    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/28/2022 I completed an on-site inspection to the center. I spoke with staff Tara Clark McClinton, who was the staff in charge since Ms. Wise and Ms. Coleman were not at the center. Ms. Coleman and Ms. Wise arrived back to the center shortly after I arrived. Ms. Clark Mclinton stated she had heard about the incident with Child C, but she was not working at the time it happened. Ms. McClinton stated staff Lillie Yarborough and Regina Chattam were working when it happened, and they called program director Ms. Wise. Ms. Wise returned to the center right after it happened. I interviewed licensee designee Sharoune Coleman. She stated she was not at the center when the incident happened on 02/16/2022 with Child C. Ms. Wise called her right after it happened, and she and Ms. Wise returned to the center. Ms. Coleman stated staff Lille Yarborough told her Child C was in an infant seat and Ms. Yarborough was feeding Child C. Ms. Yarborough went to get Child C's bottle that was on the counter not far away when Ms. Yarborough heard Child C crying. Ms. Yarborough turned around and saw the seat turned on its side with Child C still strapped in the seat. Child E (5 years old) was standing nearby, and Ms. Yarborough believed Child E had knocked over the seat. According to the staff, the children were in two groups. One staff was with two children, Child C and a 2y old and one staff was with 8 children 2 - 6yrs old. Child 1/2 E has very limited communication skills so could not state what happened. After 5:30pm, based on review of the attendance records, there were two staff and ten children. Ms. Coleman stated Child C's Mother arrived to pick up Child C a few minutes after the incident happened at the same time she arrived back at the center. According to Ms. Coleman, Child C had a little bump on her head and Ms. Wise told Child C's Mother that she should take Child C to the hospital just to make sure everything was okay. According to Ms. Coleman Child C's Mother did take to the hospital and Child C was okay. I asked Ms. Coleman if a written report about the incident had been completed and if she had reported this incident to Licensing. Ms. Coleman stated a written accident report was completed and she showed me this report. The report documented on "02/16/22 at 6:45pm (Child E) flipped the chair (Child C) was in over". Ms. Coleman stated she did not realize she needed to report this to Licensing. I interviewed staff Regina Chattam. She stated she was working with Ms. Lillie (Yarborough) on 02/16/2022 around 6:30pm when the incident happened to Child C. Ms. Chattam stated the only other staff present at the center at that time was the cleaning lady Michelle (Cegers). Ms. Chattam stated Child C was in a chair on the floor and Ms. Lillie (Yarborough) was feeding Child C. Ms. Chattam stated she did not see the incident happen because she had left the room for a minute to take two children to the door to be picked up by their parent. Ms. Chattam stated when she was at the front door, she heard a scream come from the child care room and when 4 she walked back into the child care room, she saw the chair tipped over on its side with Child C still strapped in the chair. Ms. Lillie was bending down to pick up Child C. Ms. Lillie held Child C and staff Michelle called either Ms. Angel (Wise) or Ms. "Shay" (Sharone Coleman) who both arrived back at the center a few minutes later along with Child C's Mother. I interviewed staff Lillie Yarborough. She stated she was working with Ms. Regina (Chattam) the evening of 02/16/2022. Child C was in a "highchair" strapped in and Child E was walking around nearby. Ms. Yarborough went to get Child C's bottle, which was on the counter a few feet away. She turned her head for just a few seconds and heard Child C crying. She turned around and saw the chair on its side on the floor with Child C still strapped in the chair. She picked up Child C. Child C did not seem hurt, but she had Michelle (Cegers) call Ms. Ange

    On 02/28/2022 I spoke with Child D's Mother. She stated Ms. Wise has yelled at her and has said she puts Child D (3 years old) in a highchair when Child D hits other children or does not listen to staff. Child D's Mother stated on 02/25/2022 she observed staff Regina (Chattam) grab Child D by the arm while putting Child D's coat on and getting Child D ready to leave. Ms. Coleman stated she is not aware of Ms. Wise ever raising her voice at any parent and never heard Ms. Wise raise her voice at the children or use any prohibited discipline. Ms. Coleman stated none of the staff give children time-outs in highchairs. Ms. Coleman stated staff do occasionally give preschool or school age children a time out in a "reflection chair". Ms. Coleman pointed to two blue plastic cube chairs that were placed against the wall in the dining area. Ms, Chattam stated she is not aware of Ms. Wise or any staff yelling at parents or children or using any prohibited discipline with the children. Ms. Chattam stated staff talk to children and sometimes have preschool children sit in the plastic blue chairs for a time-out. Ms. Chattam stated she never puts children in highchairs for punishment and she has not seen any staff do this. Ms. Chattam denied she grabbed Child D by the arm. Ms. Chattam stated Child D often cries at pick-up time and doesn't want to leave. Ms. Chattam stated she did not grab Child D's arm. Ms. Chattam stated when Child D's Mother arrived to pick up Child D, she (Ms. Chattam) was putting Child D's coat on, and Child D dropped her mask on the floor. Ms. 7 Chattam picked up the mask and put it in Child D's pocket. Child D held her (Ms. Chattam's) two fingers as she led Child D to the door. She did not grab Child D by the arm and does not know why Child D's Mother would accuse her of grabbing Child D's arm. Ms. Yarborough stated she has never heard Ms. Wise or any staff yell at parents or children. Ms. Yarborough stated she and the other staff will talk to the children and sometimes have a child sit in the blue chair for a time-out. Ms. Yarborough stated neither she nor any staff use the highchairs for time-outs. Ms. Yarborough stated she has never seen Ms. Chattam grab Child D or any child by the arm. Ms. Wise stated she does not raise her voice or yell at the children. Ms. Wise stated neither she nor any staff grab children or use any prohibited discipline. Ms. Wise stated staff may occasionally have a preschool child sit in the "reflection" chairs for a time-out, but never a high chair. She stated she may have said to Child D's Mother that she was going to put Child D in a highchair when Child D acts out, but she never did it and never intended to do it. I advised Ms. Wise she should not tell a parent she was going to use a prohibited discipline even if she had not intentions of doing it.

    Staff do not use prohibited discipline on the children. None of the staff members have heard staff yell at or grab children. Ms. Chattam stated she never grabbed Child D by the arm. Ms. Wise stated she never put Child D in a highchair for a time-out.
