On July 21, 2023, I attempted to contact Child A's mother via telephone twice. A voicemail was left requesting a call back each time. On July 21, 2023, I received a voicemail from Child B's father. On July 21, 2023, I interviewed Child B's father via telephone. Child A's mother is not accessible during the day due to work; however, he is. Child A is doing well, nothing is going on with her arm that is major right now. On the Hurley discharge paperwork, it stated there was a proximal radius fracture with mild cortical irregularities, essentially a buckle fracture. They went to Ortho Michigan, and nothing was needed further. According to Child B's father, the daycare has gone significantly downhill since it has been changed over to Child Time. They have spoke with the regional office about their concerns. His wife calls the center approximately three 4 times a week or more with concerns that she sees on the camera. The center has a live feed for parents to look at throughout the day. However, they are not allowed to record, or screen shot it. If they do, they get in trouble and can be possibly discharged from the center. On the day the incident happened with their child, his wife later on saw another lady in the hallway grab a child's arm, and when she called to address it, she was brushed aside. The regional office indicated they would be doing additional trainings at the center. They were notified about Child A's arm via the online portal called "SproutAbout." There were a couple of different stories they received. Child A was twirling in the bathroom, there was water on the bathroom floor, and the staff member grabbed her arm as she started to slip. The injury was down played to them. They were told she was fine, and had gone to sleep, so they let her stay there believing it was not injured. Later on, she was still favoring the arm, so they took her to Hurley to be evaluated as the arm was swollen. The teacher told them via the portal she thought she tweaked her arm as Child A was twirling, dancing and began to slip on water on the floor of the bathroom. There have been three to four new directors since the change of ownership has happened. It appears there is a lack of education with the staff there, and at one point they threatened to get attorneys involved. There have been issues with the staff, their billing for the three children they have attending there, and paperwork. They were never given a parent contract for billing, and it has been a mess for a while. They have tried to reach the director, but she is not easily accessible. Child A can be interviewed when the onsite inspection takes place. They have known child care staff member 1 since Child A was in the infant room. They do not believe she hurt Child A on purpose. Child A and child care staff member 1 are very close. Child A's Father believes the incident was an accident. On Jully 21, 2023, I interviewed Child A's mother. We reviewed what was discussed with Child A's father. Child A's mother watches the cameras pretty consistently throughout the day. She has tried to talk to the center when she sees things which are concerning but does not feel like they are listening. She feels the child care down plays a lot of the issues reported. This has been going on for months and they continue to brush her off. On July 25, 2023, I completed an unannounced onsite inspection at Child Time Learning Center. The program director was not present, staff called her, and I spoke with her via telephone. The front desk staff provided the needed paperwork items. The program director was in an all-director training and was onsite that day. Her attendance records were not onsite at the center and were at her home. She told me she would scan the records when she went home and send them via email. She works more than 50% of the time the center is open and operating. On 10/03/2022 I completed an unannounced onsite inspection at the center from 11:25 am - 12:50 pm and interviewed program director Brook Borrow. Ms. Borrow stated that she was extremely surprised that someone would report that she is not at the center enough as she is there it seems "all of the time". 3 Ms. Borrow comes in some days at approximately 9:30 am but then she stays until close. Most days she arrives at the center between 8:00 — 8:30 am. She confirmed that she is always there at least 50% of the time that children are in care. On 10/21/2022 I interviewed child care staff members (CCSM) Maddie Petty, Ginger Ferguson, Andrea Hailey, Courtney Dennison, Tayler Waite, Michelle Brier, Rosella Humphrey, Jamie Young, Ayanna Williams, Matthew Haremza, Sydney Prince, Lauren Dennison, Jessica DeWitt, and Tiffany Wilson. I attempted to interview CCSMs Isabell Grainger and Brittney Kahelski but did not receive return calls after leaving them both voicemail messages. Ms. Petty stated that she usually starts at 6:30 — 7:00 am and Ms. Borrow arrives 7:30 — 8:00 am daily and stays after closing. Ms. Ferguson clarified that she is an opener and Ms. Borrow is usually in each day by at least 8:00 am and stays all day. Ms. Hailey feels that Ms. Borrow is always there when she is. Ms. C. Dennison feels that Ms. Borrow arrives at the center most days between 8:00 — 9:00 am. Ms. Waite stated that Ms. Borrow spends more time at the center than is required and is always available. Ms. Brier stated that Ms. Borrow is always present at the center when she is there and is always available. Ms. Humphrey clarified that Ms. Borrow is usually at the center daily by 8:30 am and there until the center closes and some days she is there until 11:00 pm. She feels that Ms. Borrow is trying her hardest. Ms. Young clarified that Ms. Borrow is always there when she is. She feels that Ms. Borrow is a good program director and is doing her best. Ms. Williams stated that Ms. Borrow is always there when she is and even works in rooms as needed. She feels that Ms. Borrow is the best program director that the center has had. Mr. Haremza clarified that Ms. Borrow is there 98% of the time that he is there. Ms. Prince explained that Ms. Borrow is at the center usually between 7:00 — 9:00 am daily as she is the opener and runs the front desk until Ms. Borrow arrives. Ms. L. Dennison explained that Ms. Borrow usually arrives at the center between 8:30 — 9:00 am on the days that she is there and is always there at closing. Ms. DeWitt stated that Ms. Borrow is at the center all of the time and well after closing. She feels Ms. Borrow goes above and beyond. Ms. Wilson confirmed that Ms. Borrow is at the center daily by 8:30 am.

When I arrived at the center on 10/03/2022, I observed that all of the rooms were in the appropriate CCSM to child ratios. Ms. Borrow clarified that they have made vast improvements in maintaining appropriate ratio and feels that it is no longer an issue. Regarding the infant and toddler rooms, there is never one CCSM to 12 children. She has been getting call-ins daily from CCSM's and ends up working in rooms, as often as needed. She printed and provided me with the CCSM's and children's daily attendance for the previous two weeks. She also provided me with the contact information for the CCSM's. I notified Ms. Borrow that I would complete the CCSM's interviews via telephone calls since she was needed in a room. After I left the center, Ms. Borrow emailed me copies of the face to room sheets that CCSM document the ratio in the room at various times throughout the day. After reviewing these sheets, I confirmed that there were various times that the center documented that they were out of the appropriate CCSM to child ratio. On 09/20/2022 at 8:00 am in the Infant 1 room there were 2 CCSM's and 9 children; on 09/20/2022 at 8:00 am in the Toddler 2 room there were 2 CCSM's and 12 children; on 09/21/2022 at 8:00 am in the Infant 1 room there were 2 CCSM's and 10 children; on 09/21/2022 at 7:00 am in the Toddler 2 room there were 2 CCSM's and 9 children; on 09/21/2022 at 9:00 am in the Twos 2 room there were 3 CCSM's and 14 children; on 09/23/2022 at 7:00 am in the Toddler 2 room there was 1 CCSM and 8 children; on 09/26/2022 at 8:00 am in the Toddler 2 room there was 1 CCSM and 5 children; on 09/27/2022 at 7:00 am in the Infant 1 room there were 2 CCSM's and 10 children; on 09/27/2022 at 8:00 am in the Toddler 2 room there was 1 CCSM and 6 children; on 09/27/2022 at 10:00 am in the Twos 2 room there were 2 CCSM's and 8 children; on 09/30/2022 at 10:00 am in the Toddler 2 room there were 2 CCSM's and 9 children. On 10/21/2022 I notified Ms. Borrow of the concern with the documented ratio issues. She did not realize that the rooms were out of the appropriate CCSM to child ratios that frequently. However, all of the dates that I mentioned were prior to my onsite to the center on 10/03/2022 and they have made corrections since then. She explained that they have hired more CCSMs and added extra CCSMs on the schedule in the mornings. Ms. Petty stated that she primarily works in an infant room and sometimes they are out of the appropriate CCSM to child ratio but not that frequently. It seems to happen more often in the mornings. Ms. Furguson primarily works in a toddler room and explained that they are out of the appropriate CCSM to child ratio sometimes but for only 10 minutes at the maximum. Ms. Hailey primarily works with infants and toddlers and only recalled one time that her room was out of the appropriate CCSM to child ratio, and it was immediately corrected, while the parent remained present. They told the parent that the child would be in a different room that had space for him. Ms. C. Dennison works primarily with infants and toddlers, and they have been having a lot of CCSMs calling in, causing a problem in the morning when there are many children being dropped off at the center. She recalled a few times when one CCSM cared for 6-8 children. Ms. Waite works primarily with the preschool aged children but occasionally will help out in the infant and toddler rooms. She stated that sometimes those rooms are out of the appropriate CCSM to child ratios but only when CCSMs call-in. She recalled a time approximately two weeks ago when there were two CCSMs in the room with eight children and then three additional children were dropped off in the morning. It took approximately 5-10 minutes for them to move children around to rooms that had space for them. Ms. Brier, Mr. Haremza and Ms. L. On June 3, 2022, program director Rebecca Hirmaz reported the incident to licensing consultant Erin Kidd. I received an Incident Report regarding this on June 3, 2022. On June 6, 2022, I made an unannounced onsite inspection to the child care center. I interviewed program director Rebecca Hirmaz. On June 2, 2022, she was walking down the main hallway and opened the door to the early preschool classroom. She saw Child P standing alone in the classroom. Child P was not crying and did not appear to be scared. She took Child P outside to join his class on the playground. This was at 3:50pm. The child care staff members for the classroom that day (CCSM6 and CCSM7) were surprised and upset. Ms. Hirmaz stated that they determined that Child P had been unattended in the classroom for approximately 5 minutes. While at the center, I interviewed CCSM6, who verified that she is the lead caregiver for the early preschool classroom and that CCSM7 was her assistant for that day. She verified that approximately 5 minutes after they went outside in the afternoon of June 2, 2022, program director Rebecca Hirmaz brought Child P outside on the playground. She had 14 children ages 2 to 3 years present at that time. She was able to show 1/2 1/2 me her attendance for the day, which showed that the classroom went outside between 3:38pm and 3:42pm. She said that when they go outside, they have the children line up against the wall, the children put their arm through a colored ring that is attached to a rope and they hold on to. Because each rope only has 10 rings on it, they were using two ropes that day. The procedure for going outside also has one caregiver at the front of the line of children and one caregiver at the back of the line. CCSM7 was in the front and had the "name to face" sheet, although she did not recall hearing CCSM7 doing the name to face. CCSM6 said that on this day, the line of children became bunched up in the vestibule that connects the hallway to the playground door. She showed me the attendance sheet in which the "name to face" check is done. None of the children were checked off going out on the playground on the afternoon of June 2, 2022, although all children had been checked off and checked back in during the morning time on the playground and all of the children were checked off when they came in from being outside on the playground at the time of the incident. On June 9, 2022, I interviewed CCSM7, who confirmed that she had been working with CCSM6 in the early preschool classroom on June 2, 2022. The classroom had been out on the playground for approximately five minutes when program director Rebecca 3 Hirmaz came out on the playground with Child P. She said that the center uses a "name to face" checklist when going outside as well as coming inside from the playground. She said that this is usually done by the lead caregiver. On June 2, 2022, a child was trying to get out of the classroom when they were getting ready to go out on the playground for their afternoon time. Because of this, she had to be in the front of the line of children near the classroom door. Ordinarily, she would grab the bag of supplies and CCSM6 would grab the paperwork but CCSM7 had to grab the bag since she was blocking the door. When she grabs the bag, she checks the bathroom to make sure no children are in there when they are going out on the playground. She believes that Child P was trying to play "hide and seek" when he hid from them the afternoon of June 2, 2022, because Child A was attempting to play hide and seek two days after the incident. Child P's mother stated that she was informed of Child P being left alone with the early preschool classroom when she picked up Child P from the center on June 2, 2022. She confirmed that Child P still attends the child care. She did not have concerns about CCSM6 or CCSM7 but did have concerns about how they were constantly shuffling children around, especially at drop off and pick up. Child P will ofte

On May 20, 2022, I spoke with the center's current licensing consultant Erin Kidd, who informed me that the center had recently been placed on a first provisional license to include frequent monitoring due to a ratio violation as well as a repeat appropriate care and supervision violation. On May 24, 2022, I interviewed Child A's mother. She had been watching the center's live video feed on May 20, 2022 and witnessed child care staff member 1 (CCSM1) grab the back of a child's shirt while the child was running by, forcefully stopping him. CCSM1 was then seen putting a finger in the child's face and said that the child appeared to be upset. This occurred between 8:45am and 9:00am in the Young Preschool classroom. Child A's mother watched the live feed of the classroom around 11:00am and saw that the children in the classroom were lining up at the door. She witnessed CCSM1 grab a child from the front of the line, lift him up by his arm and carry him to the back of the line. She had a description of both children and would try to identify them. Child A's mother arrived at the center at 11:36am to pick up Child A from care and to discuss her concerns regarding what she had witnessed on the web cam earlier that morning. There was no one at the front desk at the time of her arrival. An unidentified caregiver came up to the front desk and told her that there was no one there to address her concerns with as the program director Tracy Leunberg had just walked off the job earlier that day. On May 24, 2022, Child A's mother sent me a screen shot from the center's web cam showing the two children who CCSM1 was witnessed grabbing by the shirt and picking up by the arm. On May 26, 2022, I made an unannounced onsite inspection to the child care center spoke to Rebecca Hirmaz, who identified herself as the new temporary program director. She said that she just started working at the center on May 23, 2022. She denied ever witnessing CCSM1 being rough with a child or picking up a child by the arm. While at the center, I interviewed CCSM2, who was able to identify the two children in the screen shot sent to me from Child A's mother as Child B (male, age 5) and Child C (male, age 4). She denied witnessing CCSM1 grabbing Child B by the shirt when he was running in the classroom on May 20, 2022, but CCSM1 told her that she did grab a running child by the shirt earlier that day. CCSM2 did see CCSM1 grab a child in a manner she considered "rougher than she should have" a few weeks ago. She did not recall which child this was. Regarding the incident involving picking up a child by the arm, while the children were lining up on May 20, 2022, she witnessed CCSM1 walk 4 Child C from the front of the line to the back of the line as she was acting out but CCSM2 denied witnessing CCSM1 picking up Child C by the arm at any point. During the May 26, 2022, onsite inspection, I also interviewed CCSM3 and CCSM4 who both have worked with CCSM1. Both denied ever seeing CCSM1 being physically aggressive or inappropriate with children in care. Both denied ever seeing CCSM1 pick up a child by the arms. On May 31, 2022, I interviewed CCSM1 during an unannounced onsite inspection at the center. She said that the only incident in which she recalled grabbing a child by the shirt involved Child A and not Child B. The children were cleaning up the room on May 20, 2022, and she reached for Child A's shoulder when he ran by, but her hand ended up going in his shirt, this is what caused Child A to stop. Child A did not fall down or cry when he was stopped by her. Regarding Child C, he was acting up and being rough while at the front of the line, she took him by the forearm and walked him to the back of the line. She denied picking him up at any point and said that when she took Child C to the back of the line, he laughed. I spoke to former program director Tracy Leunberg on June 3, 2022. On May 20, 2022, I spoke with the center's current licensing consultant Erin Kidd, who informed me that the center had recently been placed on a first provisional license to include frequent monitoring due to repeat caregiver to child ratio violations. Child A's mother was viewing the webcam on May 20, 2022 and saw 16 children in the early preschool classroom with one caregiver. This was around 8:45am to 9:00am. She checked it again later in the morning and started recording what was on the web cam on her phone. This was around 11:30am. She said that it looked like there was no child care staff member present in the classroom for approximately one minute but wasn't sure if a staff member might have been in the door. I was able to view the video. A caregiver could be seen exiting the area that the camera covers, returning approximately a minute later but because the camera does not show the classroom door, I was unable to determine if the caregiver left the room, which would have left the children unattended during this time. On May 26, 2022, I made an unannounced onsite inspection to the child care center. I spoke to Rebecca Hirmaz, who identified herself as the new temporary program director. She said that she just started working at the center on May 23, 2022, and she denied that the center had been out of ratio since her start date. On June 6, 2022, I made a third unannounced onsite inspection. During the onsite inspection, I observed that all classrooms were within the correct caregiver to child ratio. I interviewed child care staff members in each of the classrooms. CCSM2 said that the classroom she was working in was out of ratio on May 19, 2022. When she arrived in the classroom, CCSM1 had 12 children. The caregiver to child ratio in this particular classroom is one caregiver to no more than 10 children. On May 20, 2022, CCSM1 had 18 children when CCSM2 arrived in the classroom. CCSM2 said that since new program director Rebecca Hirmaz took over, they have been within proper caregiver to child ratios. CCSM3 told me that she has had up to 25 children with only her as a caregiver. This occurred earlier this year. She denied being out of ratio since Ms. Hirmaz began working at the center as the program director. CCSM4 said that when her classroom is not able to maintain proper caregiver to child ratio, they contact another worker to work in the classroom. This has gotten better since Ms. Hirmaz started at the center. CCSMS primarily works with the school-age children and denied being out of ratio. CCSM6 denied being out of ratio. CCSM7 said that children and caregivers are moved around in order to maintain the caregiver to child ratio. CCSM8 denied being out of ratio in her classroom at anytime. CCSM9, CCSM10, CCSM11, CCSM12, and CCSM13 all denied being out of ratio in their classroom. CCSM14 told me that the center was understaffed and that their classroom has been out of ratio on many dates but did not have an exact date as to when this last occurred. CCSM15 said that she works mainly as a floater and denied being out of ratio. CCSM16 stated that her classroom is out of ratio on most days, with the last time occurring the previous week. She did not remember what day it was but that there were nine infant and toddlers with two caregivers for approximately 1-2 hours. While at the center, I obtained written attendance records for the early preschool classroom for the week of May 16 -20, 2022. On May 20, 2022, it appeared that at 9am, there were 18 children present with one caregiver in the early preschool classroom. At 10am, there were 19 children present with two caregivers. None of the parents interviewed recalled seeing any classroom out of ratio when picking up and dropping off their children, except Child K's mother, who said that she had witnessed Child K's classroom out of ratio on a regular basis. On April 6, 2022, I interviewed Child A's Father. On April 5, 2022, Child A (male, age 2) left his classroom around 11:30 am unsupervised and was found in the parking lot of the child care center by a child care staff member. Child A's Father does not know which area of the parking lot Child A was in or which child care staff member located Child A. He believes Child A may have been out of facility approximately three minutes. The child care facility is at the corner of an intersection of two busy roads. Child A was not injured during the incident. Child A is non-verbal and was not able to tell Child A's Father about the incident. "He seemed clingy yesterday like he went through something." Child A's Father was not informed of the incident when he picked Child A up on April 5, 2022. The program director Diana Hensley, called Child A's Mother about ten minutes after Child A was picked up by Child A's Father. Child A's Father was upset that he was not informed of the incident earlier in the day and that the facility waited until he had picked up Child A before they called Child A's Mother. On April 6, 2022, I completed an onsite inspection at the child care facility. I interviewed Diana Hensley. Ms. Hensley called the department to report the incident at 2:02 pm on April 6, 2022. The incident occurred on April 5, 2022, at 11:00 am. Ms. Hensley stated she was informed by April Cole, licensee designee, that she would report the incident to the department. Yesterday on April 5, 2022, child care staff member Maggie Andres, was working in Child A's classroom (Young Preschool) with eight children aged 2.5-3 years. Ms. Andres had her classroom door propped open with her foot trying to comfort another child who was in the hallway from the Preschool Classroom. Ms. Andres was talking to child care staff member Ayanna Williams in the hallway. During this time Child A opened the rear door of the classroom that leads outside and left the building unnoticed. It is believed Child A traveled up the east side of the building and into the parking lot. The side of the building does not have cameras. Only the front parking lot is visible. The Young Preschool classroom door was easy to open and did not have a door alarm. Ms. Andres did not hear Child A leave the building. Child A was located in the parking lot, uninjured by Amanda Brinch, child care staff member. Child A is not very verbal and did not say anything about the incident. According to Ms. Cole, who viewed the video footage, Child A was out of the building for one minute and forty-five seconds. I asked Ms. Hensley why there was a delay in reporting the incident to Child A's Father. Ms. Hensley stated Childtime was investigating the incident and she was 3 waiting to hear the outcome before informing Child A's Father and Child A's Mother about what occurred. On April 6, 2022, I interviewed Amanda Brinch. Ms. Brinch was clocking out for lunch on April 5, 2022, when she got to the front door of the facility two maintenance men yelled "hey you got a kid running across the parking lot." Ms. Brinch dropped the items she was carrying and started to run toward Child A. Child A was running toward Hill Road and made it to the end of the middle row of parking spots in the front of the building. Ms. Brinch ran and scooped up Child A. Child A did not have on any shoes or coat. Diana Hensley and Tracy Leuneberg, child care staff member, met Ms. Brinch in the parking lot and took Child A back to his classroom. Child A was not injured, his feet were wet from not having any shoes on. On April 6, 2022, I interviewed Tracy Leuneberg. Ms. Brinch was leaving for lunch on April 5, 2022, between 10:30 am and 11:00 am. She went out the front door, immediately returned and said a child (Child A) was in the parking lot. Ms. Brinch ran out and grabbed Child A. Child A is non-verbal and did not identify what occurred. Ms. Leuneberg brought Child A back into the Young Preschool classroom. Ms. Andres and Ms. Williams w

Last night Child A went home and told her parents that during dance time Child B pulled her pants and underpants down, hit and poked her in the vagina. Child A complained that her vagina hurt and that it was painful to urinate. Child A's Mother reported the concerns to child care staff members in the Pre-K classroom who reported the allegations to Ms. Hensley. The child care staff members in the Pre-K classroom are Mikala Sanford and Tayler Waite. The Pre-K classroom did not have dance time on January 12, 2022, the classroom only has dance time if the weather is inclement, and they are unable to go outside. On January 12, 2022, the Pre-K classroom went outside. Child care staff members reported to Child A's Mother on January 12, 2022, that Child A had been complaining that her vagina hurt. On January 14, 2022, Ms. Hensley reported that the Pre-K classroom has cameras that record. Kathleen Miller, licensee designee, watched the entire video of the Pre- K classroom from January 12, 2022. The classroom did not have dance time on January 12, 2022. Child care children were never alone in the classroom. Ms. Miller did not observe any inappropriate interactions between Child A and Child B. On January 14, 2022, I interviewed Child B's Mother. Child B's Mother was contacted by Ms. Hensley regarding the allegations. Child B's Mother does not have any concerns with the care and supervision provided by the facility. A child care staff member is always present in the classroom. Child B has never pulled down the pants of another child in the classroom. On January 14, 2022, I interviewed Ms. Miller. Ms. Miller watched the Pre-K classroom video from January 12, 2022. Ms. Miller did not observe any inappropriate interactions between Child A and Child B. At no point in the video were any child care children observed alone in the classroom. Child A and Child B do interact with each other during the day; however, no interactions were inappropriate. No child care children had any clothing removed during the video. Two female children were observed dancing on dots during play time. Ms. Miller observed one occasion when Child A walked into the bathroom and another male child walked out of the bathroom shortly after Child A entered the bathroom. The male child was completely dressed when he exited the bathroom and both children were in the bathroom for only a few seconds. During rest time Child A and Child B are across the classroom from each other. Ms. Miller has not received any concerns regarding the care and supervision provided by child care staff members in the Pre-K classroom. 3 On January 19, 2022, 1 completed an unannounced onsite inspection at the child care facility. I interviewed Mikala Sanford. Ms. Sanford is a child care staff member in the Pre-K classroom. Last week Child A went home and told her parents that her private area was hurting, and it hurt to go to the restroom. Child A indicated to her parents that Child B pulled her pants and underwear down in front of everyone, punched and poked her in the vagina. This occurred during dance time, but on January 12, 2022, dance time did not occur. The classroom went outside. Ms. Sanford did not observe any inappropriate interactions between Child A and Child B. Dancing occurs between 9-9:34 am if the classroom does not go outside. Ms. Waite is the second child care staff member and arrives by 9:00 am. Child care children are never left alone in the classroom. Child B has a history of poking children with his finger on their buttock, over the child's clothing. Child B has never removed any child's clothing in the classroom. Ms. Sanford stated that there is no way that the allegations could have occurred.
