On April 18, 2023, I reviewed an incident report received from licensee designee and program director Victoria Peck. While outside on the playground during up time Child Care Staff Member 3 observed Child A (female, play structure with while Child B (female . Child Care Staff Member 3 also told her that she did not observe the children was not sure of the interaction between them, as they looked at her and laughedwhen she called their names. Child A's Mother stated that she asked Child A if she stated "no." Child A's Mother stated that whenRse"aassk ed Child A if Child B Child A's she stated ayes." When she asked Child A if Child B Child i A's Mother stated that Child A did not say that anything else occurred. Child A's Mother stated that she requested to speak to Child B's Parents, as she wanted to know if Child B provided more details regarding the incident and the child care center administrators told her that she could not speak to Child B's Parents. She also disenrolled Child A from the child care center. Child A's Mother stated that Child A is currently staying out of town with relatives, and she did not want her to be interviewed. On April 21, 2021, 1 completed an unannounced on-site inspection. I individually interviewed licensee designee and program director Victoria Peck, Child Care Staff 1, and Child Care Staff Member 2. Child Care Staff Member 3 was not working at the time of my on-site. Ms. Peck stated that the incident occurred on April 13, 2023, at approximately 5:15p.m., and she was not present at the center during the time of the incident, as she left for the day. Ms. Peck stated that Child Care Staff Member 1 called her at approximately 5:40 p.m., as she was the administrator in charge during 3 this time. Child Care Staff Member 1 informed her that Child Care Staff Member 3 observed Child A on the play structure with Child B Mo Child B's and h" aMreIR Membe"iM serve Child B Child A. When Child Care Staff Member 3 called their names, the children laughed and attempted to run away. Child Care Staff Member 2 was also present on the playground. She did not observe the incident, as she was interacting with parents as they picked their children up. Child Care Staff Member 3 took Child A to Child A's Mother's classroom and Child B to the office. Ms. Peck stated that Child Care Staff Member 1 informed Child B's Mother of the incident, as she arrived to pick Child B up shortly after Child B was taken to the office. The classroom came inside, and Child Care Staff Member 3 took Child A to Child A's Mother's classroom and Child B to the office. Child Care Staff Member 1 stated that she attempted to ask Child B questions about the incident, but Child B did not answer any questions. Child B's Mother arrived shortly at the child care center and came into the office. Child Care Staff Member 1 informed her of the incident with Child B present. Child B's Mother questioned Child B. When Child B's Mother asked Child B who Child A's , Child B stated, "Child A Child ChildA. Child Care Staff Member 2 stated that on April 13, 2023, while on the playground Child Care Staff Member 3 informed her that she observed Child A on the play structure Child B . Child

On March 10, 2023, I made an unannounced onsite inspection to the child care center and met with acting program director and licensee designee Lorren Roberts. I made Ms. Roberts aware of the allegations in the complaint. Ms. Roberts stated Child A was at circle time in the classroom. Child A was climbing over another child and fell off that child bumping her lip on a wooden bookshelf. 2 During the onsite inspection I reviewed the previous incident reports. The incident reports stated, on March 2, 2023, Child A was playing and then turned around and bit a child. On January 27, 2023, Child A was climbing the picnic tables when she slipped and hit her head. On October 26, 2022, Child A was playing with toys when she slipped and hit her head. On March 10, 2023, during my onsite inspection I interviewed Child Care Staff Member (CCSM) 1. CCSM 1 stated she has been working at the center since June 2022. CCSM 1 typically works in the Toddler 1 classroom. She was stepping into the classroom when Child A hit her tooth. At the time the child care children were sitting down singing songs and reading books next to the bookshelf. CCSM 1 saw Child A in her peripheral vision. Child A started to climb over a friend, stepped on a book, and slipped hitting her face on the bookshelf. CCSM 1 stated at the time of the incident, she and CCSM 2 were on the floor with the children. CCSM 2 was assisting her in containing the children. CCSM 3 was standing and completing the face to name chart. During my onsite inspection on March 10, 2023, I interviewed CCSM 2. CCSM 2 has worked at the child care since August 2022. CCSM 2 works in the Toddler 1 classroom. CCSM 2 was working at the time Child A fell. CCSM 2 stated they were finishing up circle time and she was helping another child with their shoes. She saw Child A trying to climb over her friend, there were books on the floor, and Child A slipped on one of the books. She saw Child A hit the bookshelf very hard. CCSM 2 picked up Child A after she hit her lip, she also picked up Child A's tooth, which came out when Child A fell. During my onsite inspection on March 10, 2023, I interviewed CCSM 3. CCSM 3 stated she has been working at the center since July 2022 and works in the Toddler 1 classroom. CCSM 3 stated she was working in the classroom when Child A hit her lip on the bookshelf, however, she did not see how it occurred. CCSM 3 stated the other CCSMs were sitting and reading books with the child care children. During my onsite inspection, I observed the Toddler 1 classroom. There was a mat for circle time and a small wooden bookshelf where Child A hit her lip. On June 23, 2023, I called Child A's Mother to discuss the allegations in the complaint. Child A's Mother is not what sure what's going on, but her child appears to always get hurt at the center, since the initial incident, she has received several incident reports regarding Child A getting bit by other children in the center. Child A's Mother went on to say there have been a lot of staff turnover in the center, which may be contributing to the lack of supervision in the classroom and outside. On July 10, 2023, I called Victoria Peck to conduct and exit conference. I explained my findings with Ms. Peck. Ms. Peck is aware that Child A has had some incidents where other children have bitten Child A. Ms. Peck stated there are a couple of 3 children in the Toddler 1 classroom who have been identified as biters, she has taken some steps like providing teethers for them to deter them from biting. On July 10, 2023, I reviewed the incident reports received concerning Child A since the initial complaint. On April 4, 2023, Child A was sitting on a bench, she went to get up from the bench, slipped and hit her forehead. On May 19, 2023, the child care children were preparing to go outside when Child A was bitten by another child. Ms. Peck, program director, stated that the two child care staff members who worked in the infant room at the time of the complaint are no longer employed by the center. Ms. Peck stated that diapers are changed on a regular basis, they are changed when soiled or every two hours. During the onsite inspection I reviewed a sampling of the diaper changing logs from January and February. Documenting frequent diaper changes at least every two hours and when soiled. The diaper changing records are in the Bright Wheel child care app where parents can see the diaper changes from the app or in their email. CCSM 2 stated that they always change the child care children's diapers every two hours or as needed. On June 22, 2023, I called the licensee designee Lorren Roberts and requested she send me a sampling of diaper changing logs specifically for Child A from the 3 beginning and end of January 2023. Ms. Roberts emailed diaper changing logs for January 4, 5, 10,11,16, 18 24, and 31st. The logs show that Child A was changed every two hours except during naptime. The log shows that Child A was changed after waking up from his nap. On June 22, 2023, I called Child A's Mother. I asked her what lead her to believe that Child A was not changed every two hours as indicated on the Bright Wheel log. Child A's Mother stated that she knows her child and if he was changed, he would not have had rashes. She went on to say that she checked his diapers as lunch time, and it was the same diaper she put on him in the morning. I asked if she spoke to the child care staff members when she checked at lunch and she stated she believed she did, but could not give a specific person she spoke to. ..............

On February 9, 2023, I made an unannounced onsite inspection to the child care center. I discussed the allegations in the complaint with the program director Victoria Peck. Ms. Peck stated that the allegations are coming from an former child care staff member. Ms. Peck stated, "My ex-employee(CCSM 3) was an opener and opened with CCSM 2 and the licensee designee Lorren Roberts." Ms. Peck stated CCSM 3 started work at 6:30a.m., the first infant room child to arrive usually arrives around 6:33a.m. There have been occasions when CCSM 2 has called to say that she will be 10 or 15 minutes late, but when that happen either Ms. Peck or Ms. Roberts covers the classroom to maintain ratio. During the onsite inspection on February 9, 2023, I viewed the toddler one classroom. There were six toddler aged children present with two child care staff members, which met the required 1:4 child care staff member to child ratio. CCSM 1 stated that she works from 8:30a.m.-5:50p.m. and has never seen any of the classrooms out of ratio. 4 On February 10, 2023, I received a phone call from CCSM 2. CCSM 2 stated that the classrooms have not been out of ratio in the morning. On the occasions that she is a few minutes late Ms. Peck program director or Lorren Roberts assistant program director(licensee designee) have waited in the classroom for her to get there. On March 10, 2023, I made an unannounced onsite inspection to the child care center. During the onsite inspection I viewed the infant 3 classroom and toddler 1 classrooms and both classrooms were following the required 1:4 child care staff member to child ratio. Ms. Peck stated she spoke with child care staff member Ashley Green and Ms. Green confirmed that Child A was served a beef patty on September 22, 2022, instead of fish sticks and she did not correct the information in the electronic application system to reflect the meal substitution. Ms. Peck explained that the daily meals are downloaded into the electronic application system for all children, and if a child is served a substitute meal the child care staff has to manually change it. On September 22, 2022, I observed the lunch menu to be fish sticks or substitute. Child A's electronic record was not changed to reflect that he ate a beef patty. On October 13, 2022, I met with child care staff member Lorren Roberts. Ms. Roberts denied that Child A was served fish. Ms. Roberts stated that Child A's Mother informed the child care center approximately three months ago of Child A's potential fish allergy and asked that he not be served fish. Ms. Roberts stated that child care staff members are aware of Child A's potential fish allergy. When she and Ms. Peck met with child care staff member Ashley Green, she confirmed that Child A was served a beef patty on September 22, 2022, instead of fish sticks but she did not correct the information in the electronic application system to reflect the change. On October 13, 2022, I met with cook, Ibtissam Mohamed. I asked Ms. Mohamed if she was aware of any children at the child care center with allergies. Ms. Mohamed told me that Child A had a fish allergy. I asked her if he was served fish on September 22, 2022, and she stated that he was not, as she prepares a beef patty for him. Ms. Mohamed showed me a menu posted in the kitchen and his name was listed as having a fish allergy and beef patty was listed as his substitute. On October 13, 2022, I met with child care staff member Ashley Green. Ms. Green denied that Child A was served fish on September 22, 2022. She stated that he was served a beef patty instead of fish due to his potential fish allergy. Child A's meal is prepared for him on a separate plate. Ms. Green stated that the daily meals are downloaded into the electronic application system for all children and the information must be manually changed if a child if a child is served a substitute meal. She was rushing and did not correctly enter the information into the electronic application system, as she was copying and pasting and did not change the fish to beef patty. On October 13, 2022, I met with child care staff member Jenna Farley. Ms. Farley stated that Child A is not served fish due to a potential fish allergy. He is served beef as a substitute. Ms. Green stated that she did not work on September 22, 2022. She stated that Ms. Green told her that Child A was served beef as a substitute on September 22, 2022, but she entered the information incorrectly on the electronic application system. 7 On October 13, 2022, I met with Samuel Sloan. Mr. Sloan stated that Child A is not served fish due to a potential fish allergy. He is served beef as a substitute. Mr. Sloan stated that on September 22, 2022, Child A was served a beef patty on a separate plate as the substitu
On October 7, 2022, I received an email from program director Victoria Peck stating that she was forwarding an incident report. Child A's Mother notified the child care center that Child A was taken to the hospital on October 6, 2022, as she observed a bump on Child A's forehead last night when he arrived home from the child care center. The hospital told Child A's Mother to monitor him for symptoms of a concussion and brain bleed. The incident report stated that on October 6, 2022, while on the playground Child A told child care staff member Sam Sloan that he slipped by the play structure and bumped his nose. Mr. Sloan looked at his nose and did not observe any blood or marks, and when he asked Child A how he was doing, Child A stated "okay". Child A then resumed playing. Mr. Sloan thought that it was a normal playground situation and did not inform Child A's Stepfather of the incident when he arrived to pick up Child A. October 10, 2022, I spoke to Child A's Mother to follow up on an incident report received on October 7, 2022, from program director, Victoria Peck. Child A's Mother stated that on October 6, 2022, the child care center did not inform Child A's Stepfather when he arrived to pick him up that Child A sustained a bump on his forehead. When Child A arrived home, she observed a bump on his forehead. When she asked him what happened to his forehead, he told her that he fell on the "yellow thing." She immediately took him to Chelsea Hospital emergency room. She stated that he was not diagnosed with a concussion or brain bleed, as the hospital did not complete any imaging test. However, they told her to monitor him for concussion or brain bleed symptoms such as nausea or vomiting. Child A's Mother stated that Child A has not exhibited any of these symptoms and is doing well. She was upset that the child care center did not notify her of Child A's injury, and she will be looking for a new child care center for him to attend. Child A's Mother sent me a picture of the bump on Child A's forehead. On October 11, 2022, I opened a special investigation, as an on-site inspection needed to be completed to obtain additional information. On October 13, 2022, I completed an unannounced on-site inspection. I individually interviewed program director Victoria Peck and child care staff members Lorren Roberts, and Samuel Sloan. Ms. Peck stated that she was not in the building during the time of the incident. On the evening of October 6, 2022, Child A's Mother sent a picture on the KinderCare electronic application system of a bump on Child A's forehead and message stating that Child A told her that "he fell into a yellow thing." On October 7, 2022, Ms. Peck met with child care staff member Samuel Sloan. Mr. Sloan stated that on October 6, 2022, while on the playground in the afternoon Child A pointed to the play structure and told him that he slipped. Mr. Sloan stated that Child A, kept saying "my nose." 3 Mr. Sloan examined his nose and did not observe any blood, marks, or bruises. Mr. Sloan then asked Child A how he was doing, and he said "okay" and resumed playing. Ms. Peck gave me a copy of the picture of Child A sent by Child A's Mother to the KinderCare electronic application system. Ms. Peck stated that child care staff members are required to report incidents and accidents to a manager immediately and the manager provides verbal and written notification to the parent. This information was confirmed upon review of the child care center's written plan for notifying parents of an accident, injury, or incident. Ms. Peck also stated that all child care staff members were retrained on incident reporting. Ms. Peck stated that she met with Child A's Mother on October 7, 2022. Child A's Mother told her that she took Child A to the emergency room on the evening of October 6, 2022, as he had a bump on his forehead when he arrived home from the child care center on October 6. 2022.
