(8) To comply with section 3c of the act, MCL 722.113c, a licensee shall have a policy and procedure on smoking and vaping that includes all of the following: (a) Ensure that smoking and vaping do not occur in child-use space, on the premises of a child care home while children are in care, and in a vehicle when used to transport children who are in care.
On 02/18/2021, I spoke with Stacy Tomczak, Child Care Licensing Consultant and asked her were there any concerns in regards to Ms. Adams, licensee and she stated no, she met her one time last fall when she completed an interim inspection and there were no concerns at that time. On 02/18/2021, I attempted a phone call with the complainant. A voice message was left. On 02/18/2021, I made an onsite inspection and met Jolene Adam's, along with Janet Wallace and Crystal North, child care staff members, separately. Ms. Adams denied all of the allegations. Tyler Adams, adult household member (AHM1), does reside in the home and remains upstairs. He does smoke but does so outside, not on the property and not when child care is in session. She has not smelled any smoke in the basement. She has not been over in capacity or ratio and her numbers have been down since covid. In fact, she has had the child care staff work but they are not working a lot of hours since covid. Some of her families have not come back since covid started. Ms. Adams states she does not yell at the children but does raise her voice or get louder sometimes when the children are not listening, however she does not yell at them. I met with Janet Wallace who has been a child care staff member for the past four years. She has not smelled any smoke around the house. She does know AHM1 smokes but he goes outside to smoke. She reports that there have not been over 12 children in the child care at one time. Lastly, she states she has not heard Ms. 3 Adams yell at the children, but she has raised her voice. I met with Crystal North, who has been working at the child care home for the past 9 years and absolutely loves it. Ms. North just hesitantly said everything was ok. I reviewed records for eight children and three staff members present. I also reviewed the child care attendance for the past couple of weeks and did not find any discrepancies; although the arrival and departure times of the staff members were not listed. On 02/19/2021, I spoke with Crystal North. Ms. Adams is threatening to her. She believes that Ms. Adams has been over capacity and over ratio but does not know the dates. On one occasion last fall, there were a lot of children in care and it was only she and Ms. Adams caring for the children that day. Also the AHM1 does smoke marijuana upstairs during child care hours because she has smelled it while being downstairs. Ms. Adams takes cigarette breaks throughout the day. She does not smoke in the child care area but she has smelled cigarette smoke before. On 02/19/2021, I spoke with Brianna North, a previous AHM2. Ms. North resided in the child care home from October 2020 to January 2021, as she was dating AHM1. AHM1 has smoked marijuana upstairs in the past. She has a picture of him smoking marijuana at the kitchen table on 01/11/2021. Ms. Adams allows him to smoke in the home. AHM2 states Ms. Adams does scream at the children at times. She is not aware if Ms. Adams is over capacity and ratio. On 02/19/2021, I received two photos. One was supposed to be a picture of AHM1 smoking marijuana at the kitchen table; however, I was not able to see if he was smoking. The second picture revealed 15 children present in the basement, in the child care use space. The date stamped on the picture was October 21, 2021. On 02/24/2021, I spoke with AHM1 who admits he smokes marijuana but does not smoke inside of the home. He knows he has to go outside off of the property and that is what he does. He is not aware of his mother caring for over 12 children at a time. On 03/09/2021, I spoke with Child A (female, 4.5 year old) and Child B's (female, 1 year old), mother; Child C's (female, 1 year old) mother; Child D (female, 8 years), Child E (female, 11 years) and Child F's (male, 1 year) mother; Child G's (female, 4 years) mother and Child H's (female, 1 year) mother.
