R 400.1903 · 1 R 400.1903 Licensee responsibilities. (1) A licensee shall be responsible for all of the following provisions: (g) Report to the department within, 3 business days, any changes in the household composition or when any new or existing member of the household or child care personnel has any of the following: (i) An arrest. (ii) A conviction. (iii) An arraignment for an offense that if convicted would lead to that individual's ineligibility to be connected with a child care home. (iv) Is being investigated by the state department of health and human services for an allegation of child abuse or neglect. (v) Is under court supervised parole or probation. (vi) Has been admitted to, or released from, a correctional facility. (vii) Has been admitted to or released from a health facility or agency that was providing mental health or substance use disorder treatment services to the individual.
On 04/06/2022, I conducted an unannounced onsite inspection to Starlite Daycare which is the family child care home of Wendy Armstrong. I met with and interviewed Ms. Armstrong. Jeremy Armstrong is Ms. Armstrong's adult brother. Mr. Armstrong moved into the home in February 2022. Ms. Armstrong did not understand that she needed to report the change in household composition to the department. Mr. Armstrong lived in the home when she opened her family child care home in 2013 and had been cleared by the department at that time. Ms. Armstrong logged onto the Child Care Background Check (CCBC) portal during the onsite inspection and scheduled Mr. Armstrong to be fingerprinted on this same date at 7:00 pm. Mr. Armstrong will stay with another relative until cleared in the CCBC portal and found eligible by the department to be in the household. I then met with Jeremy Armstrong and an interview was conducted. He had been cleared by the department when Ms. Armstrong opened her family child care home back in 2013 and they were unaware that they needed to notify the department. Mr. Armstrong is willing to get fingerprinted in order to be found eligible to be in the household. Mr. Armstrong will stay with another relative until cleared in the CCBC portal and found eligible by the department to be in the household. On 04/06/2022, I logged into the CCBC portal and verified that Mr. Armstrong is scheduled to be fingerprinted on 04/06/2022 at 7:00 pm. On 04/07/2022, I logged into the CCBC portal and verified that Mr. Armstrong was fingerprinted on 04/06/2022 and the results are pending. On 04/13/2022, I logged into the CCBC portal and verified that Mr. Armstrong was found eligible to be a household member. On 05/26/2022, I conducted a follow up onsite inspection at Starlite Daycare and met with Ms. Armstrong. Ms. Armstrong completed a corrective action plan during the onsite inspection, which was approved. An exit conference was held during the onsite inspection as well. Ms. Armstrong understands that in the future that before any adult moves into the home they must be fingerprint and found eligible in the CCBC portal, and she must notify the department within three business days.
