R 400.8143 · R 400.8143 Children's records. (11) A center shall maintain an accurate record of daily attendance at the center that includes each child's first and last name and each child's arrival and departure time. Electronic records may be used. If electronic attendance records are used, then they must be available to the department at the time of an inspection. If the electronic attendance records are not available during an on-site inspection, then the center is in violation of this rule.
On 4/6/23, I conducted an unannounced onsite inspection to the center. Upon arrival, I separately interviewed child care staff member 1 (CCSM 1) and Ms. Deborah Barnes, licensee designee. I informed them of the allegation. Both Ms. Barnes and CCSM 1 acknowledged the incident occurred. On 4/3/23, the children had an early snack around 9:15 a.m. CCSM 1 said child care staff member 2 (CCSM 2) informed her that Child B pinched his fingers in the fridge doorjamb when she opened the door. CCSM 2 was upset and said it was an accident. Child B was crying. The CCSM 2 comforted Child B while providing first aid by observing his fingers and hand. Child B's finger were red and there was some bruising; he was able to move his hands and fingers. CCSM 1 said she called B's Parents to informed them of the incident. CCSM 2 completed an ouch report. Child B remained in care and was his normal self for the remainder of the day. Child B was picked up by his father at his normal time at the end of the day. CCSM 1 said that Child B attends care in the Infant Island room. When they were setting up the classroom, they were unaware that the snack table was positioned to close to the refrigerator thus allowing the children seated at the table to reach and touch the refrigerator door. This is how Child B was able to get his fingers pinched in the door as CCSM 2 opened the refrigerator door. Since the incident, the CCSM's immediately corrected the problem by moving the snack table further away from the refrigerator thus not allowing the children seated at the snack table to be able to reach the refrigerator door. On 4/6/23, I interviewed CCSM 2 at the center. CCSM 2 has been employed at the center for 3 months as the lead caregiver. She stated that she loves working with the 3 children and finds the job very rewarding. I informed CCSM 2 of the allegation. CCSM 2 confirmed the allegation occurred stating that on 4/3/23 she and Child Care staff member 4 (CCSM 4) were working in the infant island classroom. As they were getting ready for snack time around 9:15 a.m., they sat the children at the snack table as they prepared the morning snacks for the children. CCSM 2 said she opened the refrigerator door to get milk to fill the children's cups. Child B was sitting closest to the refrigerator at the snack table. When CCSM 2 opened the refrigerator door, Child B began crying as he reached over and get his fingers pinched in the refrigerator's doorjamb. CCSM 2 immediately sat the milk down and picked up Child B. CCSM 2 comforted Child B checked his fingers and took him to the office to inform CCSM 1 of the incident. CCSM 2 said Child B's fingers were red and bruised. CCSM 2 applied first aid by holding an ice pack on Child B's fingers; he was able to move and calmed down. After consoling Child B for approximately 10 minutes, Child B stopped crying. CCSM 1 informed Child A's Parents of the incident via telephone. CCSM 2 completed an ouch report for the incident that was provided to Child A & B's Father at the time of pick up. CCSM 2 said Child B remained in care and was his normal self for the remainder of the day. CCSM 2 said she was unable to speak with Child A & B's Father of the incident due to her leaving early before he arrived to pick up Child A and Child B from care. CCSM 2 described the incident as an unfortunate accident as this was their first day in the new classroom and was unaware of the table being positioned to close to the refrigerator; the CCSM's immediately moved the table further away from the refrigerator to assure another incident like this could not reoccur. On 4/6/23, I interviewed CCSM 4 at the center. CCSM 4 has been working at the center for approximately three weeks and working in the infant room. CCSM 4 loves her job and working with the children. I informed CCSM 4 of the allegation. CCSM 4 acknowledged the allegation occurred sating that on 4/3/23 around 9:15 a.m. while they were getting morning snack ready for the children, Child B
On 4/3/23, Child B (age 1 years, male) was sitting in a highchair when a staff member had closed the fridge door on his hand. Child B was sitting in his highchair while the staff were preparing lunch.

On 8/31/2022, I completed an unannounced on-site inspection at the child care center. I informed program director Kimberly Andrew of the allegations. Ms. Andrew said child care staff member Hannah Paszkiewicz brought a concern she had with child care staff member Lilly Stockwell to administrative assistant and child care staff member Stephanie Hannah a week or two ago. Ms. Andrew was not present the day Ms. Paszkiewicz presented the concern to Ms. Hannah. She spoke to some of the child care staff members about the incident sine it was reported to Ms. Hannah. Ms. Andrew has had to speak to Ms. Stockwell on occasions regarding her tone of voice. Ms. Stockwell has a naturally loud speaking voice which causes communication that often gets misinterpreted as having a negative tone. Ms. Andrew said she believes Ms. Stockwell genuinely does not 2 intend to be negative in her tone, it's just how she communicates. Ms. Andrew has never been concerned with Ms. Stockwell's interactions with children. Ms. Stockwell's communication style seems to be more of a problem with adults. Ms. Stockwell is very good at getting at the same level as the children and easily develops relationships with children. When Ms. Andrew questioned Ms. Stockwell about the incident, Ms. Stockwell told Ms. Andrew she was sitting between Child A and another child during nap time. Ms. Stockwell was patting the backs of both children when Child A got up on his hands and knees to get off the cot. Ms. Stockwell said her hand was already on Child A's back, so she moved her hand down towards Child A's bottom and put a little pressure on Child A's bottom as she instructed Child A to lay down. Ms. Andrew also spoke to child care staff member Holly Decoster who works with Ms. Stockwell daily. Ms. Decoster said she has never observed or heard anything concerning between Ms. Stockwell and any children, including Child A. Ms. Andrew said nobody reported to her that they heard a slap from across the room. She did not complete an incident report because there were no marks or bruises on Child A and Ms. Paszkiewicz often complains about working with Ms. Stockwell. Ms. Andrew also considered that Ms. Decoster reported she has never observed Ms. Stockwell to demonstrate physical aggression towards children. Ms. Stockwell and Ms. Paszkiewicz do not work well together because they often have personality conflicts. Ms. Andrew said a former child care staff member, who was recently let go due to missing too much work, sent a text to Child A's Mother informing her of the incident. The former child care staff member who spoke to Child A's Mother was on break and not present in Child A's classroom during nap time on 8/18/2022. Ms. Andrew believes the former child care staff member heard about the incident from Ms. Paszkiewicz, or another child care staff member, then took upon herself to report the incident to Child A's Mother. Child A's Mother sent Ms. Andrew an email requesting to meet with her. Ms. Andrew offered Child A's Mother several options for meetings. Ms. Andrew ended up meeting only with Child A's Father. Child A's Father mostly seemed interested in knowing why Ms. Andrew did not report the incident to Child A's parents. Ms. Andrew gave Child A's Father the same explanation as described to me. Child A's Father told Ms. Andrew he questioned Child A and Child A did not report anything concerning that happened with Ms. Stockwell. Child A's Father told Ms. Andrew he has always trusted the child care staff members and has not had any concerns in the past. Ms. Andrew said Child A's Father appeared satisfied with the outcome of the meeting. I interviewed child care staff member and administrative assistant Stephanie Hannah. Ms. Hannah said it is "not uncommon" for Ms. Paszkiewicz to have complaints about Ms. Stockwell as the two do not get along very well. On 8/18/2022, Ms. Paszkiewicz came to the office and told Ms. Hannah that Ms. Stockwell hit Child A. Ms. Paszkiewicz said Ms. Stockw
