R 400.1910 · R 400.1910 1 Ratio of personnel to children. (1) The ratio of personnel to children present in the home at any 1 time must be not less than 1 member of the personnel to 6 children. The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption. I
On 04/21/2023, I interviewed the complaint source who stated that it was observed that one child care staff member (CCSM) has cared for 12 children at one time. The date that this occurred was unknown. On 04/26/2023, I completed an unannounced onsite inspection at the home. I interviewed Ms. Tabbi and CCSM1. Ms. Tabbi confirmed that they always follow appropriate ratio and are currently approved or a variance to rule 1910(1) so the current ratio is one CCSM for every 7 children. She provided me with two weeks of attendance, and I did not see any inconsistencies. CCSM1 stated that they always follow appropriate ratio. She has never worked alone with 7 children. If Ms. Tabbi is not working, she assures that another CCSM is working. On 05/19/2023, I left a voicemail message for CCSM2. To date, I have not received a return call. On 05/22/2023, I interviewed Child A's (female, 2 years) Mother. Child A's Mother stated that she is unaware of the maximum number of children one CCSM may have but is not aware of any time that they had too many children.
The child care group home operates over of the appropriate child care staff member to child ratio. Children are placed in cribs as a form of discipline for not listening. Child care staff members yell at the children and was overheard saying "If you're going to act like a baby, I'm going to treat you like a baby." The meals and snacks served are not nutritious. The children do not go outdoors daily.

The complaint source stated that an unknown little girl was placed into a crib as a form of discipline for not listening when she was instructed to clean up. Ms. Tabbi confirmed that they do not place children in cribs as a form of discipline. The only time a child is placed into a highchair (not crib) is to prevent the child from biting or hitting other children. She stated that currently Child A attends and she has spoken with Child A's Mother about her pulling another child's hair while they are cleaning up. Therefore, she places her in a highchair with an activity such as a book or a puzzle, to keep her occupied until cleaning is completed. I observed this occur while I was present for the inspection and confirmed that it was appropriate. CCSM1 stated that they never place children in cribs as a form of discipline. She was aware that Child A is placed into a highchair as a safety measure. Ms. Tabbi spoke to Child A's Mother and made her aware that they do so with activities, to prevent her from pulling another child's hair during clean up. Child A's Mother confirmed that there were conversations with Ms. Tabbi regarding Child A pulling another child's hair during cleanup. She is aware that they place Child A in a highchair at the table with a book or puzzle, to keep her occupied during cleanup. Ms. Tabbi has even texted her a few pictures showing such and she does not have any concerns with such.

The complaint source stated that CCSM's yell at the children all of the time. CCSM1 was observed yelling in an unknown child's face for crying. Ms. 4 Tabbi was overheard saying to an unknown child "If you're going to act like a baby, I'm going to treat you like a baby" while placing the child into a crib. Ms. Tabbi confirmed that they do not yell at the children. Occasionally it may get loud, so they may need to speak u to get the children's attention. She added that one of the CCSM's may need to yell out, in a reactive way, to stop/prevent a child from getting injured (bit or hit). She denies making the statement and that she never would. She has never heard CCSM1 yell at a child's face for crying. CCSM1 explained that they do not yell at the children. They are never demeaning with their language. She denies that she has ever yelled in a child's face for crying. Child A's Mother has never heard the CCSM's yell at the children.

The complaint source stated that the meals and snacks that Ms. Tabbi served the children are not nutritious. For breakfast, the children may be served a bagel or cereal and only fruit occasionally. For lunch they are served sliced ham, chicken nuggets, or peanut butter sandwiches. Only occasionally are they served fruit and/or vegetables. Ms. Tabbi confirmed that all of meals and snacks follow the meal requirements of the child care food program. She showed me the remaining food that was served that day for lunch: hot dogs, whole grain bun, green beans, fruit cocktail, and milk. confirmed that she had both low-fat and whole milk to serve to the appropriate age ranges. CCSM1 explained that all of the meals that they serve are nutritious. She gave a few examples of different meals and snacks that they serve. Child A's Mother does not have any concerns with the meals or snacks that are provided. 5

The complaint source stated that they rarely go outside but tell the parents that they do. Ms. Tabbi and CCSM1 both said that they take the children outside daily, weather permitting. They will take the children out for a walk and separate them into shifts, if needed. Child A's Mother is aware that they go outdoors daily, weather permitting.
