On April 06, 2023, a complaint was received that on March 30, 2023, Child A (male, age 2) took off his clothes while at the home and climbed onto Child B (female, age 5). CCSM1 was working when this occurred. On April 06, 2023, I completed an unannounced onsite inspection from 2:30pm to 4:30pm. CCSM1, CCSM2 and licensee Jill Particka were present and working. Ms. Particka stated that neither she nor CCSM2 were present in the home when the incident occurred. CCSM1 and Supervised Volunteer were working at the time. On April 06, 2023, I interviewed CCSM1. She stated that on March 30, 2023, it was approximately 2:20pm when she was cleaning up the kitchen area from a craft the children had completed. Supervised Volunteer was working in the back play/nap room where the other children were still napping. She heard Child B cry out and she looked over to see her sitting in a child size play chair on the floor. Child A was naked and was over her, pushing her arms back. The kitchen and front play room are large open areas, so she had a direct line of sight into that area. Child A is two years old, and Chilc B is five years old. It was unclear what he was doing, but Child B was pushing him away and was upset. She immediately went over and picked him up and moved him away. Though he is non-verbal due to his developmental capacity, he is able to say single words. She asked him what he was doing but he didn't reply. Child B remained upset and crying. She brought him to the kitchen area with her and called Supervised Volunteer into the room. Then she called Ms. Particka to let her know what had happened. Ms. Particka told her to get an incident report out and fill it out. By the time she filled it out, Ms. Particka had returned to the home. Ms. Particka called Child A's Mother and asked to have him picked up. They were concerned that his behaviors were an indicator of possible sexual abuse by someone or him seeing something inappropriate. When Child A's Mother came and got him, her reaction was very ambivalent. Child A's Mother stated that he doesn't have this behavior at home and that he doesn't get naked at home. Ms. Particka shared her concerns about him seeing something or being exposed to something inappropriate and Child A's Mother denied any issues in her home but said she would look into it. Child A has limited contact with his father. Child B's Mother was informed when she picked her up. She was a little upset but understanding of the issue. She asked a few questions and that was it. On April 06, 2023, Ms. Particka stated that she was contacted by CCSM1 regarding the incident. She had left the home for a short period and returned afterwards. She spoke with Child A's Mother and let her know what happened. Because Child A had tried to kiss Child B the day before, (while clothed) she was concerned about his behaviors. He has been going through some issues in his home life that involve the department of health and human services. He has also had some aggression issues over the last year 3 towards other children that she thinks needs to be addressed. Ms. Particka also let Child B's Mother know about the incident when she picked her up that day. By that Sunday, she had decided to give a discharge notice to Child A's Mother, because of the concerns. Ms. Particka was not concerned about the care and supervision in the home by CCSM1 and the Supervised Volunteer. She denied that there have been any previous concerns of improper supervision in the home. If Child A's Mother felt that he was learning these behaviors in the home, then why did she ask to send him back after the incident. According to Ms. Particka, on Tuesday, April 04, 2023, the Sanilac Police Department also came to her home to inquire about the incident. Officer Jennifer Deiotte asked her who was working and some other questions. She left her card and let her know they were also investigating the incident. On July 28, 2022, a complaint was received that the child care home is only licensed for 12 children and licensee Jill Particka has at least 20 over that limit every single day. The house is too small, and the children aren't getting the care they need. The back room is stuffed full of kids. Last week she had a state inspection and was 19 kids over her licensed amount. On July 28, 2022, I emailed the complainant back for additional information. The complainant indicated that they observed this information first hand and had no further information at that time. 2 On August 04, 2022, the complainant sent a picture of the attendance sheet for that day showing 33 children signed in. On August 10, 2022, I completed an unannounced onsite inspection. I reviewed the attendance log for the home. The attendance log had 21 unrelated children signed in for the day. I counted 19 children present in the home and two children were leaving as I arrived. Ms. Particka was not present at the inspection, but child care staff member Tricia Hernandez and Jenna Wylie were present. Ms. Hernandez stated that Ms. Particka had just left and would be back shortly. Within five minutes of my arrival Ms. Particka returned to the home. She acknowledged that she was over her licensed capacity of 12. We discussed the recent violation that she received for the same issue during her interim inspection conducted on July 21, 2022, when she was also over capacity. Ms. Particka indicated that she is having a hard time informing her parents that the children can no longer attend the home because they have nowhere else to take their children (due to a lack of child care in the Sandusky area). We explored ways to inform them of the licensing rules and how to also be in compliance. She agreed that she would immediately issue a discharge letter to the parents so that she only has 12 unrelated children or less. .............

Play yards must meet the Consumer Product Safety Commission safety standards for play yards, 16 CFR part 1221 (2019). Licensees shall comply with this subrule by December 31, 2019. On August 10, 2022, I observed a child using a play yard that did not have a date on it. All play yards should be dated February 19, 2014, or newer.
