On 3/30/2023, I conducted an unannounced onsite inspection at Kid's Zone. I noted that staff park on the north side of the parking lot/driveway of Kid's Zone. The driveway and parking lot are both situated on the Kid's Zone property. There was no one in the parked cars when I arrived. When I entered the child care center, I was informed by CCSM 4 that due to recent staffing changes at the center, there currently was not an approved program director at the center and she was in charge. Regarding the allegation, CCSM 4 stated that she has never seen CCSM 2 or any other staff member smoke or vape on the center's property. CCSM 2 was interviewed during the onsite and stated when she first started working at the center, she was unaware that she could not vape in her car and was allowed to do so by the previous program director. When she learned that vaping is not allowed in the parking lot, she immediately stopped. She stated that it has been several months since this occurred. CCSM 1 stated that the previous program director allowed CCSM 2 and another CCSM who is no longer employed at the center to vape in her car during breaks while parked in the center parking lot. CCSM 1 added that she has not seen it happened since the previous program director left Kid's Zone. CCSM 3 stated that she has never seen anyone smoking or vaping on Kid's Zone property. I interviewed Child A's, Child B's Mother and Mother Child C's Mother via phone. None of the parents had information relevant to this allegation.
Child Care Staff Member (CCSM) 2 vapes in her car on the child care center's property at lunch. Staff are not providing appropriate care and supervision of children. CCSM 1 talks down to children, CCSM 3 sleeps on the job, and other CCSM's are always on their phones. CCSM's don't wash their hands after diaper changes and do not use the three step process of wash, rinse and sanitize for cleaning surfaces such as diaper pads.

Program director Ms. Michaela Burnham threatens Child A (male, ) if he does not listen to his teachers telling him she will take him into the bathroom and spank him. Ms. Burnham has been observed taking Child A into the bathroom. Ms. Burnham threatens Child B (male, ) by yanking his arm and screaming in his face. Ms. Burnham pulls Child B in the kitchen/office where children are not allowed because it is an unsafe area. The center does not maintain required child care staff member to children ratio due to being short staffed, frequently during lunchtime. On 02/23/2023 a second allegation was received indicating Child A was neglected by staff when staff withheld his medication. Child A's medication was left in Child A's lunchbox and staff took pictures with personal cell phones of the label. Medication was not secured properly. On 02/23/2023 a third allegation was received indicating Child A was neglected by staff when staff withheld his food. On 02/23/2023 a fourth allegation was received indicating Child A was neglected by staff when staff did not diaper Child A adequately. On 02/23/2023, a fifth allegation was received indicating Ms. Hang did not make the staff member that assaulted Ms. Burnham leave the building while Child A and Child A's Father was present. Ms. Hang said the altercation between two staff members was hearsay until she reviewed the videotape. She did not notify parents of children in care that an altercation occurred while children were present in care.

When informed of the allegation that she talks down to children, CCSM 1 stated that she does not yell, talk down or speak harshly to the children in care at Kid's Zone. CCSM 2, CCSM 3, and CCSM 4 stated that they have never seen or heard CCSM 1 or any other staff member interact with children in care in an inappropriate manner such as yelling or talking down to children. Child A's Mother, 3 Child B's Mother, and Child C's Mother indicated they have never heard any staff member at Kid's Zone talk down to children. CCSM 3 was interviewed privately informed of the allegation that she has fallen asleep while supervising children. CCSM 3 admitted that on at least one occasion she had "nodded off' while supervising children during nap time. She explained that she is working full time and going to school so she can be pretty tired at times. CCSM 1 stated that she was present in the room once when CCSM 3 "nodded off'. CCSM 1 added that she saw CCSM 3 head fall while sitting as if she was falling asleep, but CCSM 3 immediately lifted her head. CCSM 2 and 4 stated that they had never seen CCSM 3 fall asleep while she was supervising children in care. CCSM 1, CCSM 2, CCSM 3, and CCSM 4 all stated that personal cell phone usage is allowed at Kid's Zone to communicate with parents. During the exit interview, Ms. Hang confirmed that CCSMs are allowed to use their personal cell phones for daily communication with parents. During my onsite inspection, I did not see any CCSM using their cell phone during the course of my onsite inspection. I interviewed Child A's, Child B's Mother and Mother Child C's Mother via phone. All stated they feel their children receive high quality care and supervision at Kid's Zone and did not have any concerns with the level of care and supervision provided to children at Kid's Zone. APPLICABLE R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. ANALYSIS: On at least one occasion, Kid's Zone failed to provide adequate care and supervision to children in care when CCSM 3 fall asleep while supervising children during nap time. This was also witnessed at least once by CCSM 1. There is no evidence the CCSM 1 speaks inappropriately to children in care. LD Ms. Hang and all CCSM's interviewed during this investigation confirmed that they use their personal cell phones for parent contact throughout the day when children are in care. CONCLUSION: VIOLATION ESTABLISHED 4

(1) Except as provided in subrule (2) of this rule, diapering must occur in a designated diapering area that complies with all of the followin : 5 (f) Is washed, rinsed, and sanitized after each use.
All CCSM interviews were conducted in the office area of the child care center. The office area contains several video monitors with live feeds to all the child care rooms. While interviewing and between interviews, I was able to observe children washing their hands after using the bathroom, CCSMs changing diapers, and CCSMs washing their hands and the children's hands following diapering. I was also able to observe an activity table and the diapering stations to be properly washed, rinsed and sanitized as required. During my interviews, CCSM 1, CCSM 2, CCSM 3 and CCSM 4 were all able to describe the three process for washing, rinsing and sanitizing surfaces including diaper pads. All CCSM's stated that the three-step process is followed for all surface cleaning/sanitizing including tables, countertop, and diapering. They also confirmed that CCSMs at the center are trained to have children wash their hands after toileting and/or diaper changing. All the CCSM's interviewed during the onsite denied ever seeing any coworkers at the center fail to wash their hands or the hands of children following toileting or diapering. Child A Mother, Child B's Mother and Child C's Mother did not have any information relevant to this allegation.

On 01/19/2023, Witness 1 stated she has never seen program director Ms. Michaela Ann Burnham spank a child. She has heard Ms. Burnham threatening Child A with a spanking. If children would hit each other, Ms. Burnham would say to the child, "Do you want me to hit you?" Witness 1 does not recall Ms. Burnham ever yanking children or yelling at them. She has seen Ms. Burnham taking children into the kitchen/office if they are naughty. During the holidays she heard Ms. Burnham threaten Child A. She told Child A if he touched the Christmas tree, she would break his fingers. Witness 1 does not recall anything specifically said to Child B. Ms. Burnham would also threaten Child A by telling him he will go to his mother's house if he is naughty. On 01/31/2023, I explained the allegations to child care staff member (CCSM) 1. She stated she has never heard threats for spanking nor ever heard Ms. Burnham threaten Child A with breaking his fingers if he touched the Christmas tree. She has not seen Ms. Burnham yank any child's arm. She has observed children taken into the kitchen/office. However, she does not know for what reason. She has not heard Ms. Burnham ask children if they want to be hit. On 01/31/2023, CCSM 2 stated she has not heard of threats of spankings or witnessed Ms. Burnham spanking any child. She has not observed any child yanked rj or yelled at. She has observed children in the kitchen/office but not sure why children are taken in there. On 01/31/2023, CCSM 3 stated she observed Ms. Burnham threaten to spank Child A in the bathroom and did see her take him in the bathroom. However, she does not know if she spanked him or not. CCSM 3 has observed Ms. Burnham yell at Child B to stop what he is doing. On one occasion, Ms. Burnham gave Child A straight juice so Child A would have excessive the whole time he is with his mom on a trip. Ms. Burnham does put children in "time out" in the kitchen/office, sitting children in front of the stove or sink On 01/31/2023 while onsite, CCSM 4 stated she heard Ms. Burnham threaten to spank Child A with Child A's Father present. She observed Ms. Burnham take Child A into the bathroom to spank his bottom one time, between Christmas and New Year. At Christmas time she did hear Ms. Burnham threaten to break Child A's fingers if he touched the tree. CSM 4 did not hear or witness Ms. Burnham yanking Child B's arm or screaming in his face. Ms. Burnham would give Child G (male, ) a time out and Child B a time out in the kitchen/office for inappropriate e avior. On 01/31/2023, CCSM 5 stated she has never seen or heard Ms. Burnham spanking or threatening to spank Child A. She has not witnessed her yanking any child. She has observed children being taken into the kitchen/office for time out with Ms. Burnham being a litter harsher (verbally) than she should be. CCSM 5 and other staff were given the impression from Ms. Burnham that "time out" in the kitchen/office was okay to do. CCSM 5 did not know that the kitchen/office was not approved for children. On 02/01/2023, during a phone interview, program director Ms. Michaela Burnham stated she has never threatened to spank Child A. She denied ever laying a hand on him. She redirects children. She would never threaten to break his fingers if he touched the Christmas tree. When children are arguing, she separates the children and talks to them about the problem. She denied ever threatening to send Child A to his mother's home. Child A's parents have been divorced two years and Child A's Mother Child A so she would never threaten to send him there. cTh11d B is not in her classroom. When she combines the Toddler 2 (T2) and preschool rooms, she only takes care of her assigned children, not T2 children. Ms. Burnham stated she has added locks on the kitchen/office cabinets in case a child slips into the kitchen/office and opens a cabinet that has chemicals or serrated edges. On 01/19/2023 during a phone conversation, Witness 1 stated the center is out of ratio quite a bit due to a staffing shortage. Preschool, School age, and T2 rooms would be combined in one room with two workers, not following a ratio of 1 childcare staff to 4 children. On 01/31/2023, I arrived at the center and spoke to CCSM 1. CCSM 1 said program director Ms. Michaela Burnham was out sick and not present at the center. I informed her of the allegations. I walked through the center counting children and staff. The infant room had six infants in care with two staff members. The toddler/crawler (T/C) classroom had eight children present with two staff members. T2 classroom had thirteen children present with two staff members with the youngest being Child K (male, ). On 01/31/2023, CCSM 3 stated she believes Ms. Burnham will cut employee hours if she does not like the employee. During the previous week, Ms. Burnham combined 19 preschool and T2 children in the T2 classroom. Ms. Burnham was working in the T2 classroom and refused to help with any care, including primary care responsibilities. On 01/25/2023, CCSM 3 said she went outside by herself with T2 and preschoolers with Ms. Burnham inside doing paperwork. CCSM 3 stated she was told by Ms. Burnham the ratio for T2 and preschool combined is 1 child care staff member to 8 children. I informed CCSM 3 the ratio is determined by the youngest child present. With Child K present, the ratio is 1 child care staff to 4 children, with a maximum room capacity of 11. On 01/31/2023, CCSM 4 stated the center has been out of ratio since Ms. Burnham combined preschool and T2 room. CCSM 4 contacted Ms. Hang about the ratio issue on 01/28/2023. Ms. Hang told her she had no clue it was happening at the center. Mid to late October 2022, Ms. Burnham began combining the classrooms. Ms. Burnham said she needed an assistant for her group of six preschoolers due to toileting. Since combining the groups, T2 was out ratio most days. CCSM 4 informed Ms. Hang the center has gone downhill. On 01/31/2023, CCSM 5 stated the center has been out of ratio between 4-5 months when T2 and preschool children were combined by Ms. Burnham. Ms. Burnham told her she could not be alone with her preschool children because she was toilet training one child. On 02/01/2023, Ms. Burnham stated the only employees she has terminated are those that never show up for work or that went ballistic. Due to the staff shortage, she has only been able to teach preschool 4 days in November and 9 days in December. She said she does four jobs in one day which is ridiculous. Ms. Burnham stated the ratio is 1 staff to 8 children in the preschool room. Ms. Burnham denied sending CCSM 3 outside alone and said two staff went outside with her. On 02/13/2023, CCSM 4 stated Child A's Father would come to the center and hang out on multiple occasions. Sometimes he would visit with Ms. Burnham 30-60 minutes. They would talk when she could have been helping staff with children in care. On 02/13/2023, CCSM 1 stated the center is out of ratio at times and it can happen for a short minute if the bus arrives. There has been staff turnover and rooms have been shut down when not enough staff are available for the number of children scheduled. On 02/13/2023, CCSM 6 stated the C/T room was never out of ratio. However, the T2 room was out of ratio a lot lately due to staff shortage. On 02/16/2023, Child A's Mother stated she has seen wall to wall children with little staff at the center. Child A's Mother did not state which dates this occurred. On 03/15/2023, Ms. Burnham stated the T2 and preschool rooms were combined some days in November 2022, December 2022, and January 2023 due to staff shortages. The center has not maintained ratio for a long time. Ms. Burnham stated on 11/19/2021 she was caring for 18 children by herself. This was because a lack of staff. Ms. Burnham stated sometimes rooms were closed because she was told to do so by licensing. I stopped

On 02/13/2023. CCSM 4 stated Child A's Father harassed her on 0211012023 over Child A's eyedrops, stating doses were missed and a lack of communication with lead teacher CCSM 3. Ms. Burnham never told CCSM 3 there were At 9:30 AM on 02/06/2023 is when a note was written in T2s communication book regarding the CCSM 3 gave Child A the second dose on 02/06/2023 and filled out theform; however, she missed writing it on the KZ DAILY MESSENGER sheet given to the Child A's Father at pick up. Child A's Father did not ask or talk to CCSM 3 regarding the even though she is the lead in the classroom. CCSM 4 felt like she was set up to fail by Ms. Burnham and Child A's Father. On 02/16/2023, Child A's Mother was contacted. Due to the severity of the weather, I requested Child A's Mother return my call when she is no longer driving. At 8:26 PM I received a return call. Child A's Mother stated her ex-husband, Child A's Father told her he filed allegations of neglect regarding medication within reach and accessible to other children. She was told staff left in the lunch box and no staff took them out. Staff took pictures of the the lunch box with personal phones, violating HIPPA. Child A's Mothetr hsaeidr dA 's Father told her he tried to discuss the medication with staff after the parent meeting on 02/08/2023 and the door was slammed in his face. On 03101/2023, CCSM 3 said she became aware of the medication for Child A on 02/06/2023. Ms. Burnham never talked to her about the medication prior to that date. She is unsure of who put the medication in the cabinet on 02/06/2023. She is aware that CCSM 4 found medication in the lunchbox but does not recall what day it was. CCSM 3 did not take a picture of the medication and to her knowledge no other staff member did either. Child As Father said he had a picture of the medication but did not show it to her. Child A's Father said someone sent him the picture, CCSM 3 or CCSM 1. He stopped CCSM f in the hallway outside of the bathroom. She denied sending the picture and retrieved her cell phone and showed him she did not text him. CCSM 3 said Child A's Father never communicated with her. CCSM 3 stated she did in fact give Child A two times on 02/0612023 but forgot to document one dose on the KZ DAILY MESSENGER sheet she sent home. Sometimes she makes an error without meaning to and corrects it when she is able. CCSM 3 showed me another time she forgot to write something on a form but sent the parent a text message correcting the error. On 03/0112023 Ms. Hang stated the center follows specific procedures for medication. Procedures are as follows: • A parent arrives with medication for their child. • The parents fills out the required medication form. • Medication is stored in the locked cabinet in thekitchenfoffce. • The parent talks to the program director and lead teacher, giving speck details. • The medication form is given to the lead teacher and the lead teacher writes the information in the classroom's communication book. • The staff gives the medication as directed with a second staff member overseeing the process. The staff member documents the medication given on the medication form. Staff also writes it on the KZ DAILY MESSENGER form. Ms. Hang asked Child A's Father if he ever talked to CCSM 3 regarding the medication. Child A's Father said he did not talk with CCSM 3 or CCSM 4 regarding the medication. Child A's Father told Ms. Hang he talked with Ms. Burnham regarding the when Child A was first was _ On 0310212023, CCSM 4 stated she did not take a picture of the medication in Child A's lunch box. Ms. Burnham told her on 0112612023 that Child A was due for his Ms. Burnham did not tell the lead, CCSM 3, Ms. Burnham would not talk to CCSM 3. CCSM 4 said she kept telling Ms. Burnham she should speak to CCSM 3 as she is the lead. CCSM 4 said Child A's Father did not fill out the medication form with her, but probably with Ms. Burnham. On 02/16/2023, Child A's Mother stated she was told by Child A's Father that some of Child A's food was not opened for him to eat. On 03/01/2023, CCSM 2 was preparing lunches for children in the T2 classroom. CCSM 2 was in the kitchen/office, wearing gloves and had each child's lunch box open. CCSM 2 stated she gathers the lunch boxes, paper plates, and opens all the children's food. Any food that may need reheating she heats in the microwave. Children are served all their food and any food not eaten is thrown away. On 03/01/2023, CCSM 3 stated lunch boxes are kept in children's lockers. She said when she is preparing lunch, she retrieves the lunch boxes, heats foods and put the food on the plates for all T2 children. She has never withheld food from a child. On 03/01/2023 CCSM 7 stated Child A was given all of the food parents provided On 03/02/2023 CCSM 4 stated the process for eating in T2 is as follows: • One staff member sits with children. • Second staff sets up the tables and goes through lunch bags. Warms needed foods and plates the food. Many children do not like the food to touch each other. • Child A sometimes eats good then other times not. About 90% of the time, he has chicken nuggets. CCSM 4 said she would give the healthier foods first and then when at least 50% of the main food eaten, then the sweeter foods. After he is done eating, food is tossed out. • Food eaten is documented. On 03/07/2023, CCSM 7 stated Child E's Mother would pack his lunch and he would bring it to the center. Child E also attended another educational program in the morning so Child E would eat lunch when he returned to Kids Zone. CCSM 7 stated Child E's Mother would generally pick him up at the end of nap before snack but sometimes she would be late. CCSM 7 would reserve a few chips from his lunch for an afternoon snack in case Child E was present during that time. Child E would also wake from nap and run to his lunch box for something to eat. If there was not something in it for him to eat, he would be upset. Some parents participate in the snack program at the center while others choose to provide their child a snack. CCSM 7 said she never withheld food from any child. On 03/15/2023, Ms. Burnham discussed issues with Child A being fed at child care, which Child A's Father then discussed as well. Child A's Father would pack his lunch and kids at Kids Zone only get what was sent in their lunch. Child A's Father then discussed his concerns regarding Child A not being fed and went through all of his evidence and concerns related to this. On 03/28/2023 I reviewed Child A's KZ DAILY MESSENGERS for food intake. The staff maintained written documentation for the percentage eaten for AM snack, lunch (main, vegetable, fruit, other), and PM snack. In addition, staff writes next to each heading the type of food provided. Three dashes (---) represent no food marked or eaten. On 02/16/2023, Child A's Mother stated she was told by Child A's Father the center's toileting schedule has too much time in between toileting. W On 03/01/2023, CCSM 7 stated Child A was toileted and had his diapers changed often. On 03/02/2023, CCSM 4 stated diapering happens every hour to two hours. Child A is toilet training. He did not like sitting on the toilet and it would be a chore to get him to sit. Once sitting, CCSM 4 stated she would sit nearby on the foot stool, talking to him, and praising him. On 03/28/2023 I reviewed Child A's KZ DAILY MESSENGERS for his diapering and toileting schedule. The staff maintained written documentation for P for potty, W for wet, BM for bowel movement, D for dry, L for loose stool, C for cream, and T for tried (toileting). The diapering/toileting was observed to be spaced out appropriately with the rest time having an appropriate gap for diapering/toileting. Child A attended the center on a part-time basis during Child A's Father's parenting schedule. Child A would attend between 9.5 hours to 10.0 hours each day he was present in the center. R 400.8330 · R 400.8330 Food services and nutrition generally. (9) A center shall not deprive a child of a snack or meal if the child is in attendance at the time when the snack or meal is served.
On 02/11/2023, I received a text message from Ms. Burnham stating a staff member hit her and she went for medical care. During a phone conversation with Ms. Hang on 02/12/2023, she stated there was an altercation between Ms. Burnham and CCSM 4 on 02/10/2023 at about 2:00 PM. In the afternoon, Child A's Father came to the center to talk with her regarding issues with how staff were administering medication to Child A. She, along with Child A's Father, CCSM 4 and Ms. Burnham were in the preschool classroom with no children present. Child A's Father accused CCSM 4 of not administering the medication correctly. CCSM 4 was upset and said she was done hearing his and Ms. Burnham's lies, and she was leaving the center. Ms. Hang said she continued to talk with Child A's Father. CCSM 4 exited the preschool classroom to get her belongings from the office. CCSM 4 returned to the preschool room and continued talking with Child A's Father. Shortly after, Ms. Burnham returned and said CCSM 4 assaulted her. Ms. Hang said she told CCSM 4 to leave the building and she would call her. Ms. Hang then told Ms. Burnham she had to leave to get her children and they would talk at a later time, and she would review the video. On 03/01/2023, Ms. Hang stated CCSM 4 exited the building within 7 minutes after the altercation. Prior to the altercation, Child A's Father was arguing with CCSM 4. Ms. Hang said CCSM 4 said she was upset, and she was done being harassed by Ms. Burnham and Child A's Father. CCSM 4 accused both Ms. Burnham and Child A's Father of always lying. CCSM 4 said she was done and told Ms. Hang she was leaving. CCSM 4 went to get her things to exit the building. Ms. Hang reviewed the videotape and observed during that period, CCSM 4 and Ms. Burnham had a heated argument in the kitchen/office. CCSM 4 exited the kitchen/office, then Ms. Burnham said something to CCSM 4. CCSM 4 went back in the kitchen/office, continued the heated argument, swatted Ms. Burnham with an open hand on the back of Ms. Burnham's head, exited, and gathered the rest of her belongings. On the way out of the building, Child A's Father engaged CCSM 4 in further discussion while he was sitting on the table, chewing gum, and swinging his legs. Ms. Burnham came back in, walking by CCSM 4 in a calm manner, and stood with her hand on her hip. Ms. Burnham said CCSM 4 assaulted her and said she may have to file a police report. Ms. Burnham went back in to the kitchen/office to finish working her shift. On the day of the altercation, Ms. Burnham clocked in 6:42 AM and clocked out 5:20 PM. The altercation was at about 2 PM. Child A's Father stood up. Ms. Hang disenrolled Child A on 02/10/2023. Ms. Hang was unaware Ms. Burnham went to the hospital on 02/10/2023 until over the weekend. Ms. Hang talked with CCSM 4 and asked if she did indeed hit Ms. Burnham. confirmed that she did and was very sorry 31 and she knew it was wrong. Ms. Hang said she could not allow her to work at the center with her behavior. Ms. Hang said CCSM 4 told her over the weekend the police came and interviewed her regarding the altercation with Ms. Burnham. Ms. Hang provided a copy of the letter sent to families regarding the altercation between staff: "Dear KZ Families, After conducting our own investigation, we want to notify you that there was an altercation between two employees on February 10 during business hours, which has now resulted in allegations of assault charges against one. The altercation happened in a room that is separate from the children and other staff members. Both employees are also no longer employed with Kids Zone. It is unfortunate that certain things had lead to that event, all of which we do not tolerate. Although, we have not been contacted by local law enforcement or licensing regarding this, we will provide them with anything that they may need to aid in their investigations. I am heartbroken, upset and disappointed that something like this has happened under our ownership. We

Ms. Burnham failed to administer day-to-day operations at the center and did not address parent, child, and staff issues in an appropriate manner regarding the following: • Ms. Burnham was observed to inappropriately discipline children using unapproved space for time out, prevented children's movement during nap and when a child acted inappropriately. • Ms. Burnham did not ensure compliance with required staff to children ratio when she had an insufficient number of staff for the number of children in care. Aware of the issue for months she did not correct it to meet compliance. • Ms. Burnham was aware child care staff were not administering Child A's medication correctly. She talked with staff; however, she could not get the staff to comply. Instead of retraining staff and supervising staff she told Child A's Father to talk with Ms. Hang. • Ms. Burnham was unprofessional on multiple occasions when talking with parents of children in care and talking inappropriately about staff and parents.

On 10/22/2021, I interviewed the Complainant via the telephone. The Complainant stated that she believed the video she had seen posted of Ms. Adrianna Mediana alone with seven children was taken sometime within the last week. The children appeared to all be infant or toddler age and no other adult was visible in the post. On 10/22/2021 I completed an on-site inspection. I explained the allegation to program director Ms. Michaela Burnham. Ms. Burnham reported that she had just recently been made aware of the allegations because the center had received an email stating that child care staff member Ms. Adrianna Mediana had been alone with seven child care children. Ms. Mediana was hired on 11/30/2020 and has always worked in Room 2, the crawler and toddler room, for children between the ages of 11 months to one year. Ms. Mediana has never been left with seven children to care for on her own. There is always another caregiver present in the room when needed to maintain the required one caregiver to four children ratio. Ms. Burnham shared the attendance sheets dated 10/11/2021 through 10/15/2021 for the children and caregivers who were present in Room 2. When cross-referencing the attendance records, at no time did the record show more than six children in care at one time. During the times when more than four children were in attendance, there were two child care staff members also in attendance. On 10/22/2021, I interviewed child care staff member Ms. Sarah Holland. She reported that she was unaware of any pictures that had been posted via social media. She works at the center as a floater, filling in as a caregiver, wherever she is needed. During the week of 10/11/2021 through 10/15/2021, she only worked with Ms. Mediana on 10/15/2021. She stated that she did not recall Ms. Mediana having been left alone with seven child care children. If a caregiver is left alone, it is only when all of the children are asleep and the other caregiver takes a break or goes to lunch. There is always another person available at the center to help in the room if needed. She further reported that she does not have any concerns with Ms. Mediana and the care she provides. On 10/22/2021, I interviewed child care staff member Ms. Adrianna Mediana. She reported that yes she had posted a picture on Snapchat a few weeks ago. She said the picture only showed her face and that maybe there might have been children in the background. "I don't remember what I said, I was stressed." She said that she has never been left alone with seven child care children and that there is always someone else available at the center to help if needed. "Unless all the children are asleep, then someone might leave and go to the kitchen." On 10/22/201, I interviewed child care staff member Ms. Emily Konieczny via the telephone. She reported that the only time she has witnessed Ms. Mediana alone with child care children would be during nap time and someone takes their lunch break. "If there are more than seven children we bring in another worker." She further reported that she has never been left alone at the center to care for children 4 and that there has always been other caregivers at the center who are available to help if needed. On 10/22/2021, I interviewed Child A's Mother via the telephone. She reported that she had not noticed Ms. Mediana alone with child care children. She stated, "There are at least two caregivers whenever I pick up." On 10/22/2021, I interviewed Child B's Mother. She reported that she has no concerns with the number of caregivers present. She stated, "There are always multiple caregivers... great daycare!" On 10/22/021, I left a voicemail message requesting a telephone call back from Child C's Mother. As of the date of this report, I have not received a returned phone call.
