exit the bathroom and walk towards the table where a couple other children were playing. They spoke for a few moments and then Ms. and Child A started to walk away. Ms. was holding hand. Ms. did not recall observing any incident or jerking of Child A. She had urned away when they walked away. She did recall them coming back to the area a few minutes later and Ms. stating that Child A was complaining that arm hurt.
