R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.
On the morning of September 7, 2023, I received a phone call from Licensee, Kassandra Burton, letting me know that I may be receiving a phone call because she had a payment dispute with a parent of children in care and the parent had asked for my contact information. Kassandra Burton stated that Child A (male, age 3) and Child B (female, age 7 months) had begun attending the child care home the week of August 21, 2023. Kassandra Burton contacted her families on the evening of August 29, 2023, and stated that she was going to be closed on August 30, 2023, for personal reasons. Kassandra Burton said that Child A & B's Mother was upset about the closure and then allegedly lost her new job after her children became sick and she did not want to pay for services that had been agreed upon in the parent contract. Kassandra Burton sent me a series of text messages with Child A & B's Mother that included a conversation about the allegation. In a text message sent to Kassandra Burton on the morning of September 7, 2023, Child A & B's Mother stated, "I still have a video of Child A crying telling me he ate animal food from a bag." Kassandra Burton responded to the text message and said that her dog food is stored in the garage and is not left out where the children can access it. Kassandra Burton asked Child A & B's Mother why she had not said anything to her about Child A saying he ate dog food while in care until after the payment dispute. Child A & B's Mother responded through a text message and stated she had not said anything about it because she hoped she could trust Kassandra Burton not to let it happen again. Kassandra Burton responded and said, "Not to let it happen again? No kids have access to dog food in my house." On September 7, 2023, I spoke to Child A & B's Mother and Kassandra Burton about the allegation by telephone. Child A & B's Mother said that on the evening of August 24, 2023, Child A came home and said he had eaten animal food in a plastic bag while in care. Child A & B's Mother was not sure who fed it to him or whether he found it and got into it on his own because he was hungry. I asked Child A & B's Mother if she had spoken to Kassandra Burton about what Child A had said, and she admitted that she had not said anything to her because she was not sure if it was true and she had never seen any dog food assessable to the children in the child care home. She stated that instead, she addressed it more broadly on August 25, 2023, when she dropped Child A & Child B off at the child care home by asking Kassandra Burton and Child Care Staff Member 1 (CCSM 1) to watch Child A more closely. On the evening of August 25, 2023, Child A came home from care and consumed half of a pizza. She thought maybe Child A had eaten the dog food the day before because he was not being fed enough while in care. She sent CCSM 1 a text message that evening and asked her if Child A had been eating and drinking while in care because he was so hungry. CCSM 1 responded and told her that they had alfredo for lunch. CCSM 1 said some of the children in care did not like it, but she thought Child A ate most of it. Child A & B's Mother thought Child A also seemed dehydrated, so she gave him some Pedialyte. While I was on the phone with Child A & B's Mother, Kassandra Burton had tried to contact me by telephone and asked me to call her back. She wanted to let me know 4 that she had spoken with CCSM 1 who told her that on the evening of August 25, 2023, Child A & B's Mother had texted CCSM 1 asking her if Child A had been eating and drinking while in care because he had eaten almost half of a pizza that evening. Kassandra Burton said CCSM 1 responded and stated that they had made alfredo that day and many of the children in care did not seem to like it, but she was "pretty sure" Child A ate most of it. On the morning of September 7, 2023, I received a phone call from Kassandra Burton about the allegation. She stated that Child A & B's Mother was upset with her because her children had contracted hand, foot, and mouth disease and was threatening to make her pay for the medical bills. Kassandra Burton denied that it came from the child care home and said that none of her other children in care had hand, foot, and mouth disease. Kassandra Burton sent me a series of text messages between her and Child A & B's Mother. Child A & B's Mother texted Kassandra Burton on the morning of September 7, 2023, to state that Child A and Child B were both "still fighting a disease." She said that Child B had low oxygen levels and was nearly put on a ventilator three times and she had the hospital records to prove it. Child A & B's Mother threatened to make Kassandra Burton pay for the medical bills. Kassandra Burton responded to the message and told Child A & B's Mother to "go ahead" and take her to court for reimbursement because no one else in the child care group home had hand, foot, and mouth disease. On September 7, 2023, I spoke to Child A & B's Mother by telephone who said that on August 31, 2023, both Child A and Child B were diagnosed with hand, foot, and mouth disease. She said this was a couple days after Child A said that Child G (female, age 3) had drank out of his sippy cup and she had observed there were other children in care who were coughing and had congestion at pick-up time. She said she had taken Child A and Child B to the doctor on August 31, 2023, and the physician who treated them said it was common for children in child care facilities to get hand, foot, and mouth disease especially since this was their first time in child care. Child A & B's Mother said she was never notified that other children in care had the illness and she did not think Kassandra Burton had notified other parents of children in care that the child care home had two confirmed cases of hand, foot, and mouth disease. On September 7, 2023, Kassandra Burton called me while I was on the phone to Child A & B's Mother and asked me to call her back. She wanted to provide me with additional information about her communications with Child A & B's Mother. I asked Kassandra Burton if any other children in care were ever diagnosed before or after Child A and Child B contracted hand, foot, and mouth disease, and she said no other children in care were ever diagnosed with it. She said she has a private social media group on Facebook where she posts information about what is going on in the child care home. She said when she received a copy of the doctor's note from Child A & B's Mother on August 31, 2023, she immediately removed any identifying personal information and posted it on the group page so all the parents in care would be aware of it. She said Child A & B's Mother told her that the children would need to be excluded from care for seven days. Kassandra Burton forwarded a copy of the social media post to me. On August 31, 2023, a post was made on Facebook that stated, "Parents please watch for symptoms. Two of my daycare children have been diagnosed." The attached note was dated August 31, 2023, and read..." Patient was seen and diagnosed today with hand, foot, and mouth disease. Please take proper precautions." It was signed by Kristi Smith, PA-C, Ascension Medical Group. On September 8, 2023, I made an unscheduled inspection to the child care home and spoke to Kassandra Burton and CCSM 1 about the allegation. Kassandra Burton said Child A & B's Mother contacted her on August 31, 2023, and said she had just returned from the doctor's office, and she was going to lose her job because the children needed to be excluded from care for seven days because they were diagnosed with hand, foot, and mouth disease. On August 29, 2023, I made an onsite inspection to the child care home and spoke to Licensee, Kassandra Burton, and Child Care Staff Member 1 (CCSM 1) about the allegation. Kassandra Burton admitted that she was out of ratio with two child care staff members and more than 12 children in care two or three days in August 2023 when there was overlap between children who were disenrolling to go to school and children who were starting to attend her child care home. She said normally she always stays within her ratio and capacity, but she was trying to accommodate both families during the transition. CCSM 1 denied that the child care home ever had more than one child care staff member to six unrelated children in care but then she recalled one week in August 2023 when she and Kassandra Burton had more than 12 children in care at one time. She explained that some children were transitioning back to school and going to be leaving the facility while a new family was starting care and needed it to begin before the other children returned to school. I requested to see the daily attendance records for the month of August 2023 so I could determine how many days she had too many children in care. Kassandra Burton gave me her attendance records but admitted that she has been going through a difficult situation at home and had not been good about maintaining daily attendance records for a while. I opened the attendance book where she maintains her daily attendance records and the last day attendance had been recorded was July 14, 2023. I reviewed the attendance records from June 1, 2023, through July 14, 2023. Kassandra Burton had each child's first and last name and the time of arrival and departure recorded for each day. She also included the first and last name of each child care staff member who worked that day and their time of arrival and departure. Her dated daily attendance records during this timeframe indicated that she always maintained a ratio of at least one child care staff member to six children and she never exceeded 12 unrelated children in care at any given time. I asked to see her daily attendance records from July 17, 2023, through the morning of August 29, 2023, and she indicated that she could not find them and knows she did not take attendance every day. She said she had not yet completed her daily attendance record for the morning of August 29, 2023, but would complete it immediately. I counted the number of children in care and observed 10 unrelated children in the care with Kassandra Burton and CCSM 1, so they were within both their ratio and capacity that morning. I explained to Kassandra Burton that she should have waited to enroll the children who were coming to her child care home until after the school-age children went back to school and she said normally she would have done that but she wanted to accommodate the family who needed care immediately. She said she would not do that in the future, and we completed a corrective action plan onsite for the violations. 3 I also told her that she is required to maintain accurate daily attendance records for both the children in care and the child care staff members she employs. She said she would start maintaining them immediately and we completed a corrective action plan onsite for the violations. On August 30, 2023, I spoke to Child Care Staff Member 2 (CCSM 2), Child A & B's Mother, and Child C & D's Mother by telephone. CCSM 2 said she is only employed part-time at the child care home but normally she is there with either Kassandra Burton or CCSM 1, and they never usually have more than 12 children in care. CCSM 2 said she leaves when the group home is down to six unrelated children in care and one child care staff member. She said the only time she ever remembers there being more than 12 children in care was one week in August 2023 when some children were transitioning out of the child care home and another family was starting care. On August 29, 2023, I made an onsite inspection to the child care home and spoke to Kassandra Burton and CCSM 1 about the allegation. Kassandra Burton denied ever using any individuals to provide child care in her home without a comprehensive background check. Kassandra Burton said the only child care staff members she employs in the home are CCSM 1 and CCSM 2 and they both have had comprehensive background checks. She denied anyone else frequently visiting the home during child care hours or ever using a "substitute" child A care staff member who may not have had a comprehensive background check. She admitted she has one friend who has transported her minor household members to school but denied that the individual has ever provided any care or supervision to the unrelated children or ever been alone around any children in care. I reviewed the child care staff member attendance records from June 1, 2023, through July 14, 2023, and the daily attendance records indicated that only Kassandra Burton, CCSM 1, and CCSM 2 were ever used to provide child care in the home. I compared the names on the attendance records with the names in the Child Care Background Check System and everything matched. Only Kassandra Burton, CCSM 1, and CCSM 2 are listed as child care staff members in the Child Care Background Check System. Kassandra Burton produced the consent and disclosure forms for CCSM 1, CCSM 2, and herself and they were filled out completely and accurately. CCSM 1 denied that any individuals have been employed without a comprehensive background check. She said she has been employed since February 2023 and the only child care staff members who have provided care with her are Kassandra Burton and CCSM 2. CCSM 1 said she was required to have a comprehensive background check before she began employment in the child care home. She denied ever seeing any regular visitors to the home or ever working with a "substitute" child care staff member who may not have had a comprehensive background check. On August 30, 2023, I spoke to CCSM 2, Child A & B's Mother, and Child C & D's Mother about the allegation. CCSM 2 acknowledged that she has only worked part- time in the child care home since March 2023, but she denied ever seeing anyone working with children that might not have had a comprehensive background check. She has only worked with Kassandra Burton and CCSM 1. She has never seen frequent visitors to the home or heard about her using any "substitute" child care staff members who may not have had a comprehensive background check. Child A & B's Mother said she has only ever seen Kassandra Burton, CCSM 1, and CCSM 2 in the child care home. She denied any further knowledge of the allegation. Child C & D's Mother said that she has only ever seen Kassandra Burton, CCSM 1, and CCSM 2 in the child care home. She said there was one other child care staff member who had worked in the child care home a long time ago, but she resigned and that is when CCSM 1 was hired. On August 29, 2023, I made an onsite inspection to the child care home and spoke to Kassandra Burton and CCSM 1 about the allegation. Kassandra Burton admitted that she recently went through a divorce but denied having a boyfriend or dating anyone right now. She said her ex-husband just moved out of the home two weeks ago and still had a couple belongings in the home to pick up but said most of his items were gone. She thought maybe the allegation was coming from a social media post she made as a joke on her social media account a few days ago where she posted a meme that said, "My mom said get yourself a confident fella and I heard convicted felon in my head." She said the joke was in reference to her making some bad choices in men when she was younger, and she thought it was funny. She was concerned that someone may have taken it seriously and said she would refrain from posting something that could become controversial in the future. Kassandra Burton reiterated that only she and her two minor children reside in the household now. She said occasionally she will have a friend come spend the night on the weekends, but it is not on a recurring basis. She also had a friend leave their vehicle in her driveway for the week when they went out of town. Kassandra Burton knew that if anyone ever wanted to move into the child care home, she would need to complete a comprehensive background check on them before they moved in. Kassandra Burton took me into the master bedroom and showed me her closet that only had women's clothing in it. She showed me the closet that her ex-husband had used, and it was nearly empty with only a few items hanging inside. She pulled the items out and showed me that they were women's clothing and said they belonged to her. She pointed to some men's cologne on the dresser and said that belonged to her ex-husband but suggested it was something he had forgotten or did not want. Kassandra Burton gave me a tour of the rest of her home, and I did not find any evidence that anyone else was residing in the home with her and her two minor children. CCSM 1 stated that she has never seen any men coming or going from the child care home, visiting during child care hours, and denied any knowledge about Kassandra Burton dating anyone. She said to her knowledge, only Kassandra Burton and her two minor household members reside in the home. On August 30, 2023, I spoke to CCSM 2, Child A & B's Mother, and Child C & D's Mother by telephone. CCSM 2 denied any knowledge about Kassandra Burton dating anyone and said she has never seen any men coming or going from the child care home. She stated that only Kassandra Burton and her two minor household members reside in the home since her ex-husband moved out recently. Child A & B's Mother said she drops her children off early in the morning and she has never seen anyone in the home except Kassandra Burton, her two minor household members, CCSM 1, and CCSM 2. Child C & D's Mother stated that she has only ever seen one man in the home and that was Kassandra's ex-husband before she got divorced. She stated that only Kassandra and her two minor household members reside in the home since he moved out.
R 400.1910 · 1 R 400.1910 Ratio of personnel to children. (1) The ratio of personnel to children present in the home at any 1 time must be not less than 1 member of the personnel to 6 children. The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. On August 29, 2023, I made an onsite inspection to the child care home and spoke to Kassandra Burton and CCSM 1 about the allegation. Kassandra Burton said that both CCSM 1 and CCSM 2 have completed their training for this calendar year and they both only started their employment at the child care home in 2023. She said they have completed Health and Safety Training for Licensed Child Providers Parts 1 & 2, infant safe sleep, and other trainings in MiRegistry. She said they both should have more than the required five clock hours of training for this calendar year. Kassandra said she has not yet completed all 10 clock hours of training she is required to obtain for this calendar year, but she is aware that it needs to be completed before December 31, 2023. She denied employing any other child care staff members in her home. I logged into MiRegistry and saw that CCSM 1 has completed 10 clock hours of training for 2023 which included Health and Safety Training for Licensed Child Care Providers Courses 1 & 2, Safe Sleep Practices for Caregivers, and Infant Safe Sleep for Michigan Child Care Providers. CCSM 2 had completed nine clock hours of training in MiRegistry this calendar year. She has completed Health and Safety Training for Licensed Child Care Providers Courses 1 & 2, and Infant Safe Sleep for Michigan Child Care Providers. Kassandra Burton became a licensed child care provider on October 12, 2022. In calendar year 2022, Kassandra Burton completed 18 clock hours of training, including Health and Safety Training for Licensed Child Care Providers Courses 1 & 2, Infant Safe Sleep for Michigan Child Care Providers, Michigan Ongoing Health and Safety Training Refresher 2022, Child Care Licensing Family and Group Home Orientation, and the Facilities Improvement Fund (FIF): Tax Implications.
