On 05/27/2021, 1 conducted an unannounced on-site inspection. I interviewed David Hawse (owner) and Kristin Hochstein (staff member). Interviews were conducted in the main office. Mr. Hawse stated that he has recently been driving the center's bus to transport children to and from local elementary schools. Mr. Hawse he has been transporting the children for the past several weeks, as a former staff member who was previously responsible for driving the buses is no longer employed at the center. Mr. Hawse stated that he does not have a valid chauffeur's license, although he indicated that he was unaware such a license was required to transport the children on the buses. He also stated that another staff member, Amber Hatfield, transports 2 the children from time to time and that she does hold a valid chauffer's license. Mr. Hawse has reportedly made an appointment with the Secretary of State in order to initiate the process of obtaining a chauffeur's license. He was unable to recall the exact date of his appointment. Ms. Hochstein confirmed that Mr. Hawes shares responsibility for driving the buses with Ms. Hatfield since the former employee quit several weeks ago. I made a copy of Mr. Hawes driver's license, which did not have a chauffeur's endorsement. I made a copy of Ms. Hatfield's license, which is a valid chauffeur's license. I also visually inspected the two buses located at the center. Each bus contained four rows of bench seat and the driver's seat. While on-site Mr. Hawes informed me that the center will be closing their license effective 05/28/2021. Mr. Hawes provided me with a signed closure letter.

The children in the toddler room will go three to four hours without having their diapers changed and will still have feces on their bottoms after being changed. Staff do not wash their hands after diapering. Staff are too "rough" with the children. Owner David Hawes threatens to hit the children with a yardstick if they are not completing their schoolwork. Owner David Hawes dragged Child A -) by the ankles across the floor. Staff member will chase Child A around the room and not allow to goo the bathroom. She has also grabbed Child A forcibly by the arm. Staff members are not wearing masks, parents and children are not being screened for COVID-19, and sick children are allowed to attend the center. The toddler room is out of ratio.

I interviewed the complainant via telephone. The complainant stated children in the toddler room will go three to four hours without having their diapers changed. This usually only happens during naptime and they do not wake the children up at the two-hour mark to change them. I explained to the complainant that naptime is an exception and we do not expect the center to wake the children to change them during naptime. Once the child wakes on their own, they can be changed. The complainant also stated children are sent home at the end of the day with full diapers. The complainant has seen feces on children after other staff had changed the child first. Staff do not wash their hands after diaper changes. and I interviewed owner David Hawes at the center. Mr. Hawes stated staff are supposed to check the children's diapers each hour and they are to change their diapers after two hours even if they are not soiled. Mr. Hawes stated some parents have complained the center is using too many diapers during the day, but he would rather have his staff change the children and keep them clean. Mr. Hawes stated he can only remember one parent complaining about their child having a diaper rash, but it was corrected after the child's diaper brand was switched, so he does not believe it was related to the child not being properly cleaned. Mr. Hawes stated no parents have complained about their child not being properly cleaned by center staff. He stated staff are instructed to wear gloves while changing diapers and once diapering is complete, staff are to take their gloves off, and wash their hands. He is not aware of staff not doing this. I interviewed infant/toddler staff member Natalie White at the center. She stated she changes diapers every two to three hours depending on the child. The children are cleaned thoroughly, and if they have a diaper rash, they have cream to use for the rash. She has not received any parent complaints regarding diapering. She stated everyone washes their hands after diapering. interviewed infant/toddler staff member Diana Gonzalez via telephone. Ms. Gonzalez stated she changes diapers every two hours during her shift. She changes diapers at 8am, 10am, around 12 or 12:30pm and once again before she leaves for the day at . Ms. Gonzalez stated she checks diapers at least once an hour. She changes thec hildren if needed when she checks and changes their diapers every two hours even if they are not soiled. She stated everyone washes their hands after diapering. I interviewed toddler staff member Leanne Wolak via telephone. She stated children are changed every two hours, unless soiled before two hours. Diaper changes are written on the daily sheets and children are cleaned properly. No parents have complained about their child having dirty diapers. She stated everyone washes their hands after diapering as well. I interviewed director Kim White via telephone. She stated there have been no parent complaints regarding their children having dirty diapers. Diapers are checked all the time and changed when soiled. During nap, the children's diapers are not checked, but they are changed before naptime and may be changed during naptime if they wake up and a diaper change is needed. She also stated all staff wash their hands after diapering. interviewed preschool staff members Rachel Sablatzky and Jacob ornery via telephone. The complainant stated the staff are "rough" with the children. When asked what is meant by "rough", the only specific example they could give was in the toddler room the staff will pull the children by the arm and say, "Come here now". The complainant did not give specific names of staff who do this and could not give any other specific details. Owner Mr. Hawes denied any staff member has ever been physically rough with any child at the center. He stated the staff are not 'verbally rough' with the children either, but staff may have to raise their voice if the children are not listening to them or not changing their behavior. Mr. Hawes stated staff have been taught to re-direct the children if they are misbehaving. Director Ms. K. White and staff members Ms. Sablatzky, Mr. Gurney, Ms. Gonzalez, Ms. N. White, and Ms. Wolak were interviewed separately; however, they essentially stated the same information. They all stated staff are not rough with the children and they have not observed any staff members speaking or acting in a rough manner toward any of the children at the center. They all stated they may have to raise their voices if the room is getting too loud; however, staff do not yell at the children and they are not rough with the children. Child A's Mother, Child B's Mother, Child C's Mother, and Child D and Child E's Mother were interviewed separately; they essentially stated the same information. They all stated they do not have any concerns for their children's wellbeing while at the center and their children have never complained about not liking the center or being afraid of anyone there. None of their children have ever come home with any unexplained marks or bruising after attending the center either. Messages were left for Child F, G, and H's Mother; however, a return call was not received. I received the parent handbook, and the center's discipline policy says in part: If a child needs to be disciplined, we will use constructive methods, such as: redirection, review of classroom rules and discuss them, talk to the child/children about the situation and use positive reinforcement for appropriate behavior. The following discipline methods are prohibited: there shall be no cruel, harsh, corporal punishment, or any unusual punishments such as, but not limited to, punching, pinching, shaking, spanking, or biting. No child shall be humiliated or subjected to profane language, threats, and derogatory remarks, or other verbal abuse. Techniques of discipline shall not humiliate, shame, or frighten a child. Discipline shall not include withholding food, rest, or toilet use. The center shall not abuse or neglect children and shall protect children from abuse and neglect while in the center's care. A

The complainant stated Mr. Hawes will threaten to hit the children with a yardstick if they are not completing their schoolwork. The yardstick is kept in the office. The complainant has not seen Mr. Hawes hit anyone; however, he will smack his own hand with the yardstick and say, "If you do not get to work" indicating he will hit them. Owner Mr. Hawes stated there is a yard stick that is kept in the office and is used to measure items for crafts. He denied that the yard stick is ever used by himself or any staff member to threaten the children and that threats are not allowed. Mr. Hawes stated he does not carry the yard stick around unless it is being used to measure an item for a project. Mr. Hawes stated that when the school age children are supposed to be doing schoolwork and are not, the most that is said is they need to focus on what they should be working on. Mr. Hawes stated some of the children have picked the yard stick up and swung it around, but they were stopped, and told that if they hit someone it would hurt, and they cannot swing it around. Director Ms. K. White and staff members Ms. Sablatzky, Mr. Gurney, Ms. Gonzalez, Ms. N. White, and Ms. Wolak were interviewed separately; they essentially stated the same information. They all stated a yardstick is kept in the office, but Mr. Hawes nor any other staff members have ever threatened a child with it for not following the rules or for not doing their schoolwork. They all also stated they have never received any parent complaints regarding the yardstick. Child A's Mother, Child B's Mother, Child C's Mother, Child D's and Child E's Mother were interviewed separately; they essentially stated the same information. They all stated they do not have any concerns for their children's wellbeing while at the center and their children have never complained about not liking the center or being afraid of anyone there. The complainant stated Child A, who has , was running away from Mr. Hawes and hid under a table in the preschool/school age room. Mr. Hawes rabbed Child A by the ankle and dragged out from under the table and dragged approximately ten feet across the floor, is was the only time the complainant witnessed Mr. Hawes be physical with Child A. The corn lainant also stated once at quiet time. Mr. Hawes stated Child A is in the preschool/school age classroom. Child A has and does like to hide; however, has not dragged Child A out from Runeom!Patable or dragged across the oor. Mr. Hawes stated if Child A is hiding under furniture at the center, he or another staff member gets down to level and talks with to find out what is going on and how, is feeling. Mr. awes stated Child A is in and does not quite understand how to follow the online portion of school right now, so it has been a struggle to focus. Mr. Hawes state e has spoken with Child A's mother about sogmetet ionfgMir struggles and a teacher from Child A's school is going to contact the center to discuss some of the techniques the school uses to help Child A focus and follow alon Mr. Hawes 0 stated he thinks Child A hides because. believes it is a game and will run from staff and try to kee away from them, especially if they are trying to get to remain seated for virtual school time. Mr. Hawes stated he has never witnessed any staff member grab Child A forcibly in any way and staff have ever denied Child A or any other child of usin the bathroom. He stated has never grabbed Child A and dragged back to a seat to make sit ere for a time out. Mr. Hawes stated staff talk wi hild A and the other chi ren if they are not listening. He stated when Child A's mother comes to pick up, he talks with her about how Child A's day went. They talk about if Child A ha any problems and about what schoolwork was able to complete that day. ■ Mr. Hawes stated Child A's mother has never voiced any complaints or concerns about Child A's treatment or behaviors at the center. He stated that the center does not utilize timeouts with children of any age. The discipline techniques they use are to talk with children, redirect them, or have them sit with a book, or a quiet toy until they are calm. Staff will check on the children to see how they are doing and if they are ready to re-join the rest of the room then they are able to do so. stated she works with Child A and has never observed or heard about Kr. awes or any other staff member grabbing and dragging Child A by the ankle after hid under a table. She stated Child A is very active and has some so mother sends tablet with , which helps remain calm and eeps s ill. The complainant stated staff do not wear their masks all the time and the parents and children are not being screened for Covid-19. The complainant also said Child B and Child C came to the center with fevers, runny noses, coughing, and sneezing. The complainant told Mr. Hawes this and he did not call their mothers. Child B and Child C stayed at the center all day and came back the next day and were still acting sluggish, so they at least had a cold. Owner Mr. Hawes stated staff and parents who enter the building must wear a mask. Parents also are not allowed to go past the main front desk at this time. The center has two handheld thermometers to take staff and child temperatures and the staff and children/parents must complete a Covid-19 screening form that is kept at the front desk. Mr. Hawes denied that any children at the center have had a fever but did report some of the children have been sick with runny noses. Mr. Hawes stated these children had their temperatures checked throughout the day and have not had temperatures. He stated Child B and Child C have had runny noses most recently. 12 Director Ms. K. White and staff members Ms. Sablatzky, Mr. Gurney, Ms. Gonzalez, Ms. N. White, and Ms. Wolak were interviewed separately; they essentially stated the same information. They all stated staff and parents who enter the building are required to wear masks; however, there is one parent that filled out a form saying she cannot wear a mask. There is a white screen at the entrance of the building and parents are not allowed to go past that. All staff and children must go through the Covid-19 screening questions that are kept at the front desk and get their temperature taken. There have not been any issues with sick children, but if a child is not feeling well during the day, they take their temperature and call their parents if they are too ill to participate with their class. Staff always communicate with parents regarding how their child is feeling. Child A's Mother, Child B's Mother, Child C's Mother, and Child D and Child E's Mother were interviewed separately; they essentially stated the same information. They all stated staff and parents wear masks when they are in the center and parents do not go past the white screen that is by the front desk. None of their children have had fevers or have been too sick to attend the center. Messages were left for Child F, G, and H's Mother; however, a return call was not received. During both unannounced inspections on 10/2/20 and 10/26/20, all staff were wearing masks. I also observed the thermometers and COVID form that are required to be filled out. I also observed parents coming in and not going past the white screen that is by the front desk. I did not observe any sick children. I received the parent handbook, and their illness policy says in part: The following precautions shall be taken for children suspected of having a communicable disease: the parent or guardian will be notified, children with any signs of diarrhea, severe coughing, difficult breathing, yellowish skin or eyes, redness or itching eyes, evidence of parasitic infestations, temperature of 100 degrees Fahrenheit, untreated infected skin, dark urine or grey/white stool, stiff neck, sore throat, or vomiting will be isolated and discharged to their parent or guardian. A child must remain home for 24 hours after a fever has returned to normal without any medication. Staff also must not come to work if they are showing signs of a communicable disease or illness. .............................................

The complainant stated it is not uncommon for the toddler room to be out of ratio. The complainant did not know specific dates, but said many days, one staff member will have 5-14 toddlers by themselves or there will be two staff with 12-20 toddlers. They will also sometimes put the one infant they have in the toddler room. I explained to the complainant that it is not against the rules to put infants/toddlers together in the same room. The complainant stated the preschool and infant rooms are okay with ratio. Owner Mr. Hawes stated they are always in ratio. He stated there are always 2-3 staff in the toddler room with 8-12 children. Currently the infant room only has one child and one staff member, so if they need to, they will move three toddlers to the infant room to help with ratio, or Mr. Hawes will go in the room to cover ratio. The preschool/school age room is always in ratio. Director Kim White stated the infant, toddler, and preschool/school age classrooms are always in ratio and that she or Mr. Hawes step in as needed. The infant/toddler staff members Natalie White, Diana Gonzalez, and Leanne Wolak were interviewed separately; they stated essentially the same information. They all stated their classroom is never out of ratio. They all stated Mr. Hawes helps if a room goes out of ratio. The preschool/school age staff members Rachel Sablatzky and Jacob Gurney were interviewed separately and stated essentially the same information. They both stated their classroom is always in ratio and they are not unaware of any issues in the infant or toddler rooms. They stated Mr. Hawes helps if a room goes out of ratio. Child A's Mother, Child B's Mother, Child C's Mother, and Child D's and Child E's Mother did not have any concerns regarding ratio. Messages were left for Child F, G, and H's Mothers; however, they did not call back. I conducted two unannounced on-site inspections at the center. During both onsites, Mr. Hawes was working in ratio in the toddler room and the center was in ratio.
