    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. I

    On 03/31/2023 program director Erika Zwolinski contacted licensing regarding the allegation, and on 04/03/2023 she submitted the incident report. On 04/05/2023 I completed an on-site inspection and interviewed Ms. Zwolinski. She stated on 03/31/2023, the preschool children in classroom D went on a daily walk in the hallways of the school. Staff 1 and Staff 2 had the children line up in the classroom. There were 16 children in attendance and Staff 1 counted the 16 children. Staff 1 led the line and Staff 2 was at the end of the line of children. They went on their walk and were gone for about four minutes. When they returned to the classroom, Child A was in the classroom sitting at a table. Staff 1 asked Child A 2 where she was when the class lined up and left the classroom, and Child A said she was in the bathroom. I interviewed Staff 1, lead caregiver for classroom D. She stated every morning when the children arrive, she takes attendance and writes the number of children that are present for the day on a white board just outside the door of the classroom. Staff 1 stated whenever the class leaves the classroom, she does a head count of the children as they line up to leave and does a head count again when they get back to the classroom. On 03/31/2023 there were 16 children present. It was a rainy day, and they were not going outside so they took a walk through the school. There is a blue tape line on the floor of the classroom, and she had the children line up on the tape. She did a headcount and counted 16 children. She was at the front of the line of children and Staff 2 was at the back of the line. They left the classroom and were gone for between 4 and 5 minutes. When they arrived back to the classroom, Staff 1 saw Child A sitting at a table. Staff 1 asked Child A where she was when the class went on the walk, and Child A stated she needed to use the bathroom. Staff 1 believes Child A was in the line when the children lined up on the blue tape and then Child A left the line to use the classroom bathroom. Neither she nor Staff 2 saw Child A leave the line to go the bathroom. Staff 1 stated since this incident she and Staff 2 are making sure to check the bathroom, turn off the bathroom light, and close the bathroom door before they leave the classroom. I recommended to Staff 1 to do a head count of the children when the class gets outside of the classroom to ensure all of the children have exited the classroom. I interviewed Staff 2. She stated last Friday (03/31/2023) was a rainy day so the class took a walk around the school. She and Staff 1 had the children line up at the door, and Staff 1 counted all 16 children. Staff 1 was at the front of the line, and she (Staff 2) was at the back of the line. Staff 2 was distracted for a few seconds by one of the children and she did not see Child A leave the line. The class went on the walk and returned to the classroom a few minutes later. Staff 1 saw Child A sitting in the classroom at a table. Staff 1 asked Child A where she had been, and Child A said she had to use the bathroom. Staff 2 stated since this incident, she and Staff 1 make sure the bathroom is empty before they leave the classroom, and they are doing head counts multiple times when they leave the classroom. On 04/18/2023 I spoke with Child A's Mother. She stated she was notified of the incident on 03/31/2023. Child A's Mother stated Child A was not upset by the incident and she has no concerns and believes it was an honest mistake by the staff. Child A's Mother stated she reminded Child A to tell the staff is she needs to go use the bathroom. 3

    On 12/08/2021, I conducted an unannounced on-site inspection. I Interviewed Katherine Melistas (program director/licensee designee), Theresa Scheuermann (school-age caregiver), Patricia Lindamood (school-age caregiver), Elisa Panyard (assistant caregiver-ECC), and Raelene Tucker (assistant caregiver- ECC). Ms. Melistas assured me that she has never failed to inform a parent if their child suffered an accident, injury, or incident while in care. Ms. Melistas provided me with the program's written plan for how and when a parent will be notified if a child experiences an accident, injury, or incident. 2 The plan states that a parent or guardian shall be notified immediately by a staff member if their child experiences an accident, injury, incident, or illness. Staff members are to contact the parent/guardian using the contact information found on the child's information card. An accident/incident report will then be completed and placed in the child's file, and LARA child care licensing is to be notified when required. Ms. Melistas indicated that there have not been any significant accidents or injuries this year. She denied receiving any complaints from parents or staff members about accidents, injuries, or incidents not being reported in accordance with the center policy. Ms. Scheuermann stated that parents are contacted when children have minor accidents. Ms. Scheuermann also indicated that if the injury is something more significant, they will contact the parents and fill out an accident/incident report. She denied having ever witnessed or hearing of a staff member not reporting an accident, injury, or incident to a parent, and indicated that she has never heard of a parent complaining about not being informed of an accident, injury, or incident. Ms. Lindamood stated that she and other staff members always report to the parent if a child injures themselves. Ms. Lindamood denied receiving complaints from parents about not being informed about a child injuring themselves while in care. Ms. Panyard stated that she is new to the program but is not aware of any concerns with staff members not reporting children's accidents, injuries, or incident to the parents. Ms. Panyaid denied hearing complaints from parents or staff members regarding this allegation. Ms. Tucker stated that staff members always report to parents when a child hurts themselves while they are attending the program. Ms. Tuckers denied having knowledge of any incidents in which a staff member failed to report injuries to parents.     On 12/08/2021, I observed the school-age after school program, and the ECC after school program. Both programs were in ratio as follows: • School-age after school program located in the cafeteria-(a child who is eligible to attend a grade of kindergarten or higher-requiring a 1:18 ratio) - 2 staff members with 22 children. • ECC after school program located in the Room A: preschool 4's classroom-(3 years of age until 4 years of age-requiring a 1:10 ratio) - 2 staff members with 16 children. While on-site I observed the attendance records for the school-age after school program for 12/02/2021; 12/06/2021; and 12/07/2021. The program-maintained ratio all three days: • 12/02/2021-3 staff members with 50 children. • 12/06/2021-3 staff members with 41 children. • 12/07/2021-3 staff members with 46 children Ms. Melistas provided me with the attendance records for the ECC after-school program for 12/02/2021; 12/06/2021; and 12/07/2021. The program-maintained ratio all three days: • 12/02/2021-3 staff members with 14 children. • 12/06/2021-3 staff members with 19 children. • 12/07/2021-3 staff members with 18 children. Ms. Melistas stated that both the school-age after school program, and the ECC after school program always maintain ratio. Ms. Melistas denied knowing of anytime either program was out of ratio and stated that she had never received any complaints from staff members or parents regarding ratio issues. Ms. Scheuermann and Ms. Lindamood denied ever seeing the school-age after school program out of ratio and stated that they usually have three staff members present. 4 Ms. Panyard and Ms. Tucker denied ever seeing the ECC after school program out of ratio. They further denied hearing complaints from any staff members or parents regarding ratio. On 1/18/2021, I conducted an unannounced on-site inspection. I observed the school-age after school program, and the ECC after school program. Both programs were in ratio as follows: • School-age after school program located in the cafeteria-(a child who is eligible to attend a grade of kindergarten or higher-requiring a 1:18 ratio) - 4 staff members with 33 children. • ECC after school program located in the Room A: preschool 4's classroom-(3 years of age until 4 years of age-requiring a 1:10 ratio) - 3 staff members with 20 children.
