    R 400.8125 · R 400.8125 1 Staff; volunteer; requirements. (1)AII staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 07/06/2022 I received an incident report from Franklin Academy. The report indicated that Child A's parent informed the center that Child A told her that another child touched his penis while they were at the center together. Child A indicated it occurred in the butterfly room. A date, time, or additional details were not provided. Child A was enrolled in the butterfly room (also called the green room) during the 2021/2022 school year and remained at the center for the first three weeks of summer camp. Licensee Designee Lori Allmacher stated Child A provided inconsistent details about the child that allegedly touched him. First, he stated it was a male child in his class, then he said it was another child in another class and that child had yellow hair, then it was a female with black hair. Ms. Allmacher said she did not contact any other parents because she was not sure who was involved in the incident. Program Director Lori Allmacher reviewed camera footage from the previous few days and interviewed staff members but was unable to find any additional information about the incident. Child A's last day of care was 06/30/2022. Ms. Allmacher stated that Child A's Mother wanted to walk Child A around the building to help Child A identify the alleged perpetrator. Ms Allmacher felt this may not be safe for other children. She did not feel that Child A's parent wanted to observe Child A in his classroom, rather she wanted the other child to be identified. Ms. Allmacher said they try to limit the number of people coming in and out of the building due to covid and for safety purposes. Typically, parents pick up and drop off at specific times to avoid the amount of people gathering. Parents form a car line and staff walk children out. However, parents do come into the building to pay bills or if their child is having a hard time coming into the building/going to their classroom. Parents are allowed in the building with their children. On 07/07/2022 I spoke to Child A's Mother. She stated that Child A told her that another child touched his penis. Child A's Mother said that Child A showed her how he was touched. She said Child A demonstrated the other child pulled his waistband open and put his hand down his pants and squeezed his penis and told him that it was a secret and not to tell anyone. Child said it happened in the butterfly room.. He did not indicate an area of the building or a time of day. He wasn't sure when it happened, if it was during the school year or during summer camp. Child A's Mother said that Child A does not make up stories and has never said anything like this before. She informed the center about the incident and wanted to do a walk through of the center to help Child A recall events, but was infomed by the adminstrative staff that she was not allowed in the 3 building. She felt that it was important to understand more about the incident so that any child involved could be helped. Child A's Mother is concerned with the supervision of children at the facility and is not satisfied with the way the center handled the incident. On 07/12/2022 I conducted an announced onsite inspection. I interviewed Child Care Staff Member Lindsay Simpson, Camp Director Ekaterina Anguelova, Camp Director Devin Bosch and Lori Allmacher. Child A was enrolled in the butterfly room during the school year and in the green room during summer camp. Both rooms serve children 3 years through 5 years old. I observed the classroom. The bathroom is located down the hallway and to the left of the classroom. There is a boys bathroom and girls bathroom. I interviewed Ms. Simpson. Ms. Simpson is the assigned staff member to the butterfly/green room. She spends some of her time supporting the admininstrative office staff outside of the classroom during the summer months. Ms. Simpson works Monday through Friday from 8:30 am to 4:30 pm. She did not work in Child A's classroom during summer camp. She stated on 06/30/2022, she spoke to Child A's Mothe

    On 07/12/2022, I interviewed, Ms. Anguelova. I asked to review staff files. Ms. Anguelova provided files. However, staff that were hired to work in summer camp did not have a comprehensive background check, Ms. Anguelova states she was not aware that summer staff were required to have a background check. She did not know that summer camp followed the same rules and the child care. I informed Ms. Anguelova that staff are not able to work with children until they are determined eligible by the department.

    An approved program director was not present for at least 50% of the time when children are in care 6 or more hours per day. There is not an approved program director working at the center from June through August. On 07/13/2020, I interviewed Ms. Allmacher. She told me that she does not work as the program director in the summer. I informed her that the center needs an approved program director. Ms. Allmacher told me that the summer camp is not part of child care license. She stated she did not know that the summer camp program needed to part of the license and would like to add summer camp to her child care license.

    Appropriate care and supervision was not provided when children were not properly supervised while swimming. On 07/12/2022, no staff members were in the pool with children. There was a life guard at the large pool, however there was no life guard at the smaller pool.

    On 05/23/2022 I received an email from Program Director, Lori Allmacher. She emailed to report that she was informed by Child A's Father on 05/19/2022, that Child A told him that he had his hair pulled by an individual at the school on 05/18/2022. Child A's Father was not sure who pulled Child A's hair as he could not understand the name that Child A provided as the individual who pulled his hair. Child A's Father expressed concern that Child A had his hair pulled at school and asked Ms. Allmacher for help deciphering the name that Child A repeated as the person responsible for the hair pulling. Ms. Allmacher brought Child A into his assigned classroom, the Cricket classroom. Ms. Allmacher asked Cricket classroom Lead Child Care Staff Member Chelsea Smith if she understood what Child A said. Together they determined that Child A said, "Ms. Meela (Grant) pulled his hair. On 05/25/2022, I conducted an unannounced onsite inspection at Franklin Academy. I interviewed Ms. Allmacher and Ms. Smith. Ms. Allmacher confirmed that Child A is enrolled in the Cricket classroom and attends preschool at the center Monday through Friday from 9:00 am to 3:00 pm. Ms. Allmacher stated that Ms. Grant was a floater, and she worked the entire day in the Cricket Room. Children in the Cricket room are between 30 months and 36 months of age. Ms. Grant provided coverage for Ms. Smith who completed Professional Development training and worked at the front desk for the entire day. There were 7 children in the classroom, so Ms. Grant worked alone, as a second staff member was not needed because ratio was met. The maximum number of children in this classroom at any time is 8; therefore, an assistant staff member is 3 never needed. Ms. Allmacher said due to the allegations as well as other personnel issues, Ms. Grant's employment was terminated on 05/23/2022. Her last day at the center was 05/19/2022. Ms. Allmacher stated that Child A's Father arrived at the center around 9:00 am on 05/19/2022. He told her that Child A repeatedly told him that someone at school (Franklin Academy) pulled his hair. When Child A's Father and Mother asked him who pulled his hair; they were not able to decipher his response. Ms. Allmacher brought Child A to the Cricket Room. Ms. Smith asked him if someone pulled his hair the previous day and Child A stated it was "Ms. Jameela (Grant)." Child A stated that Ms. Grant pulled his hair at naptime. Then Child A demonstrated his hair on the top- right side of his head pulled. He pointed to a small child chair; indicating the place in which his hair was pulled. On 05/19/2022, Ms. Allmacher asked Ms. Grant about the alleged incident. Ms. Grant could not recall anything she may have done that would cause Child A to say this. Ms. Allmacher asked Ms. Grant about the incident two addional times. The second time she asked, Ms. Grant told her she was rubbing his head during nap and maybe that was when he could have thought she pulled his hair. The third time, Ms. Grant stated that Child A was wrapped in his blanket because he was fidgety and maybe she accidentaly pulled his hair when she wrapped him. Later in the day on 05/19/2022, as the children in the Cricket Class, which included Child A, walked through the hall they passed Ms. Grant. Child A yelled out to Ms. Grant, "Don't pull hair!" Ms. Grant commented that he was being silly. Ms. Allmacher contacted Child A's Mother and told her that Child A said Ms. Grant pulled her hair. Ms. Allmacher told Child A that she would investigate the incident. Ms. Allmacher said she did not oberve any red marks, brusing, scratches, or missing hair on Child A's head. Ms. Allmacher said that Ms. Grant was scheduled off work on 05/20/2022 and called into On 05/23/2022, Ms. Allmacher contacted the department by email and submitted a written incident form. I observed naptime video footage of the Cricket Classroom from 05/18/2022. Naptime occurred from 11:45 am to 2:15 pm. At 11:45 am 7 children transitioned fro
