On 09/15/2021, I received a complaint that Child A, (3-year-old female), was pulled from her cot by CCSM, Amber Rodriguez. The allegation read that Ms. Rodriguez admitted that she pulled Child A from her cot. The incident caused three marks on Child A's back. On 09/15/2021, I initiated the investigation by calling Christ the King Lutheran School. I interviewed the principal of the school, Dr. Kelly Kapp-Heifner. Dr. Kapp- Heifner said she is not the program director but because she was the principal of the school, she was very involved with the preschool as well as knowledgeable about the alleged incident. Dr. Kapp-Heifner said the incident allegedly occurred on Friday, 09/10/2021 after naptime. It was reported to her that one of the child care staff members, Amber Rodriguez, pulled a 3-year-old child from her mat and as a result, a child was injured. Dr. Kapp-Heifner suspended Amber Rodriguez from 9/13/2021-9/14/2021 while she completed an internal investigation of the allegations. Dr. Kapp-Heifner said Ms. Rodriguez also received a written reprimand. On 09/16/2021, I arrived unannounced to Christ the King Lutheran Preschool. I spoke briefly with Dr. Kapp-Heifner, explaining that I was going to interview child care staff members, Amber Rodriquez, and Sylvia Linares, who were both present during the time of the incident. Amber Rodriquez said, on Monday, 09/13/2021, Dr. Kapp-Heifner called her and said there were marks on Child A's back. Dr. Kapp-Heifner said Child A's parents said Child A told them she dragged Child A off her mat. Amber Rodriquez said she was surprised because Child A never said she was hurt and remembered Child A getting up from her nap and they played "peek a boo." When Child A got up, she rolled up her mat and went to sit on the carpet. Amber Rodriquez and Child A have a good relationship. Child A calls her big sister, and they often talk about Child A's big brother going away to college. I asked Amber Rodriquez if she had any thoughts or comments as to why Child A would say she dragged her off her mat. Amber Rodriquez said, "I have no idea why she would say that." Sylvia Linares said, on Monday, 09/13/2021, about 10:00am, Dr. Kapp called about the alleged incident." Sylvia Linares said she did not recall anything out of the ordinary happening on Friday, 09/10/2021. Child A was happy, cheerful, talkative, and didn't wake up sad. She recalled Child A smiling while waiting in line for the restroom. Sylvia Linares never received anything over the weekend from Child A's parents on Class Dojo. Class Dojo is a platform for parents and teachers to communicate throughout the day. I asked Sylvia Linares to please describe the kind of person Amber Rodriguez is. Sylvia Linares said Amber Rodriguez is friendly, well- liked, and kind. She also volunteers and participates in the summer camp and in 3 vacation bible school. Sylvia Linares said Dr. Kapp-Heifner showed her the pictures sent of Child A's back from Child A's mother. On 9/16/2021, I called Child A's mother regarding the allegations. Child A's mother said, On Friday, 09/10/2021, at 5:00pm, she and Child A's Father picked up Child A. When they got home that evening Child A went to use the bathroom. Child A's dad went in to wipe her and noticed some marks on Child A's back. He asked her what happened to her back and Child A said, "Ms. Amber pulled me off my mat and hurt my back." Child A's mother took out her phone and took pictures of the marks. The injuries looked like carpet burns. Immediately, Child A's mother sent an email to Dr. Kapp-Heifner. The email described what Child A said happened to her back and she attached the pictures she took of Child A. Child A's mother said she thought it was best she emailed Dr. Kapp-Heifner instead of emailing Sylvia Linares. I asked why. She said, "In knowing that Amber was Sylvia's daughter, I thought it was best to contact the principal; I didn't want there to be any conflicts." Child A's mother said she did not hear anyt
