    R400.1908 · R400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home. I

    On 02/15/20222, I spoke with Ms. Edwards about the complaint that she had more children in care than she was licensed for. Ms. Edwards stated that Spring Lake School District didn't have school last week. On Monday and Tuesday of that week her niece and nephew who are age 7 and 11 spent the day with her. She is always within her licensed capacity. I observed Ms. Edwards attendance and was able to confirm that Ms. Edwards only had six unrelated children. On 07/07/2022, I spoke with Child A's Mother. She stated that on 02/08/2022, she knows that Ms. Edwards had at least two additional children (between the ages of 5 to 9) in her care. She stated she observed at least seven or eight children in Ms. Edwards' care and that she only saw this once. On 07/07/2022, I spoke with Child B's Mother. She stated that she had never known of Ms. Edwards older children to providing care for the child care children and she has never been asked to pick up her children early or been told that they would be left with someone else if she didn't. On 07/08/2022, I spoke with Child C's Mother. She has never seen more than six children present. When she drops off there is usually only three or four children that and her son would make five.

    On 02/15/2022, I spoke with Ms. Edwards regarding the complaint. She stated that she is always home with the children and that she has never had another parent, or her older children provide care for child care children. She also stated that she has never asked parents to pick up their children early in order for her to run errands or get her hair done. On 07/07/2022, I spoke with Child A's Mother. She stated that her daughter has been attending Ms. Edwards child care only for a few months. Ms. Edwards has asked her on at least three occasions if she could pick her daughter up early because she had to run errands or ger her hair done. She stated that Ms. Edwards would tell her that if she couldn't come pick up her daughter, she would leave her with Ashley Frye and/or one of her older children. Child A's mother also stated that on one occasion Ms. Edwards asked her if it would be okay if her son watched her child. On 07/07/2022, Child B's Mother stated Ms. Edwards has never been asked to pick up her children early or they would be left with someone else. She has never seen or known of any of Ms. Edward's older children providing care for the child care children. She has never provided care for any children at Ms. Edward's house and is not sure why someone would say that she did or would. On 07/08/2022, Child C's Mother stated that Ms. Edwards is always there when she drops off and a pick up her son and she has never been asked to pick him early. She also stated that she has never known her adult children or any other person or parent to provide care for child care children.

    On 02/15/2022, I spoke with Ms. Edwards regarding the complaint. She denied that the children watch television all day. She does however admit that the television is on most of the day for back ground noise but no one is watching it. (1) A licensee shall ensure that all of the following requirements are met: (a) Each child shall be provided with nutritional and sufficient food pursuant to the minimum meal requirements of the child care food program, as administered by the Michigan department of education. These minimum meal requirements are based on the dietary guidelines for Americans made by the National Academy of Medicine, which are available at https://www.fns.usda.gov/cacfp/meals-and-snacks. This subrule does not apply to children whose parents provide their food.

    On 02/15/2022, I spoke with Ms. Edwards regarding the complaint. She stated that all of the children have water bottles or sippy cups, they have access to them through the day and can drink whenever they feel thirsty. Child A's Mother stated Child A has a water bottle that she provided. She noticed that most of the time when she picked her up her water bottle would be empty and out of her reach. Once when she arrived to pick Child A up, Child A was reaching up screaming for her water bottle. When she asked Ms. Edwards why Child A was screaming for water, Ms. Edwards said, "Oh, I was meaning to refill that". She filled the water bottle herself at least on three occasions. Child B's Mother stated she has no concerns with what her child is eating or drinking. Her child always has more than enough to drink. Child C's Mother stated she feels that her son gets plenty of water and liquids. On 08/03/2022, a follow-up phone call was made to Ms. Edwards regarding the children having access to water. Ms. Edwards stated that she has a water cooler that the children have access to all day as well as their own water bottle. She helps the younger children with their water bottles when they need it. She does not allow them to walk about with them so when they are empty, she puts them away until they ask for more water.
