On 06/26/2023, I initiated the special investigation by contacting Child A and Child B's guardian/grandmother by telephone and conducting an interview. On 06/13/2023 she picked Child A and Child B up from the center around 11:30 pm. Child A kept telling her that "Ms. Kim" pinched him. Ms. Kim is Kim Diebold the program director and lead caregiver at the center. Child A did not have any marks, bruises, or injuries from being pinched and did not require medical attention. It is unknown if Child A was pinched accidentally or intentionally. She did not confront Ms. Diebold about the incident. Child A does have behavioral problems and is struggling to get his behaviors under control. Child A is in counseling to try get the behaviors under control. Child B did not have any knowledge of Child A getting pinched despite being in the same room as Child A and being cared for by Ms. Diebold. Child B did not witness Child A get pinched and did not hear Child A complain about getting pinched. Child A does have a history of being untruthful however the guardian/grandmother feels that Child A must be telling the truth as he has told her multiple times that "Ms. Kim" pinched him. On 06/21/2023, the center 2 terminated Child A from the center due to his behaviors. The center had been working with Child A on his behaviors by "redirecting" him. Child A does have a history of kicking, throwing things, temper tantrums, lying and disobeying. On 06/28/2023, I conducted an unannounced onsite inspection at Kingdom of Care Childcare and Preschool Center. I met with administrative assistant and child care staff member, Kayla Young and an interview was conducted. On 06/13/2023, Child A was present at the center from 3:42 pm until 10:56 pm and he was cared for by Kim Diebold and Precious King. Child A's sibling Child B was also in attendance and was cared for by the same caregivers as both are in the school-age room. To her knowledge Child A's guardian has not made any complaints regarding Ms. Diebold allegedly pinching Child A. Ms. Diebold has never been observed disciplining any child in an inappropriate manner. Ms. Diebold has never had any child, parent or other child care staff member complain about her discipline methods. Child A was terminated from the center on 06/21/2023 due to behavioral problems. Child A has a history of throwing things at other children and staff. Child A has kicked and hit other children and staff. Child A does not obey directions and often has temper tantrums. Child A has lied on other children and blamed them for his behaviors. During the first week of June, they were going to terminate services and the guardian/grandmother called crying about how she was struggling with Child A's behaviors and that she was getting him enrolled in counseling as she was having difficulty with him at home, at school and at the center on a daily basis. Due to the guardian/grandmother calling explaining that she was getting Child A into counseling they decided to give him another chance however his behaviors continued. I then met with child care staff member, Precious King and an interview was conducted. Ms. King works as a floater at the center. On 06/13/2023, she was working with Child A and Child B in the school-age room. She does not recall any incidents involving Child A and Ms. Diebold. Child A did not show any signs of being upset or injured in any way. In fact, Child A kept showing herself and Ms. Diebold his muscles on that day. Child A does have behavioral problems and is a very hyper child who requires redirection quite often. Child A has temper tantrums and gets upset and throws things and kicks people when he is upset. Ms. King has worked with Ms. Diebold and never had any concerns with the care she provides. Ms. Diebold has never been observed disciplining any child in an inappropriate manner. Ms. Diebold has never had any child, parent or other child care staff member complain about her discipline methods. Child A did not complain

On 5/24/2023, I reviewed the comprehensive child care background account for Kingdom of Care Child Care Center. Erica Romero-Burns was not currently connected to the facility. She was disconnected on 9/29/21. On 5/26/23, I informed Yolanda Irvin that Ms. Romero-Burns was not currently connected to her facility in their account. She stated that Ms. Romero-Burns is an employee that has been employed on and off for a few years. Her most recent start date was 12/22/22. It must have been an oversight that she was not currently connected. On 6/09/23, the background check account was reviewed and Ms. Romero-Burns has completed the comprehensive background check and was determined eligible and connected to the facility on 5/31/23.

On 5/24/23, I attempted to contact Child A's Mother with the telephone number that had been provided. The call went through however, I could not leave a voicemail message for her. I texted the number and requested that Child A's Mother call me. I did not receive a return call from Child A's Mother. I made an onsite inspection to the center at 9:07 a.m. On 5/25/23. I interviewed Kayla Young. Ms. Young assists Ms. Irvin in operating the center and she is also a child care staff member. Ms. Young remembered the situation with Child A and Ms. Romero-Burns. The incident allegedly happened this past March 2023. That day Child A was having a rough day. He arrived from after school and the children just finished having snack. There were activities for the children to do and Child A was not wanting to do any of the activities. He was upset that a little girl did not want to play with him and was playing with another child. He was picking up the chairs and anything else that he could. At no time was Ms. Romero-Burns inappropriate with him. Child A had a 3 rough morning that day also. He was very angry when he came to morning school care. Child A's Mother contacted Ms. Young and informed her that Child A said that Ms. Romero-Burns put her hands on him. Ms. Young and Mr. Irvin reviewed the video of that day, and they did not see at any time that Ms. Romero-Burns put her hands on Child A. They set up a meeting with Child A's Mother. Child A's Mother came in for the meeting the following day after the alleged incident. They reviewed the video with her. She observed that Child A was throwing things around the room, and this is when she said Child A had autism. She has never provided the center with any information stating he was diagnosed with autism. Ms. Young pulled Child A's file and showed Child A's Mother that none of the paperwork had a diagnosis on it. It was decided that Child A would not be allowed to come to the center any more after she did not provide any documentation that Child A was on the spectrum. Child A's Mother was upset by this decision. I interviewed Elizabeth Mahan, child care staff member. She remembered the day that Child A acted out and accused Ms. Romero-Burns of mishandling him. Child A had a rough time while he was at the center before school. She thought he may have been tired because he arrived early that day. There is a brief period where they read books prior to the bus picking up the children. He did not want to do this and threw a book across the room. He was very angry that morning and she had to talk to him about this behavior. She has worked with Ms. Romero-Burns on many occasions. She is a very go with the flow type of person. She has never observed Ms. Romero-Burns to be rough with any of the children and she did not have any concerns regarding her caring for children. Ms. Mahan's own child in in Ms. Romero-Burns care while she is at the center. On 5/25/23, I received a telephone call from Ms. Romero-Burns. The day that Child A alleged that she disciplined him inappropriately was a fairly calm day. Child A's behavior came out of nowhere. She requested for Child A to sit by her because he was being aggressive. He picked up a chair and threw it. She did not know what triggered him because she had never seen him act aggressive like that before this day. Child A's Mother contacted her later after she picked up Child A. She told Ms. Romero-Burns that Child A told said that she held him. She accused Ms. Romero- Burns of gaslighting Child A because he has high functioning autism. Ms. Romero- Burns had no information regarding Child A having autism and she has never observed any behaviors that would suggest that he was on the spectrum. She denied calling him a baby and doing anything physical towards him. Ms. Romero-Burns uses redirection for discipline. If the children continue to display aggressive or dangerous behaviors, they may contact parents to pick their child up from the center. Physical discipline is

On 12/02/2022, I received a phone call from Child Care Licensing Consultant, Mary Smith. Ms. Smith indicated receiving an email from Kingdom of Care licensee, Yolonda Irvin reporting parent alleging one of the lead toddler child care staff members touching her child inappropriately and the allegation having "no truth to it whatsoever. Ms. Irvin wanted to relay severity of allegations to her licensing consultant, Ms. Smith. On 12/05/2022, I interviewed Child A's mother. Child A reported she received a doctor's check at childcare where her buttock was "checked", and it hurt. There is a new employee working with Child A and Child A's mother was not notified. "I think her name is Liz." The alleged inappropriate touching took place on Wednesday (11/30/2022). When talking to Ms. Irving, she was not apologetic and was very dismissive. Ms. Irvin asked Child A to repeat what she disclosed, and she would not. 3 Child A did not seem afraid during her disclosure. She was taken to the doctor's office and there were no signs of abuse. On 12/07/2022, I conducted an on-site inspection and interviews with new lead caregiver, Elizabeth Mayhan and Administrative Assistant, Kayla Young. During dramatic play activity, Ms Mayhan engaged with Child A with toy stethoscope and checked her heartbeat. During naptime, Ms. Mayhan also took Child A to the restroom. "I gave her praise when she went on the potty." While helping in restroom, door was left open as remaining children in care were still on cots for naptime. Child A was picked up and taken to her dentist appointment. Child A returned to child care facility after her dentist appointment and Ms. Mayhan asked how her appointment went. Child A has verbal limitations and Ms. Mayhan was unable to understand how her dentist appointment went. Ms Young reported Child A's mother came to the child care facility with Child A on 12/1/2022 and explained what happened to Child A to Ms. Young and Ms. Irvin. Child A was picked up on 11/30/2022 at 1:00 pm for a dentist appointment and returned and brought back in approximately an hour and thirty minutes. Child A's mother was "adamant" Child A was inappropriately touched while at the child care facility. Child A's mother asked Child A if she remembered what she said and she kept playing. Ms. Young has known Ms. Mayhan for many years. "Before Liz (Elizabeth Mayhan) came here, she worked in head start program at school." On 1/13/2023, I contacted Child B and Child D's mother. Child B's mother reported, "I love that place," and feels like Child B is very safe while attending the child care facility. Child D's mother transitioned Child D to Kingdom of Care from another child care facility. ", it has been really good. My child is a biter and was no longer able to attend the other childcare. They are amazing and patient. I trust the staff whole heartedly." On 2/10/2023, I interviewed preschool lead caregiver, Cameron Williams. Mr. Williams has observed a "world of difference" since Ms. Mayhan began working in the toddler room. "It's organized and there is now a structure and flow. Ms. Williams is more confident that children in care in toddler room will be ready when transitioning to preschool room. Mr. Williams has not had any direct interaction with Child A. "I just know her face from drop off." On 2/15/2023, I conducted interviews with program director, Kimberly Diebold, and assistant child care staff member, Hannah Rosario. Ms. Diebold reported at the time Child A was allegedly touched inappropriately at the child care facility, she was gone to her dentist appointment. Ms. Diebold has no concerns with Ms. Mayhan. Ms. Rosario and Ms. Mayhan have adjoining rooms and they check in with each other throughout the day. "Elizabeth is wonderful and is great in the toddler room." On 02/22/2022, 1 contacted Child A's (female, age one) mother and an interview was conducted. On 02/09/2022, a child care staff member sent her an alert on Pro-Care that Child A had bumped her forehead and went back to playing. Child A had a goose egg size bump on her forehead when picked up from the center on 02/09/2022. The child care staff member reported some children were playing with a ball and Child A fell forward and hit her forehead, however, went back to playing after being given first aid. Child A returned to the center on 02/11/2022 and another alert was sent to her indicating that "while children were playing with a ball" Child A "was hit on forehead while sitting on bench. Checked her forehead put cool cloth on it". Child A's mother was at work and unable to go to the center and sent her boyfriend. Child A remained at the center on 02/11/2022 until Child A's mother got off work. The child care staff members are claiming that Child A was only injured on 02/09/2022 and not again on 02/11/2022. Child A is only one year old and is unable to explain what happened. Child A was taken to Ascension St. Mary's 3 Hospital on 02/11/2022. Child A was taken to Caring Pediatric Partners on 02/18/2022. Child A's mother was informed by the licensee Yolonda Irvin that there is a video of the injury on 02/09/2022 however she has not been able to view the video. Ms. Irvin is claiming there was only one incident in which Child A was injured despite Child A's mother receiving two alerts via Pro-Care that there were two incidents. On 02/22/2022, I received a voice mail message from the licensee Ms. Irvin requesting a call back. On 02/22/2022, I conducted an unannounced on-site inspection at Kingdom of Care Childcare and Preschool Center. I first did a walk-through inspection to determine if the center was within ratio. The infant room was observed to be at a 1:4 ratio. The preschool room was observed to be at a 1:6 ratio. Those were the only two rooms that had children. There were two additional child care staff members available to assist with providing care. I then met with child care staff member Kayla Young, and an interview was conducted. Ms. Young was not working on 02/09/2022 when Child A was injured. She was notified via the Pro-Care application of the injury. Child A was not injured on 02/11/2022. The program director had been informed that she updated the wrong part of Pro-Care as she input the injury under the "notes" section of the Pro-Care application instead of the "incident" section. On 02/11/2022 she entered the injury under the "incident" section of the Pro-Care application which caused confusion when Child A's mother received the alert. Child A never returned to the center after 02/11/2022. On 02/17/2022, Child A's mother called and reported she had taken Child A to the doctor, and she was demanding to review the video surveillance of the injury. She called Child A's mother on 02/21/2022 and left her a voice mail message and she had not heard back from her to obtain any further information. Ms. Young denies that the center is providing care overnight and reports they close at 12:00 am and open at 5:00 am Monday through Saturday. Ms. Young, Ms. Irvin and Ms. Diebold have transported a few children from school to the center since the school year began however this is not done daily. Ms. Young was unaware that the center was not approved to provide transportation. I then met with and interviewed the program director, Kimberly Diebold. Ms. Diebold is the infant/toddler lead caregiver. On 02/09/2022 she had taken the children to the multi-purpose for large gross motor activity and Child A was sitting on the small bench and she fell forward and hit her forehead on the floor. Child A was not playing with a ball however other children were. When Child A fell, she did cry for a few seconds. She ran over and picked Child A up immediately and provided comfort. She put a cold cloth on Child A's forehead, and she stopped crying. T

(4) A licensee, licensee designee, or program director shall submit a written report to the department of the occurrences outlined in subrules (1), (2), and (3) of this rule, in a format provided by the department, within 72 hours of the verbal report to the department.
The licensee and program director failed to submit a written report to the department with 72 hours of Child A's mother notifying the center that Child A was taken for medical attention following the injury that occurred at the center. The licensee was made aware on 02/17/2022 and did not submit a written report to the department until 03/24/2022. Ms. Irvin did report the injury verbally to the department timely as the center was made aware on 2/17/2022 and it was reported on 02/18/2022 via voicemail which is within the 24-hour timeframe requirement.
