    R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home. 4

    On 02/23/2022, I sent an email to the complainant source to obtain additional information. On 02/23/2022, I received an email from the complainant source. On 02/24/2022, I conducted an unannounced on-site inspection at Like Home Daycare. I first did a walk-through inspection to determine ratio and capacity. There were 12 children in care and there were two child care staff members present. I then met with the licensee, Andrea DeBardelaben and an interview was conducted. She admits during the month of December 2021 there were a few times she was over capacity and ratio. This was due to parents not picking their children up timely, due to being essential workers in the medical field and them being mandated to work overtime. This happened as she was unaware of what she should do if children had not been picked up and more children were being dropped off. She was "being too nice to people" and "messed up". She now understands that additional children cannot be dropped off until the other children have been picked up. Since this happened, she has provided all the parents a letter indicating that once their schedule has been turned in, they must pick their children up timely as other children will not be able to be dropped off as she will not be paid by the Department of Health and Human Services (DHHS) and will be cited by the Bureau for being over capacity and out of ratio. Since December 2021, she has been refusing to allow parents to drop off children until a parent arrives to pick up their children as to always ensure she is within capacity and ratio limits. I then observed Ms. DeBardelaben did not have any cribs and only had pack and plays. It was explained to Ms. DeBardelaben that she is not allowed to have infants sleep in pack and plays during overnight care. When Ms. DeBardelaben was licensed, she had three cribs and three twin size fold away beds available for child care use. While she still has the three twin size fold away beds she got rid of the cribs as she did not plan on having infants during overnight care. She plans on replacing the three twin fold away beds, as they are getting worn out. Ms. DeBardelaben was able to show that she had two cribs ordered and five twin fold away beds ordered. They should be delivered by 02/26/2022. Ms. DeBardelaben admits she has had up to nine children during the hours of 12:00 am and 5:00 am. When children were scheduled to be picked up before 12:00 am she allowed the children to fall asleep on cots. It was explained to Ms. DeBardelaben that any time children are in care between the hours of 12:00 am and 5:00 am the children must be sleeping in age-appropriate cribs or beds. I then met with child care staff member, Angela Gray. There have been a few times during the month of December 2021 that there were more than 12 children in care. This was due to parents not picking up their children when they were supposed to. She is now aware that if a parent fails to pick up their child and they are at capacity of 12 children no new children can be dropped off. She is also aware of the ratio guidelines. There have been times when toddlers slept on cots during the hours of 3 12:00 am and 5:00 am. This was due to the parents indicating they would pick up their child before 12:00 am and were then late. She was not aware that infants could not sleep in pack and plays during overnight care. Ms. DeBardelaben has purchased two cribs and five twin size fold away beds which should be delivered soon. Ms. DeBardelaben plans to replace the three twin size fold away beds with the five new ones she purchased. I then requested Ms. DeBardelaben produce her attendance records dating back to 12/05/2022 through present. She provided the original copies and requested they be mailed back to her at the completion of the special investigation. On 02/27/2022, I received a text message from Ms. DeBardelaben with pictures of the five twin fold away beds and two cribs that were delivered. On 04/20/2022, I conducted a

    R 400.1910 · R 400.1910 Ratio of personnel to children. (1) The ratio of personnel to children present in the home at any 1 time must be not less than 1 member of the personnel to 6 children. The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.

    On several occasions between 12/05/2021 and 12/19/2021, Ms. DeBardelaben and Ms. Gray were out of ratio, as they were caring for more than 6 children each. After reviewing attendance records on 12/07/2021, there were 22 children in care between 3:30 pm and 4:52 pm. On 12/08/2021, there were 14 children in care between the hours of 2:30 pm and 3:42 pm. On 12/19/2022, there were 13 children in care between 5:30 pm — 6:33 pm. Ms. DeBardelaben reports this is due to parents arriving late to pick up their children. Ms. DeBardelaben is now aware that if there are 12 children in care, then additional children cannot be dropped off until the other children are picked up. I conducted two unannounced on-site inspections and found the group child care home within ratio.

    R 400.1922 · R 400.1922 Nighttime care. (4) If nighttime care is provided, then children shall sleep in age- appropriate cribs and beds. Port-a-cribs and play yards are not allowed for nighttime care.

    Ms. DeBardelaben cared for nine children overnight on 12/07/2021 and did not have enough cribs and beds to accommodate this many children during overnight care. Ms. DeBardelaben admitted that she had the toddlers sleeping on cots, as they were supposed to be picked up before 12:00 am however they were picked up late. Upon review of the attendance records there were times the children were not picked up until 12:45 am. Ms. DeBardelaben has since purchased additional beds and cribs. Ms. DeBardelaben can now care for two infants and five children over the age of one, as she has two cribs and five fold-away beds to accommodate overnight children.
