    On 09/23/2022 I spoke with Champions School Age Area regarding the complaint allegation. stated she and Staff G spoke last week with Child D's Mother about the allegation. Child D's Mother stated she observed Child D and when Child D's Mother asked Child D if Child D that way, Child D stated Staff H did. stated that Staff H has been placed on administrative leave since this allegation was made. On 09/23/2022 I spoke with He stated _ met with Child D and Child D's Mother on 09/22/2022. Child D's Mother informed that Child D was no longer enrolled at the center. On 09/27/2022 I spoke with Champions Preschool Area Manager Tomico Dyson who stated Child D enrolled at the center last and attended the program during last school year. Ms. Dyson stated Staff H had been working at the center for the past _. Last school year Child D was in a classroom with Staff H. On 09/27/2022 I completed an on-site inspection to the center with and Southfield Police Department I interviewed regarding the allegation. stated Child D's Mother came to the center about two weeks ago and spoke with her. Child D's Mother was very upset and stated Staff H had Child D. - told Child D's Mother that Child D is not in Staff H's classroom this school year and Child D would only be in a classroom with Staff H if Child D attends the before and after school program. stated Child D's Mother brought up a concern alleging that one day last school year Child D was in the with Staff H when Child D's Mother arrived to pick up Child D. stated she did not know anything about whether this ened or did not happen as she did not work at the center last school year, stated last school year Child D was in Staff H's classroom and it would not abe uncommon for staff to have a child go with them to the to get something like a _. left after - was interviewed. and I then interviewed Staff I, Staff J, and Staff G individually. Staff I stated she has worked at the center for caregiver. Staff I stated Staff H has worked in her classroom since June . Staff I was aware that Staff H had not been working at the center the past few weeks, but Staff I did not 4 know the reason for this. Staff I stated she had no concerns about Staff H's care for the children. I asked Staff I about how staff handle toileting with the children. Staff I stated the children don't usually need help with toileting. Some children wear pull ups at nap time and some of the parents send wipes for their children. Staff I stated staff encourage the children to wipe themselves but occasionally a staff assists a child with wiping. Staff I stated when she helps a child wipe, she wears gloves and will say to the child, "I'm going to help you wipe". I asked Staff I about the center's procedures for opening and closing hours and which staff typically work at these times. Staff I stated there is usually one staff that opens the center at 6:30am until about 7:50am when more staff arrive. The children who arrive before 7:50am are all in one classroom and then around 7:50am when the other staff arrive, they take the children to other classrooms. Staff I stated around 4:30pm many of the children go home so the classrooms combine again until the center closes at 6:00pm. There are always two staff at the center until it closes. I asked Staff I if she or other staff let children help sweep, vacuum, or do any of the cleaning. Staff I stated neither she nor other staff let the children help sweep or vacuum. Staff I stated some of the children like to be "helpers", but a child would only be a "helper" in the morning during opening and not at the end of the day closing. Staff I stated at closing time, one staff is with the children and one staff cleans the rooms. Staff I stated she, Staff H, Staff J, and - are the staff who usually work at Staff J stated she has worked at the center for the past -, and she ■ . caregiver.     On 3/31/2021 I received a phone call from Ms. West-Gorman. She indicated that Child A's Mother reported an incident of inappropriate contact between Child A and Child Care Staff Member Josh Walker. Ms. West-Gorman informed me that Child A's arm was pinned between the doorway frame and Mr. Walker's body and the incident occurred when Child A tried to leave the classroom rather than do distance learning computer work. 2 On 04/07/2021 I conducted an unannounced on-site inspection at Magnolia Center. Upon inspection, I interviewed Ms. West-Gorman and Child Care Staff Member Alexis Herring. Mr. Walker was not available for an interview. He was not working on the day of the inspection. Ms. West-Gorman stated that Child A's Mother reported the incident to her. She did not observe the incident or notice any marks or injuries to the child. She indicated that Mr. Walker told her that he did not lean on Child A's arm or pin him in the doorway, but Child A did try to squish through the doorway as he stood in it. She stated she does not have any concerns regarding Mr. Walker's interactions with children. Ms. West- Gorman said that the center uses redirection methods when children are not following directions and physical discipline is never used. Ms. West-Gorman spoke to Child A's mother on 03/31/2021. She said she would investigate the incident. Ms. West Gorman verbally reported to the incident to me on 03/31/2021. I received a written report of the incident on 04/01/2021. A written report of the incident was received on 04/1/2021. I interviewed Ms. Herring. She did not observe Mr. Walker pin Child A's arm against the door. She did not observe any injuries to Child A. She does not recall Child A trying to leave the classroom or Mr. Walker standing in the doorway. Nothing stood out to her about Mr. Walker's interactions with children. Ms. Herring stated that physical discipline is never used. If children are not listening or following rules, she will flick lights on and off to gain attention of the children, sing songs to redirect, and use a count down. On 04/07/2021 I received a document consisting of an email and photograph from Child A's mother that was sent to Ms. West-Gorman. The photograph did not show any visible injury. There was a blue circle drawn around his left wrist, with Child A's mother's statement indicating that was the area that Child A said felt sore. I received and reviewed the center's discipline policy. The policy stated that staff are required to use positive techniques and to refrain from an unacceptable measure while caring for children. Unacceptable techniques include separation as a punishment, physical discipline, verbal or emotional abuse, disrespectful communication, withholding basic needs, and lack of supervision and child endangerment. On 04/07/2021 I spoke to Child A's mother. She stated that Child A told her that Mr. Walker leaned on his arm while he stood in the doorway and that his arm was sore. Child A's mother stated that Child A's arm appeared slightly red and was sore near the child's left wrist. She said she contacted Ms. West-Gorman to ask about the incident. She said she does not believe that Mr. Walker intentionally injured Child A, and she is aware that children can, "push buttons," from time to time, but wanted to let Ms. West- Gorman know about the incident so she could discuss the incident with Mr. Walker. She does not have any concerns with the child care center and feels safe bringing her children to care. She stated she likes Mr. Walker and approves of the care and supervision he provides to children. 3 On 05/05/2021 I spoke to Mr. Walker. He said he remembered the incident, but he was unaware that he pinned Child A's arm in the doorway. He said the class was transitioning from lunch to distance learning time. Child A was supposed to logon to his computer and begin distance coursework provided by Southfield Public Schools. Mr. Walker stated Child A refused to get started on his computer a

    On 3/04/2021 I conducted an unannounced onsite inspection at Magnolia Center in Southfield, MI. I interviewed Program Director Lisa West-Gorman and Child Care Staff Member Diamond Johnson. Ms. West-Gorman stated she found Child A unattended in the office. Child A attends the Butterfly Classroom (Kindergarten- 2nd grade). Ms. Johnson is assigned to work in the Butterfly Classroom. Ms. West-Gorman worked in the Blue Jay Room (a preschool classroom, located right next to the office) from 12:30 pm to 2:40 pm on 03/01/2021. Around 12:50 pm, Ms. West-Gorman received a phone call. She walked out of the classroom and into the office. When she stepped into the office, she heard a commotion and observed Child A hiding underneath a desk inside the office. Ms. West-Gorman said Child A was laughing and giggling. She asked him to come out from under the desk. He complied. Ms. West- Gorman walked Child A back to his classroom. She told Ms. Johnson that she found Child A under the desk. Ms. Johnson told her she was aware that Child A left the 2 classroom. Ms. West-Gorman returned to the Blue Jay Classroom with Child A. He remained in the Blue Jay classroom. While in the Blue Jay room, Child A climbed on shelving and was disruptive to resting children. Ms. West-Gorman walked Child B back to the Butterfly room around 1:30 pm and called Child A's Mother. She informed her that Child B was found unattended and told her that Child A will be sent home for his behavior if he continued to be disruptive and leave the classroom. At 2:00 pm, Ms. West-Gorman called Child A's Mother a second time and requested Child A to be picked up. Child A's Mother picked him up around 3:00 pm. Ms. West-Gorman stated Child A has left the classroom before. She has implemented strategies to redirect the behavior including placement of a stop sign on the floor and printed stories about not running away from staff members. Ms. West-Gorman said if the classroom doors are open, Child A has a tendency to attempt to flee the classroom. I interviewed Ms. Johnson. She said Child A was not having a good day. From the time he walked in the room today to the time he was picked up, he was jittery and overactive. He had a lot of energy. Child A ran around the classroom and drew on the floor with crayons. Ms. Johnson said she asked Child A for the crayons. He yelled, "No!" and ran away. When she took steps towards him, he ran to the other side of the room. He ran in circles around the classroom. He told Ms. Johnson, "I want to go home!" Ms. Johnson stated she tried to calm him by telling him to sit down and color. Eventually, Child A sat in his seat. He colored on the table. Ms. Johnson reminded him he needed to get on his computer for distance learning. He got up and ran to the front of the classroom then ran out of the room. Ms. Johnson observed him run by the bathroom and observed Child Care Staff Member Josh Walker stop him and tell him, "Go back to class." Mr. Walker went back into his classroom. Ms. Johnson stated she tried to grab Child A by the hand while in the hallway. He pulled away and took off down the hall. Ms. Johnson said she returned to her classroom and called Ms. West-Gorman. She said the line was busy, so she assumed Ms. West-Gorman was in the office. Ms. Johnson remained in the Butterfly Room. Around 5 minutes later, Ms. West-Gorman brought Child A back to the Butterfly Room. Ms. Johnson said Ms. West-Gorman asked her if she knew Child A was missing from the room. Ms. Johnson said yes and conveyed she did not go to get him because she thought Ms. West-Gorman was in the office. Ms. West-Gorman told her she was not in the office she was in a classroom and she only happened to find Child A by chance. She said if Child A ever leaves the classroom again to yell or scream down the hall (to get someone's attention). Ms. Johnson stated that Ms. West-Gorman took Child A into the Blue Jay classroom with her and he did not return for about 30 minutes. Once he was back in the

    On 2./24121, the department received a om laint stating that Ms. West-Gorman grabbed and pulled Child M t -year-old down to the ground. 0co)mp On 2/26121, 1 interviewed the Complainant who said that they heard from Staff Member A that lbs. West- orman pulled Child M to the ground about a couple of weeks ago. Recently, the Complainant heard Child M crying so loudly for at least 20 minutes and they were concerned about it. The Complainant did not see anything but heard the crying and screaming. On 2126121, 1 conducted an unannounced onsite inspection at the center. 1 interviewed Ms. West-Gorman who said that a couple of weeks ago (she did not remember the date) she was aggressive with Child A, but she does not know anything about an incident with Child M. Ms. West-Gorman said that on 2123121, Child M was uncontrollably sobbin for a long period of time. She said that she was not su whys was crying, and would not say anything. Ms. West-Gorman said thati could not be consoled. A is time, she called Child M's father and asked him to pick up Child M. Ms. West-Gorman said that Child M was probably crying for about 15 minutes and none of the staff members, she nor Staff Member B could console After about 20 minutes stopped crying all and about half hour later, gild A's father picked up. leis. It was morning time, and she was alone in the room. lien they wanted to go to the gym to play, Child A refused to o. wanted to stay in the classroom and did not like to move to another area. started to throw toys around, did not listen to instructions and started hitting other c ildren, was punching and kicking in the air but also punched another child. In order to pro ect other children, Ms. West-Gorman said that she grabbed Child A from one side of the table and pulled to her side of the table aggressively. She said that she was more aggressive than she wanted to be. Ms. West-Gorman said that usually she used techniques of redirection, talking to the child, breathe in and out with the child but none of these techniques worked with Child A. Child A was climbing shelves and behavior was very odd. Ms_ West-Gorman said that Child A always resisted new child care staff members class, was only used to two staff members in inl classroom, Staff Member B and Staff ember C. Ms. West-Gorman said that she was called in by er supervisor Ms. Cat erine Broessell who stated that another staff member had seen her being aggressive with Child A and she admitted to the incident. On 2/26/21, I interviewed Staff Member B who agreed that on 2/23/21, Child M was crying inconsolably, and the staff did not know whys had started to cry. Staff Member B said that Ms. West-Gorman came into the classroom to help her manage Child M who was throwin chairs at other children. Child M seemed very angry, and nothing seemed to help to stop crying. Ms. West-Gorman was in the classroom for about 20 minutes an ater took Child M outside the classroom into her office to soothe ■ and call Child M's father to pick ■ up. Staff Member B said that she did not know what happened after that. Staff Member B said that she had not seen Ms. West-Gorman being aggressive towards children at any time. She said that Ms. West-Gorman comes into the classroom rarely since she works with Staff Member C in the room. Staff Member B had heard about the incident of Ms. West-Gorman being aggressive with Child A, but she had not seen anything like that. Staff Member B said that Ms. West- Gorman is firm with the children in her instructions
