On August 3, 2023, I spoke with Complainant over the telephone. Complaint stated it was Witness 1 who saw the incident occur on August 1, 2023, and took the picture noted in the allegations. When Complainant saw the picture, Complainant posted it to the Facebook page to let the parents of the children in the picture that "eenleft outside alone. The post has since been removed from Facebook. The complainant provided witnesses information before ending the conversation. 3 Complainant provided the picture taken by Witness 1 through email. In it you see a young boy standing behind a black stroller with a baby in it near the front entry way of the Drug store. Starting from that point moving to the right next to a brick wall is a wagon with three separate cars called a train wagon. The first two cars are occupied by toddler girls followed by a toddler boy. Next to them, closer to the street, is a young girl with a preschool aged boy hugging her around the waist. All of the children are to the right of the sliding glass doors to the building. I interviewed Witness 1 over the telephone. He stated that he was making a delivery to the Collie Drug store in St. Clair Shores (address is 21728 Harper Ave. St. Clair Shores, MI 48080). As he was leaving the store, after completing his delivery, he saw a group of children located on the south side of the building. He gave the time of approximately 11:15AM. He spoke with MHM 1 (8-year-old female) about the number of children. Witness 1 stated that MHM 1 responded that they were from a daycare and that her mother was in the store shopping. Witness 1 did not observe an adult with the group. Witness 1 went back to his truck that was parked on Alger St. He got in and took a picture of the children waiting. He explained he was in shock and called Complainant first and then called the . It was around the same time he called the police department that e watched an adult female walk out of the Roi store and leave with the children. Th did not come telling Witness 1 there was nothing they could if the grou Whaad a ready left. This all took place between 11:15 AM to 11:30 AM. He could not recall an exact time that Ms. Dunn was in the store but knew it was several minutes. On August 3, 2023, the investigation was assigned to the and I spoke briefly about the allegations of the case. We agreed to meet at the Collie Drug store in St. Clair Shores the following day. On August 4, 2023, and I visited the Collie Drug store located on the corner of Harper Av"an St. Upon arrival we went met with Witness 2. He stated that the camera system had been down, and he would be unable to provide us with any documentation or video evidence that Ms. Dunn was ever in the store. He was aware of the situation as a customer contacted him to let him know that a picture had been taken outside of his store, claiming that 5 children had been left alone and was requesting any information about parents. Witness 2 introduced us to Witness 3 who works as a cashier in the front of the store. Witness 3 stated that she might have seen Ms. Dunn arrive that day but does not remember anything further than that information. She said it was very busy and she was helping with customers, but she believes that if it did happen, Ms. Dunn was only in there for brief time. Witness 3 was unable to see anything outside due to 4 where she was positions herself behind the cash register. She would not be able to see out the door if there were any children left outside. and I toured the building and found that there were several items "Ocmgtth e windows and we were unable to see out of the building. The only way to see out of the building was to look through the sliding glass entry/exit doors. That view is limited to the area in front of the doors. On February 16, 2023, I interviewed the complainant over the telephone. The complainant provided more information and described the activities that were going on in the front yard that is used by the children as approved childcare space. The front yard is not fenced, and while Ms. Kerrigan is always supervising the children, they (the children) will start to wander either over to the driveway of the abandoned house to the left or into the next-door neighbor's driveway that connects to Ms. Kerrigan's. The complainant was quick to point out that Ms. Kerrigan is always outside with the children and is quick to get them back to the front yard. When asked specifically about what the concerns were, the complainant listed items, such as noise, too many toys, toys blowing into neighbor's yards, and etc. What was listed are not child care licensing rule violations. 2 The complainant stated that there were hazards if someone was driving down the street and hit one of the children playing. Or someone was pulling away from street parking possibly hitting a child. On February 24, 2023, I drove past Ms. Kerrigan's home but did not see that anyone was home. The front yard had an ample number of outdoor toys for the children to play with while in care. The toys looked to be in good condition and were about 10 to 15 feet away from the street with a barrier between. I also observed that the driveway of the alleged abandoned home was in good condition with no obvious hazards. On March 7, 2023, I conducted an unannounced inspection to Ms. Kerrigan's home. I again observed the toys to be ample and in good condition. The barrier was still up for separation. There is no backyard so the house sits back further back from the street than the neighbors' homes. I met with Ms. Kerrigan and discussed the allegations. She stated that she knew it was an issue with her neighbor. She has applied for grant money to get a fence for the outdoor play area and has quotes from a fence company to install it. She stated that she also will have permission from the City of St. Clair Shores to put the fence in place. Ms. Kerrigan stated that she is always with the children when they are outside. When she sees the children wander, she is immediately getting them back to her yard. She stated it is a quiet residential street with not a lot of heavy traffic.
