    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times. A

    On 03/10/2021, I completed an unannounced on-site inspection at Genise Weston's group child care home; also present was child care consultant Kelly Millar. I met with and interviewed licensee Genise Weston. On 01/21/2021, Child A's (female, age five) mother sent her a text message that she was able to provide. The text message said that Child A reported that Child B (female, age seven) "keeps trying to touch her butt and pull her pants down in the back. I think something needs to be said to her mom cuz I don't want her doing that to her. I told her she needs to tell you if this happens again". Ms. Weston replied "I will talk to her 3 mom when she pick her up. Tell her she has to tell me when this happens". Child A's mother replied "I don't understand why she would do it and why she thinks it's normal or okay? I guess she tells her "I won't be ur best friend" when she tells her to stop. So I'm assuming that why she doesn't say anything. But we are agreed that she needs to tell you". Ms. Weston reports she talked to Child B's mother on 01/21/2021 and informed her of the allegations. Child B denied the allegations to her mother and Ms. Weston. To date Child A has never reported an inappropriate touch or attempted inappropriate touch by Child B or anyone else to Ms. Weston or the other caregiver. Ms. Weston reports the children are never left unsupervised. She provides care for the children in the basement in a large open area. Ms. Weston reports there have been a few times she has went upstairs to use the bathroom while the children were napping however it is only for a few minutes and the children were asleep. However, when the children are awake all of them go upstairs to use the bathroom. They also eat upstairs in the kitchen. Child A and Child B do not nap next to each other however they are in close proximity. Child B has never been observed being inappropriate with any of the children and no one has ever reported any incidents. Child B has been attending the group child care home since she was three months old. Ms. Weston reports she was unsure who to report the allegations to as her consultant retired at the beginning of January 2021. Ms. Weston called the area manager Rose Rafferty on 03/05/2021 and left a voice mail message after Child A's mother made a second complaint. Child A has not returned to child care since 03/05/2021. Child B continues to attend child care. During the on-site inspection Ms. Weston provided the child information cards for all the children enrolled in child care (Child A through Child H). On 03/10/2021 and 04/19/2021 an attempted telephone call was made to Child A's mother and there was no answer. A voice mail message was left requesting a return phone call. On 04/19/2021, an attempted telephone call was made to Child B's mother and there was no answer. A voice mail message was left requesting a return phone call. On 04/19/2021, an attempted telephone call was made to Child C's (female, age six) mother and the phone number had been disconnected. On 04/19/2021, an attempted telephone call was made to Child D's mother and there was no answer. A voice mail message was left requesting a return phone call. On 04/19/2021, I received a telephone call from Child A's mother and an interview was conducted. On 01/21/2021, Child A informed her that Child B kept trying to touch her butt by grabbing the back of her pants. She sent the licensee a text message informing her of the allegations and requesting that Ms. Weston speak to Child B's mother. Child A admitted to her that she never reported this to Ms. Weston or Ms. Weston's daughter who also provides care at times. Child A did continue to attend child care at Ms. Weston's and did not report any other incidents until 4 03/03/2021 when Child A reported Child B was trying to get her to tongue kiss her and told her she wouldn't be friends with her if she didn't do it. Child A did not allow Child B to get her to tongue kiss her but kept trying repeatedly to get

    Ms. Weston did not make a verbal or email report to the department within 24 hours of being informed of an allegation of inappropriate contact. Child A's mother informed Ms. Weston on 01/21/2021 via text message that Child A reported Child B "keeps trying to touch her butt and pull her pants down in the back". Ms. Weston confirmed that Child A's mother sent her this text message and she failed to report it to the department as required. Ms. Weston did not make a verbal report to the department until 03/05/2021 after Child A's mother made another complaint to Ms. Weston about Child B still attempting to be inappropriate with Child A.

Child A's mother informed Ms. Weston on 01/21/2021 via text message that Child A reported Child B "keeps trying to touch her butt and pull her pants down in the back". Ms. Weston confirmed that Child A's mother sent her this text message and she failed to submit a written report it to the department as required.
