R 400.1903 · R 400.1903 Licensee Responsibilities. (3) The licensee shall permit parents of enrolled children who are in attendance to visit the child at the child care home at any time during hours of operation, as required in section 3a of the act, MCL 722.113a.
On December 15, 2020 I completed an unannounced onsite inspection at the child care home and interviewed Mrs. Musselman-James. She reported that Child A is her niece's daughter, and the parents are not together. She stated that she has had multiple issues with Child A's father and had a personal protection order (PPO) against him that recently ended. Since it ended, he has been allowed to start picking up Child A from her home. Mrs. Musselman-James stated that when the PPO was in place Child A's father was not allowed at her home. At this time, due to COVID-19 she is doing all drop-off and pick-up on the front porch as 2 recommended per the child care COVID-19 guidelines. Child A's father has not been allowed into the home, but none of the parents have been allowed into the home due to these restrictions. On December 15, 2020 I had telephone contact with Child A's father. He reported great concern with not being allowed into the child care home. I informed him that due to COVID-19 child care providers have been advised to not allow parents into the home to minimize the number of people in the home. He said he has never been allowed into the home because Mrs. Musselman-James had a PPO against him. I advised him that if she had a PPO against him, she was correct to deny him access to her home. On January 19, 2021 I made telephone contact with Child A's mother, and Child B and C's mother. Child A's mother confirmed that Mrs. Musselman-James is her aunt. She reported that her aunt always has an open-door policy, but due to COVID-19 she has not been allowing parents into the home. Child B and C's mother stated that she was never been denied access to the home and has no concerns with not being allowed into the home at this time. She is happy that Mrs. Musselman-James is following the COVID-19 guidelines. On January 20, 2021 I made telephone contact with Child D's mother. She reported that she has always been allowed access to the child care home before COVID-19. She has no concerns with Mrs. Musselman-James following the recommended guidelines.
Mrs. Musselman-James will not allow Child A's father into the child care home. Child A was transported without prior permission and Mrs. Musselman-James refused to bring her back. Child A's father was not notified when children in the child care are sick.

Mrs. Musselman-James reported that she does not transport unrelated child care children; she only transports her relative's children if she has their parents' permission and it is not during child care hours. She reported that one time she offered to keep Child A for the mother because the mother had to go out of town early and Child A's father would be there to pick her up around 8:30am. Mrs. Musselman-James reported that the father did not show up and she was trying to contact him. She needed to run some errands, so she got permission from Child A's mother to take her on the errands. She explained that by 10:30am she had not been able to make contact with Child A's father. She texted him asking when he would be there to pick her up because she needed to run errands. The father's reply was "That's none of your business." At 11:15am she text Child A's father and said they were leaving and would be back in 30 minutes. Within 10 minutes of her leaving he texted saying he was there to pick up Child A and was calling the police. Mrs. Musselman-James said she immediately came home, and the police were there. She explained to the police what happened and showed them the text messages. The police just watched the exchange of Child A going from Mrs. Musselman-James to her father and then left. I reviewed the text messages she referenced, and the words and timeline are accurate. Child A's father reported that he never gave permission for Child A to be transported by Mrs. Musselman-James. I informed him that the mother had given her permission. I also told him I reviewed the text messages between them, and Mrs. Musselman-James notified him she was leaving. Child A's father became belligerent during this discussion and hung up the phone. Child A's mother reported that her aunt was simply trying to help her, and Child A's father was being very difficult. She said she had given permission for Mrs. Musselman-James to transport Child A. Child B and C's mother and Child D's mother reported that their children have never been transported by Mrs. Musselman- James.

Mrs. Musselman-James reported that she does notify parents if a child has been exposed to a communicable disease. She stated she believes this is in reference to children with COVID-19, but they have not had any children or parents test positive for the disease. Child A's mother, Child B and C's mother, and Child D's mother reported there have been no positive cases in the child care. They stated Mrs. Musselman-James is quick to notify them of any illness going around the child care. When I spoke to Child A's father, we were not able to discuss this topic before he became belligerent and hung up.
