R 400.8125(1) · R 400.8125(1) Staff; volunteer; requirements. All staff and volunteers shall provide appropriate care and supervision of children at all times.
The center failed to provide appropriate care and supervision when there were three separate incidents with Child A involving inappropriate sexual contact/behavior with other children.

R 400.8131 · R 400.8131 Professional development requirements. (10) All child care staff members who work directly which children are required to be trained in first aid and pediatric, child, and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center, and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child, and adult CPR. Each of these child care staff member's first aid and CPR certificates must be valid and retained on file in the center.
On December 22, 2020, I initiated my investigation by interviewing the Licensee Designee Kelly Biondo. I inquired with Ms. Biondo whether the center was open currently, and Ms. Biondo stated that the center is closed from December 21, 2020 through January 4, 2021. I informed Ms. Biondo that a complaint was received in concerns with the center and that an onsite inspection will be made upon their reopening. 2 On January 7, 2021, I conducted an unannounced onsite inspection. I arrived at the center at 1:15 p.m. On January 7, 2021, I interviewed Licensee Designee, Kelly Biondo. Ms. Biondo stated that the center has been closed due to COVID-19 and renovations as licensing has been aware. Ms. Biondo expressed that the center had just recently opened for a couple days before the holidays in December. Ms. Biondo stated that all of her child care staff members have completed their required state licensing trainings, and she would never leave any child care staff member alone with child care children before they complete the required trainings. Orientation is provided for new child care staff members. I reviewed the center's staffing plan and all of the child care staff members records that are currently employed and working at the center. I was able to verify in each child care staff folder the professional development requirements were completed by Jennifer Adkins, Amanda Allison, Kate Anderson, Kelly Biondo, Janice Hirsch, Angie Jarocki, Blerina Kalmeta, Shirley Liden, Lori Mason, Adele Puckett, Alyssa Smith, Coco Smith, Carolyn Welton, and Jessica Worcester that include CPR, first aid, safe sleep, bloodborne pathogens/ prevention and control of infectious disease, and the health and safety trainings that were completed through MiRegistry.

On January 7, 2021, I interviewed Licensee Designee, Kelly Biondo. Ms. Biondo stated that all her child care staff members have completed their required comprehensive background checks and are available to be reviewed at any time. Child care staff members complete comprehensive background checks prior to having contact with child care children. I was able to review and verify in each child care staff folder for Jennifer Adkins, Amanda Allison, Kate Anderson, Kelly Biondo, Janice Hirsch, Angie Jarocki, Blerina Kalmeta, Shirley Liden, Lori Mason, Adele Puckett, Alyssa Smith, Coco Smith, Carolyn Welton, and Jessica Worcester that their comprehensive background checks have been completed and all have been found eligible to work with children. All of the center's child care staff members eligibility letters as well as their consent and disclosure forms are on file at the center for review. 5

R 400.8131 · 1 R 400.8131 Professional development requirements. (4) Before unsupervised contact with children, all child care staff members who work directly with children shall complete prevention and control of infectious disease training, including immunizations.
During the onsite inspection on January 7, 20201, I was able to verify that the center has appropriate fire exit routes and that in each room there is an evacuation plan posted. The evacuation plan includes a diagram of the building that depicts the approved means of exits from the children's use areas and clearly leads the children and staff to the safe areas outside the building. The internal exit signs throughout the center are illuminated, clearly marked, and are consistent with the center's written procedures.

(e) Handling and storage of hazardous materials and appropriate disposal of bio-contaminants. (f) Precautions in transporting children, if applicable. Child development.
