R 400.8740(1) · R 400.8740(1) Manufacturer’s rated seating capacity; restraint devices; safety belts (1) Each child transported shall be seated according to the manufacturer's rated seating capacity and properly restrained by a passenger restraint device pursuant to sections 710d and 710e of the Michigan vehicle code, 1949 PA 300, MCL 257.710d and 2 57.710e.
There was insufficient evidence to support that Child A was not seated properly while being transported by the center.

On October 3, 2025, I observed that bathrooms designated as emergency spaces are also being used as storage for multiple items limiting how many children and caregivers will fit in the room in the event of an emergency.

During the inspection on October 3, 2025, I received a child attendance log that should 16 children for 3 caregivers in a 1:4 ratio room. Leaving the room over ratio by 4 children.

Per the center's records, the Pre-k classroom was out of ratio on 10/22/2025 from 10:31a.m. to 10:52a.m. with a 2:21 child care staff member to child ratio. The youngest children in the room were three years old thus requiring a 1:10 staff member to child ratio.

On 08/13/2025 during circle time with Child A would not sit for circle time, so Teacher 1 forcefully picked him by one arm to move him to a chair. As Teacher 1 moved Child A, he was crying and fighting her. Child A's legs were dragging across the floor as he was being moved.

Approved ratio and maximum group size was not maintained in the Discovery Preschool classroom on 08/25/25, 08/26/25, 08/27/25, 08/28/25, 08/29/2025 or 09/02/25. The approved ratio for the classroom is 1:8, with a maximum group size of 24 children. Child A (29-month-old) was moved up from the toddler room and requires a 1:4 ratio with a maximum group size of 12 children for her age.
