(10) Written approval from the department must be obtained before making any changes in the terms of the license, including but not limited to, adding use space, changing age groups served, changing program components, changing the capacity of the center, or making changes to a room or well-defined space that will result in a change in capacity of the room or well-defined space.

During an onsite inspection at Havel Elementary it was reported by office staff that the preschool class was relocated to another school in the district. The staff person thought it was possibly relocated to Harvey Elementary. On December 19, 2022, this consultant sent an email to the licensee designee's Cheryl Wajeeh-Piwko, Cassie Edwards, and Cheryl Whiteman to inquire if the information of the preschool relocating to Harvey was correct. After receiving no response, a 2 subsequent email was sent on January 13, 2023, regarding an update/status on the email sent on December 19, 2022. On January 13, 2023, Ms. Wajeeh-Piwko responded that the preschool program was moved from Havel Elementary to Harvey Elementary at the beginning of the school year in September of 2022. She reported that she thought the classroom was approved in the past for preschool. I reviewed the file and it showed no early childhood programs had been approved at this location since 2014. On January 18, 2023, I emailed Ms. Wajeeh-Piwko to confirm a modification request is needed in addition to lead, environmental health, program director information, staffing plan, and equipment list. I provided technical assistance and reminded Ms. Wajeeh- Piwko of the of the requirement to request a modification to the terms of the license any time the age range or rooms move location. Ms. Wajeeh-Piwko was advised to cease operation as she is operating out of the terms of the license as the location had only been approved for school-age since 2014 and not preschool age children. It was further noted that the school-age program had not been in operation at this location since the pandemic in 2020. On January 19, 2023, I interviewed Ms. Cheryl Wajeeh-Piwko and she reported that they will cease operation immediately. The preschool program will be relocated to the Walsh Early Childhood center as there is an empty classroom at this location that is currently approved for preschool child care. She emailed the modification request to the department and also reported that she has sent off her request for lead and environment health inspections and anticipate having the inspections completed within the next two weeks. On January 24, 2023, I conducted an onsite investigation. The preschool program was no longer in operation. I inspected the classroom and there were no visible hazards observed. On January 24, 2023, the environmental health inspection was completed and approved the use of room #14, the stage and gymnasium. On January 31, 2023, I conducted an exit conference with Ms. Wajeeh-Piwko. I updated Ms. Wajeeh that I received the environmental health inspection and the areas were approved. She reported that the lead inspection should occur within the next week and she would forward the report to the consultant. Ms. Wajeeh-Piwko was advised that the investigation would be closed out so the modification request could be approved once all the inspections and final paperwork is submitted. 3

R 4OO.8167(3 Indoor space. (3) A center shall provide a floor plan of all child use areas to the department at initial licensure and before making structural changes or adding any child use space. Only space that has received prior approval for child use by the I department may be used for child care.

(8) A lead hazard risk assessment must be completed by a certified lead risk assessor on all centers built before 1978. Any lead hazards identified must be addressed as noted in the lead hazard risk assessment report before issuance of the original license. The results of the assessment must be kept on file at the center. Centers that operate in a school building serving only school-age children are exempt from the requirements in this rule. 4

The licensee designee allowed preschool-age children to use a room that had not been inspected and approved by a certified lead hazard risk assessor.
